CLAIRE A. MANNING, as Exec~rix of the Estate of John P. Manning a/Ida John Philip Manning who
died a resident of Suffolk County on September 20, 2009 and whose will admitted to probate by the
Suffolk County Surrugates Office on July 29. 2010 under Probate File No. 2610-2247, residing 1540
Jackson Streel, P.O. Box 262, New S~folk, New York 11955, the party of the firs~ part, and
CLAIRE A. MANNING AND MARITA MANNING*FRANZMAN, as Trustees of the Credit Shelter Trust
URV of John P. Manning Article Third, as to an undivided f'~y (50%) percent interest; and
CLAIRE A. MANNING AND MARITA MANNING-FRANZ~AN, as Trustees of the Marital Trust U/W of
John P. Manning A~icle Third, as to an undivided forty-nine (49%) interest; and
CLAIRE A. MANNING, as to an undivided one (1%) percenl interest,
Claire A. Manning residing at 1540 Jackson Street, P.O. Box 262, New Suffolk, New York 11956, and
Madta Manning-Franzman residing at 110 Meetinghouse Creek Road, Aquebogue, New York 11931,
the party of the second part,
.WiTN ESSETH, that the party of the first part, in consideration of Ten and 00tl00-($10.00)-Dollars and in
distribution of the real pmpady described herein pursuant to said will, and other good and valuable
consideration paid by the party of the second part, does hereby gran{ and release unto the party of the
second pad, the heirs or successors and assigns of the party of the second part forever,
All that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, siluate,
lying and being in the Village of New Suffolk, Town of Southold, County of Soffotk and State of New York,
more particularly bounded and described as follows:
BEGINNING at a point on the southerly side of Jackson Street, distant 231.57 feel westerly from the
cotter formed by the intersection of the southerly side of Jackson Street with the westerly side of Fh~h
Street;
Running Thence South $ degrees 08 minutes 20 seconds West 421 feet to the ordinary high water mark
of Great Peconic Bay as it existed and as shown on a survey by Van Tuyl and Son, Licensed Land
Surveyors, dated May 24, 1957, and furthe~ on said course to the current ordinary high water mark of
Peconic Bay;
Running Thence along said high water mark w;eatedy 100 feet more or less to the easterly side of lands
formerly of James Manning;
Thence North 6 degrees 08 minutes 20 seconds East along the easterly side of saic[ last mentioned land
to the southerly side of Jackson Street; the di~ance in prior deeds being 424 feet, plus accretions;
Thence South 84 degrees 00 minutes O0 seconds East along the southerly side of Jackson Street 100 feet
to the point or place of BEGINNING.
Together with any accretions of the Premises.
SUBJECT TO any state of facts that an accurate survey msy show.
SUBJECT TO covenants, restrictions, reservations, easements and agreements of record, if any.
TOGETHER WITH all right, title and interest, if any, of the party of the first part to the present high water
mark of said premises.
TOGETHER WITH all rights and privileges of the party of the first part to the use of the water supply from
the well located of the property formerly owned by James P. Manning which is adjacent to Ihs above
described property.
BEING AND INTENDED TO BE the same prer~ises conveyed to John P. Manning by deed dated May 21,
2005, recorded November 15, 2005 in Liber 12419 page 826.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all Ihs estate and rights of the party of the first part In and to said premises,
TO HAVE AND TO HOLD the premises herein granled unto the party of the second part, the heirs or
successors and assigns of the I~arty of the second part forever.
AND the party of the first part covenants that Ihs party of the first pad has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesakt.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be apl~ied first for the purpose of paying the c~st of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word 'party" shall be construed as if it read 'parties" whenever the
sense of this indenture so requires.
