That there will be no unreasonable interference with navigation as a result of thc work herein authorized. That if furore operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. Box 933 Cutchogue, NY 11935 RE: THOMAS & MAUREEN DOWLING 1200 BROADWATERS ROAD, CUTCHOGUE SCTM# 104-9-3 Dear Mr. Schwartz The Board of Town Trustees took the following action dudng its regular meeting held on Wednesday, September 22, 2010 regarding the above matter: WHEREAS, Mark Schwartz, Architect on behalf of THOMAS & MAUREEN DOWLING applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southoid, application dated August 16, 2010, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfrent Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Headng was held by the Town Trustees with respect to said application on September 22, 2010, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of THOMAS & MAUREEN DOWLING to construct an addition between the existing house and existing garage apartment; construct alterations within building; second-floor expansion; proposed rear deck and screened-in porch; for the existing flagpole; and for a 4' wide access path to the boat basin; with the conditions that the existing wetland areas are to be left in its natural state and are not to be mowed with the exception of the 4' wide access path to the boat basin; and as depicted on the site plan prepared by Mark Schwartz, Architect, last dated September 23, 2010, and stamped approved on October 4, 2010. SCTM#104-9-3 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the LWRP provided that the following best management practices are implemented to meet and further the below listed policies: Poficy 5. Protect and improve water quality and supply in the Town of Southold Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem 6.3 Protect and restore tidal and freshwater wetlands. Provide adequate buffers between wetlands and adjacent or nearby uses and activities in order to ensure protection of the wetland's character, quality, values, and functions. E. Maintain buffers to ensure that adverse effects of adjacent or nearby development are avoided: Maintain buffers to achieve a high filtration efficiency of surface runoff. Avoid permanent or unnecessary disturbance within buffer areas. Maintain existing indigenous vegetation within buffer areas. Existing Conditions - A site inspection was conducted on September 9, 2010. This site is unique in that high marsh wetland vegetation (spar#na patens, distich#is spicata, iva frutescens, baccharis halimifolia and salicornia sp.) occurs landward of the bulkhead for a distance of 115_+ feet. The vegetation is mowed in several areas: to maintain a wide (greater than 11') path to an existing boat basin and catwalk, around an existing flagpole and west of the boat basin to maintain a sitting area (beach chairs were observed). Evidence of frequent ponding was also observed behind the bulkhead in areas of lower elevation surrounding the flagpole. The area is a wetland and subject to Chapter 275 Wetlands and Shorelines provisions of the Southold Town Code. Hydrology on site indicates that if the mowed areas were allowed to re- establish, high marsh wetland species would re-colonize the areas. It is recommended to minimize impacts to surface and subsurface water quality, vegetation and habitat from the developed areas that a buffer be established to preserve the natural (wetland) vegetation. The landward limit of the buffer is proposed to be where the (line) of existing wetland vegetation meets the lawn area. Access to the water should be achieved via an unimproved path of a specified width. The area surrounding the flagpole and sitting area (white circle below) could be continued to be mowed. A sample definition of a natural vegetated buffer is included for your use. NATURAL VEGETATED BUFFER -- a land area of a certain length and width where existing vegetation occurs prior to the commencement of any grading or clearing activity. Vegetation shall be maintained to achieve a minimum percent ground cover of ninety-five (95) percent. To achieve the percent ground cover indigenous, drought tolerant vegetation shall be planted. Survival of planted vegetation shall be (ninety) 90 percent for a period of three (3) years. Maintenance activities within the buffer are limited to removing vegetation which are hazardous to life and property, trimming tree limbs up to a height of fifteen feet (15') to maintain viewsheds, replanting of vegetation and establishing a four foot (4') wide access path constructed of pervious material to access the water-body.
