The meeting began at 7:16 p.m. with four LPC members present. Adoption of Meeting Minutes: ?? ACCEPTANCE OF MEETING MINUTES FROM DECEMBER 7, 2010 & DECEMBER 21, 2010. MOTION made by John Sepenoski, seconded by Eric Keil, to accept the LPC meeting minutes from December 7, 2010, as revised. Motion carried: 4/0/1 (Chris Baiz abstained as not present for that meeting) MOTION made by Lillian Ball, seconded by John Sepenoski, to accept the LPC meeting minutes from December 21, 2010. Motion carried: 5/0 Land Preservation Applications and Inquiries: ?? SCTM #1000-107-10-10.1 (Girards) Review Survey Melissa gave status update of Girards project. Preliminary survey reviewed by committee and approved. It was noted that the Reserve Area was not designed to meet all Code minimum bulk requirements like lot depth, set-backs, etc., and could not be, due to existing buildings; however, it does meet minimum lot area. A mobile home is shown within easement area. Since existing, LPC will allow continued use if mobile home is being used for farm labor housing but landowner must provide all applicable permits for trailer and its use. ?? SCTM #1000-115-2-6 (Marratooka North LLC) Update re: status Eric Keil was not present during discussion of this project due to personal involvement. Melissa gave current status of project with LPC members and reviewed proposed ODA (open development area) subdivision that is now before the Planning Board for review. Landowner has proposed a conservation subdivision using ODA concept. A total of 4.5 acres is reserved from Easement Area. The landowner’s application to Planning Board is to obtain ODA approval for one additional lot on approximately ½ acre while leaving an area of 4 acres that includes the existing house. The 4 acre area will retain the right for a second use since it will be at least 160,000 sq ft, but will not retain the right for further subdivision. The creation of the ½ acre lot will result in subdivision open space which will be within the Easement Area. Subdivision Open Space is not considered buildable land; therefore, the landowner will not receive payment for this area. Applications & Inquiries for Uses or Structures on Preserved Property: None Stewardship and Management: ?? MONITORING (PROPERTY CONDITION) REPORTS: SCTM #1000-63-2-6.2 Reinckens f/k/a Duffy (per John Sepenoski) o Not discussed due to time constraints. SCTM #1000-107-5-6.3 B&H Farms f/k/a Courtenay (Eric Keil/Melanie Doroski) o Easement area is planted in grape vines and is being well-maintained. Deer fencing has been installed around perimeter. A submersible well, back flow, water meter and electric installation are visible beyond gated entrance. None of these improvements within the easement area have been approved by the Land Preservation Committee. Letter to be sent to landowner with Request for Agricultural Structure Placement on PDR lands form. SCTM #1000-112-1-8.2 Pangari f/k/a Simmons/Nicholas (Eric Keil/Melanie Doroski) o Easement area is planted in tree-shrub nursery stock. “Soundview Farm” sign has been erected along Sound Avenue within the easement area as well as a small office building (approximately 8’x10’) located in the southeasterly corner of the easement area. Split rail fencing appears to separate nursery stock from a designated parking area and a parking directional sign has been posted, all within the easement area. Although fencing is allowed, retail parking is not allowed within the easement area. There is an uncontained fuel storage tank for farm equipment operations located in the approximate center of the easement area. None of these improvements have been approved by LPC. Ed Harbes, neighboring landowner, will be contacted regarding retail parking on easement area. Letter to be sent to landowner with Request for Agricultural Structure Placement on PDR lands form for formal approval for fuel storage tank, fencing, sign. Verification needed for what appears to be retail parking for an adjacent farm stand operation and small office building, neither being allowable uses on PDR lands. SCTM #1000-112-1-9.1 N&L Properties, LC f/k/a Koroleski (Eric Keil/Melanie Doroski) o Property is for sale. Easement area is fallow farmland that is being overgrown with tall grasses, shrubs, small cedar trees, etc. Invasive plant life – Bittersweet, Tree of Heaven, Russian Olive, Ornamental Pear – has taken root in several areas. Existing farm roads are overgrown but somewhat passable. Stephen Searl of PLT will be contacted as he may have personal contact with current landowner and can suggest that mowing the farmland, before plant growth becomes detrimental to farming, would make land more marketable. There is no mowing requirement within the recorded easement language. SCTM #1000-113-7-19.26 Bicycle Path, LLC f/k/a Simicich (Eric Keil/Melanie Doroski) o Easement area is planted in grape vines and being well maintained. “Duck Walk Vineyards” sign has been erected along Bergen Avenue. SCTM #1000-115-2-9.3 Foreman f/k/a Sidor, Barney (Eric Keil/Melanie Doroski) o Not discussed due to time constraints. SCTM #1000-120-5-1 Macari f/k/a Smith, Thornton (Eric Keil/Melanie Doroski) o SCTM #1000-121-1-1-6 Macari f/k/a Smith, Thornton (Eric Keil/Melanie Doroski) o A large portion of the easement area is planted in grape vines and is being well-maintained. Portion of the easement area is fallow field. Deer fencing has been installed. An agricultural storage building, as approved by LPC on 9/19/2008 has been constructed. Although deer fencing is an allowable structure within the easement area, LPC was not notified of its placement. Letter to be sent to landowner with Request for Agricultural Structure Placement on PDR lands form. Following monitoring reports not discussed due to absence of Maureen Cullinane. Position has been posted within Town Hall. Formal advertisement for employment will be in local newspaper, 1/13/2011 edition. Resumes are due by January 28, 2011 for part-time position. ??
