AUTHORIZATION
Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
November 17, 2010, and in consideration of application fee in the sum of $250.00 paid by Luke & Rita Licalzi
and subject to the Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees
authorizes and permits the following:
Wetland Permit to construct approximately 177 linear feet of vinyl bulkhead in
place of (and 18" higher than)existing timber bulkhead and backfill embankment
landward of bulkhead with approximately 140 cubic yards clean sand to be replanted
with native vegetation and restored and maintained as a natural vegetated buffer; and
install approximately 127 linear feet of 1.5' to 2.5' diameter, approximately 300-1,000
lb. fieldstone on filter cloth and backfill with approximately 45 cubic yards sand to be
planted with beach grass to restore and vegetate upland area lost to erosion; and as
depicted on the site plan prepared by EN-Consultants, Inc., last dated October 20,
20i0, and stamped approved on November 17, 2010.
IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee Luke & Rita Licalzi, residing at 2105 Calves Neck Road, Southold, New York
as part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
That the said Board of Trustees and the Town of Southold are released fi.om any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction
to the deed of the subject parcel. Such evidence shall be provided within ninety (90)
calendar days of issuance of this permit.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failiare to obtain same.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, November 17, 2010 regarding the above matter:
WHEREAS, EN-Consultants, Inc. on behalf of LUKE & RITA LICALZI applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated October 27, 2010, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application to
construct approximately 177 linear feet of vinyl bulkhead in place of (and 18" higher
than) existing timber bulkhead; and the installation of approximately 127 linear feet of
1.5' to 2.5' diameter, approximately 300-1,000 lb. fieldstone on filter cloth and backfill
with approximately 45 cubic yards sand to be planted with beach grass to restore and
vegetate upland area lost to erosion be found Consistent with the Local Waterfront
Revitalization Program policy standards, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application to
backfill embankment landward of bulkhead with approximately 140 cubic yards clean
sand to be replanted with native vegetation and restored and maintained as natural
vegetated buffer be found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered the Local Waterfront Revitalization
Program policy 4.1 to the greatest extent possible through the imposition of the
following Best Management Practice requirements: the use of native vegetation is to be
used to re-vegetate the disturbed areas, and
WHEREAS, a Public Headng was held by the Town Trustees with respect to said
application on November 17, 2010, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be

of the Southold Town Code, and,
RESOLVED, that the Board of Trustees APPROVES the application of LUKE & RITA

with approximately 140 cubic yards clean sand to be replanted with native vegetation

Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.

The CAC Supports the application the Condition the rip-rap is used across the top of the
landward bulkhead with no increase in elevation, the height of the bulkhead is not raised,
the size of the non-turf vegetated buffer is increased to 10' across, and the run-off from
the driveway in captured into drywells.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
depadment, as well as the records available to me, it is my recommendation that the proposed actions;
1. Construct approx. 177 linear ft. of vinyl bulkhead in place of (and 18" higher than) existing timber
bulkhead;
Installation of approx. 127 If. of 1.5' to 2.5' dia., approx. 300-1,000 lb. fieldstone on filter cloth
and backfill with approx. 45 cy. sand to be planted with beach grass to restore and vegetate
upland area lost to erosion;
are CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided
the following best management practice is required pursuant to:
§ 275-11. Construction and operation standards.
A. General. The following standards are required for all operations within the jurisdiction of the
Trustees:
(2) Erosion control. Installation of an erosion control structure is necessary during any building,
grading, landscaping or site work activity within Trustee jurisdiction. This structure may include, but is
not limited to, installation of a silt fence, hay bales, wood chip berm and silt booms. The placement of
the erosion control structure(s) shall be determined by the Trustees or their designee. All intertidal
construction and excavation requires the installation of a silt boom that will retain all
suspended sediments within the immediate proiect area

exposure, geometry, and sediment composition.

The area from the top of bank seaward is protective natural feature. The proposal includes back filling
of existing vegetation (see submitted survey dated 10/20/10) that is currently stabilizing the bank (see
following photo). It is recommended that the Board further evaluate the need to raise the grade behind
the proposed new bulkhead and the backfilling of existing vegetation.

written determination regarding the consistency of the proposed action.

Statement of the effect, if any, on the wetlands and tidal waters of the town that may result by
reason of such proposed operations (use attachments if appropriate):
The project consists ofiwo components. The fi~st is the ordinary and routine replacement of an existing timber bulkhead, in-place, with a vinyl bulkhead to be
elevated 18 inches higher than the existing bulkhead. The existing vegetated embankment behind the bulkhead, which is steeply sloped, eroding, and being
infiltrated by invasive vegetation, will be backfilled and regraded to the new bulkhead height at a more gradual slope and replanted with native vegetation so
that it may be restored and maintained as a natural vegetated buffer. The second, using stone, backfill, and native plantings, is the partial reclamation and
vegetative restoration of an upland area that was lost avalsively to erosion in the spring of 2010 as a result of two consecutive nor'easter storm events. The
embankment separating the maintained lawn and upland from the beach has eroded landward by as much as 44 feet since 2001, at which time much smaller
stone was permiacd to help stabilize the embankment location at that time. This part of the project will similarly establish a vegetated nonturf buffer between
the beach and the current, reduced, lawn area. The project will therefore serve the dual purpose of stemming the erosion and loss of the applicant's upland and
establishing or restoring vegetative buffer areas between the upland and tidal wetlands and waters of the Town. In addition to providing flood and erosion
protection, these buffers provide habitat and increased stormwater absorption capacity and filtration of contaminants adjacent to wetlands.

The project is consistent with Policy 4 because it seeks to incorporate vegetative non-structural measures, i.e., vegetative buffer, with a
hard structural erosion protection measure, i.e., stone armor, to stem the loss of the eroding shoreline and partially reclaim and
vegetatively restore an upland area that was lost avulsively to erosion in the spring of 2010 as a result of two consecutive nor'easter
storm events. The proposed structural erosion protection measure is limited to the minimum scale necessary and must be employed
where natural protective features are absent and vegetative means of erosion control have been ineffective. For example, marsh grasses
that were was planted when smaller scale rip-rap was permitted and installed in 2001 were quickly lost, and even buffer vegetation
planted behind the rip-rap was lost when the smaller rip-rap was overtaken by erosive wave action, resulting in the landward erosion of
the upland embankment by as much as 44 feet since that time. As the structure will be located entirely landward of spring high water,
the project will in no way impede upon public trust lands or access thereto. The in-place replacement of the bulkhead is defined under
Chapter 268 as a minor action that is exempt from waterfront consistency review.
