WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Mattituek in the Town of Sou,hold, County of Suffolk arid State
of New York bounded and described as follows:
BEGINNING at a monument set on the southerly side of Westphalia Road, said monument being
south 67 degrees 35 minutes 20 seconds west 24.86 feet from the intersection of the southerly side
of Westphatia Road and the westerly side of Bennet's Pond Lane, said monument marking the
northeast~ly comer of premises herein described:
RUNNING THENCE from said monument and point of beginning south 29 degrees 32 minutes 00
seconds east 241.00 feet to a point and land now or formerly of Baldwin;

THENCE along said land now or formerly of Wells, south 67 degrees 35 minutes 20 seconds
214.90 feet to other land now or formerly of' Wells;
THENCE along said land, north 29 degrees 32 minutes 00 seconds west, 241.00 feet to the
southerly side of W,stphalia Road;
THENCE along the southerly side of Westphalia Road, north 67 degrees 35 minutes 20 seconds
east, 214.90 feet to the monument and place of BEGINNING.

BEING AND INTENDED TO BE the same premises conv~yed to the party of the first ~ by
deed dated November I 1, 1997 and recorded May 7, [998, in the Office of the County Clork of
the County of Suffolk ip Liber 11892, Page 173.
TOGETHER with all the right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises ti> the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, tho heirs or successors and assigns of the'party of the second part foreoer.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except .as
aforesaid.
AND the party of the first part in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the co~t of
the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose. .
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
