Thanks. Dear Southold Town Trustees, I am a resident of Sigsbee Road in Mattituck and have a few concerns regarding the properties at 2999 and 3105 Sigsbee Road. I have no objections to the work being performed at the properties to repair the bulkheads. The debris from the original bulkheads washed up on Sigsbee Road Beach and destroyed the chain link fence on the east side of the beach property and the Sigsbee Road Civic Association bore the costs of the cleanup and will be before the Trustees shortly to install a new fence. However, I had an incident this summer with I believe the resident at 3105 Sigsbee Road. My 9 year old daughter and her friend were swimming in the bay and wandered into the swimming ropes installed by the applicants. A woman from the property walked out of her house onto the beach to chase and harass the kids because they were swimming inside their swimming lines. I was very upset and confronted the owner and asked to see her survey showing she owned the water and permit for the ropes knowing she had neither. I even challenged the owner to call the police. These owners believe that since they put in ropes in front of their properties they are entitled to the water and can chase people who swim in this area. There has also been many occasions in the past when the property owners have refused passage from Sigsbee Road beach to Marlene Lane beach even when walking seaward of MHW. I do not oppose the swimming lines since they provide a barrier of protection for the bathers and there is space available to boaters to access the bay. I request as a condition of the permit that the owners are made aware of the rights of access along the beach and water. It is my understanding they own the landward of the MHW which can vary from day to day and do not own underwater land. If my assumptions above are not correct, please advise me as to our rights since I want to sure we respect the owners property rights. Thank you for your time. Sincerely, John J. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided the following best management practice is required pursuant to: § 275-11. Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: (2) Erosion control. Installation of an erosion control structure is necessary during any building, grading, landscaping or site work activity within Trustee jurisdiction. This structure may include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt booms. The placement of the erosion control structure(s) shall be determined by the Trustees or their designee. All intertidal construction and excavation requires the installation of a silt boom that will retain all suspended sediments within the immediate aroiect area. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
