THIS INDENTURE, made the 30th day of December, 2010
BETWEEN
CLAIRE A~ MANNING AND MARITA MANNING-FRANZMAN, as Trustees of the Mar~al Trust U/W of
John P. Manning Article Third, as to their entire (49%) undivided interest in the property described
bolder, and CLAIRE A. MANNING, as to her entire one (1%) percent undivided interest in the property
described below, Claire A. Manning residing at 1540 Jackson Street, P.O. Box 262, New Suffolk, N.Y.
11956, and Marita Manning-Franzman residing at 110 Meetinghouse Creek Road, Aquebogue, N.Y.

MANNVIEW, LLC, a New York Limited Liability Company with olT~,,es at 1540 Jackson Street, New
Suffolk, New York 11956, the party of the second part,
WITNESSETH, thai the party of the first part, in consideration of Ten and 00/100-($10.00)-Dollars, and
other good and valuable consideration paid by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever,
All that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the Village of New Suffolk, Town of Southold, County of Suffolk and State of New York,
more particularly bounded and described as follows:
BEGINNING at a point on the southerly side of Jackson Streel, distant 231.57 feet westerly from the
corner formed by the intersection of the southerly side of Jackson Street wi~ the westedy side of Fifth
Street;
Running Thence South 6 degrees 08 minutes 20 seconds West 421 feet to the ordinary high water mark
of Great Peconic Bay as it existed and as shown on a survey by Van Tuyl and Son, Licensed Land
Surveyors, dated May 24, 1957, and further on said course to the current ordinary high water mark of
Peconic Bay;
Running Thence along said high water mark westerly 100 feet more or less to the easterly side of lands
formerly of James Manning;
Thence North 6 degrees 08 minutes 20 seconds East along the easterly side of said last mentioned land
to the southerly side of Jackson Street; the distance in prior deeds being 424 feet, plus accretions;
Thence South 84 degrees 00 minutes 00 seconds East along the southerly side of Jackson Street 100 feet
to the point or place of BEGINNING.
Together with any accretions of the Premises.
SUBJECT TO any state of facts that an accurate survey may show.
SUBJECT TO covenants, restrictions, reservations, easements and agreements of record, if any.
TOGETHER WITH all right, title and interest, if any, of the party of the first part to the present high water
mark of said premises.
TOGETHER WITH ail rights and privileges of the party of the first part to the use of the water supply from
the well located of the property owned by James P. Manning which is adjacent to the above described
property.
BEING AND INTENDED TO BE the same premises conveyed to John P. Manning by deed dated May 21,
2005, recorded November 15, 2005 in Libor 12419 page 826.
TOGETHER wilh all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and ail the estate and rights of the party of the first pad in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successom and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose =f paying Ihe cost of the improvement and
will apply the same first to the paymenl of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read ~parties" whenever the
sense of this indenture so requires.
