Findings: The project meets all the requirements for issuance of an Emergency Wetlands Permit as determined by the Board of Trustees. The issuance of the Emergency Wetlands Permit allows for the operations as indicated on the project plan dated January 10,2011. Special Conditions: A full Wetland Permit must be applied for within 90 days of the date of this permit in order to conduct any further activity. This is not a determination from any other agency. Backfill structure with approximately 50 cubic yards of upland-source sand, The wail will consist of three courses of 2'x 2'x 6', 6,000 pound blocks. The wOrk shall be as shown on the attached sheet I of 1 drawing dated 1/10/11 by Eh-Consultants, Inc. stamped "NYSDEC Approved 1/10/11". Findlno That an Emeroencv Exists: Based on the Department's review of the situation, inspection of the site and the information provided by the applicant, and having consulted with the Department's Offices of Natural Resources, the Department has determined that this situation meets the definition of an emergency, "an event which presents an immediate threat to life. health, ~rol~ertv. or natural resources,~ as defined in the Uniform Procedures regulations. Section 621.1 (j). There is currently an immediate threat to the structural integrity of the existing house due to erosion of the Long Island Sound shoreline in the project area. This situation is an immediate threat to significant property and safety. Accordingly, the Department hereby made a finding that an emergency exists pursuant to Section 621.12 of the Uniform Procedures Act regulations due to the threat noted above. The Department has determined that emergency action is necessary in order to protect the Pologeorg~s residence from continued shoreline erosion. Authorized and issued by: George W. Hammarth Deputy Regional Permit Administrator Please note further that this Emergency Authorization is granted subject to the following conditions in accordance with Section 621.1 2(e) (2) of the Uniform Procedures regulations: SPECIAL CONDITIONS All work is to be performed in accordanc~ with the conditions described below: 1. The concrete block wall authorized pursuant to this emergency authorization shall be removed as part of the planned future shoreline stabilization project for this Site. 2. No excavation of the beach is authorized for the purpose of obtaining fill or stone materials. 3. All activities authorized by this emergency authorization must be in stdct conformance with the approVed plans submitted by the aPPlicant or his agent as part of the emergency authorization application. 4. All fill shall consist of clean sand, gravel or Soil (not asphalt, slag, flyash, broken concrete or demolition debris). 5. The storage of construction equipment and materials shall be confined to the beach landward of the line of apParent high water, Any debris or excess material from construction of this project shall be completely removed from the adjacent area (upland) and removed to an approved upland area for disposal. No debris is permitted in tidal wetlands or protected buffer areas. This Emergency Authorization is issued for a 30-day period commencing on the effective date and ending at midnight on the expiration date. This authorization may be renewed for an additional 30-day period provided the permittee requests said renewal in writing and complies with ali conditions contained herein. Said renewal request must be submitted to the Regional Permit Administrator no later than 7 days pdor to the expiration of the original 30-day period and no additional activity may occur after the expiration of the odginai 30-day period unless authorized in writing by the Department prior to commencement of said activities. As per 6 NYCRR Part 621, Section 621.12(i), a person who violates any term or condition of an Emergency Authorization will be ordered to pedorm any necessary restoration or mitigation of environmental damage resulting from that action.
