We are aware of an application filed by En-Consultants, Inc. on behalf of John Kramer. The application seeks your Board's authorization to construct 137 linear feet of stone rip-rap and 148 linear feet of vinyl retaining wall to deposit 95 cubic yards of sand and to plant beach grass landward and seaward of the proposed retaining wall. Mrs. Anderson's concern is that the proposed shore hardening structures may cause significant erosion to the un-bulkheaded portion of her property. Such concern is legitimate. Both the property of Kramer and the property of Anderson are subject to direct wave action from winds emanating from the southeast. Previously, both properties were protected from southeasterly wave events due to the existence of a sand spit maintained by timber jetties at the mouth of Jockey Creek and Town Creek. That sand spit has all but disappeared, attached herewith at Exhibit A is an aerial photo taken from a soil survey of Suffolk County, New York issued on April, 1975, that shows the sand spit that used to protect both properties from a southeasterly wind and wave event. Up to the 1980's the sand spit was used as a spoil site for adjacent dredging activities. The sand spit referred to herein is labeled B.C. ("beaches"). Attached hereto at Exhibit B is an aerial photo obtained from Google Maps dated September 20, 2010. Our initial review of this application reveals that there is no erosion occurring in the vicinity of the proposed regulated activities. A comparison of the site plan prepared by Allen Glenn Bernhard, P.E., P.C., stamped approved by the Southold Trustees on January 23, 2008, and the survey prepared by Nathan Taft Corwin, III, L.S. stamped received October 27, 2010, reveals that the distance from the front lot line to mean high water are virtually the same. The site plan shows the western lot line extending from the front lot line to mean high water at 216.57 feet, whereas the survey discloses the same lot line at 218.85 feet. In contrast a comparison of the site plan against the survey on the eastern lot line shows a loss of approximately 7-8 feet where the existing rock revetment was installed. Thus, the stabilization sought by Mr. Kramer is a preventive measure (in the event the property is subject to a severe storm event). The proposed fill consisting of clean sand is something this Board should support. The proposed rip-rap consisting of 100-300 lb field stone on filter cloth is considered light and its purpose appears to be largely to retain the sand fill that would be deposited adjacent thereto. The planting of beach grass landward and seaward of the rip-rap would further stabilize the sand fill area above the rip -rap and the beach area below the rip-rap The proposed vinyl retaining wall consists of a whaler, a top clamp and vinyl sheathing driven into the ground. The section through the proposed rip-rap and retaining wall detail depicts the vinyl sheathing to be 10 feet in length (2 ft above grade and 8 ft below grade). The accompanying note shows the vinyl sheathing to 20 ft in length (should be 10 feet in length). It is clear that the proposed retaining wall is a structure whose purpose would be to protect the Kramer property in the event of a severe or catastrophic storm. Given that the intended purpose of the retaining wall, we recommend that the retaining wall be relocated further landward (to the seaward edge of the escarpment). We suggest that the proposed 18 feet of beach grass plantings be reduced such that the usable lawn portion of the Kramer property remain the same. Attached herewith at Exhibit C is a copy of the Site Plan prepared by En-Consultant, stamped received October 27, 2010, which depicts the alternative location suggested in this correspondence. We also recommend that the sand spit area to be utilized again as a spoil site as to provide needed shoreline protection to all waterfront owner in the immediate neighborhood. Sincerely, Matt D. NOW, THEREFORE, in consideration of TEN DOLLARS ($10) paid by Grantee to Grantor, and other good and valuable consideration, the mutual receipt and legal sufficiency of which Grantor hereby acknowledges, Grantor and Grantee hereby agree as follows: 1 . Grantor hereby grants unto Grantee, its heirs and assigns, (i) full, fres and exclusive right and author- ity, and an easement, to maintain, repair, use and draw water from the Well , in such manner and in such quantities as Grantee, its heirs and assigns, shall deem appropriate in its sole and absolute discretion, and (ii) full and free right and authority, and an easement, to maintain, use and repair the Pipes running from the Well along the Strip, it being expressly acknowledged and agreed that Grantor, his heirs and assigns, shall have no rights to use- or draw water from the Well in any event whatsoever. 2 . Grantor hereby grants unto Grantee, its heirs and assigns, a non-exclusive right of access for Grantee, its agents , employees and invitees, to enter upon the Burdened Property to repair, replace, maintain, or reconstruct all or any part of the Well or the Pipes, it being expressly understood and agreed that Grantee, its heirs and assigns, shall not have any obligation to repair, replace, maintain or reconstruct all or any part of the Well or the Pipes in any 4 event whatsoever. Grantee, its heirs and assigns, agree that 5 whenever it shall enter upon the Burdened Property for purposes of exercising its rights hereunder, Grantee, its 6 heirs and assigns, shall (i) perform any work relating to the 7 Well and the Pipes with due diligence, in a good and workerlike manner, and in compliance with all laws, rules, 8 regulations, and requirements of all governmental authorities 9 having jurisdiction thereover, (ii) restore, as soon as practicable, the Burdened Property to the condition which 10 existed immediately prior to the time such work was 11 commenced, and (iii) remove all debris and materials promptly after such work is completed. 12 3 . Grantor, his heirs and assigns, shall have the 13 right to use those portions of the Strip which are not actually occupied by the Well or the Pipes; provided that 14 such use does not interfere with the rights and easements 15 granted to Grantee by Grantor hereunder and further provided that Grantor, his heirs and assigns, shall not have the right to erect any structures on the Strip, but nothing contained herein shall prohibit Grantor from fencing the Burdened Property in accordance with municipal regulations. 4 . The rights and easements herein contained shall run with the land and be binding on the parties hereto and their respective heirs and assigns. 5 . This Agreement may not be modified or terminated nor may any of its provisions be waived orally, but only by an instrument in writing, executed by the parties hereto. 6. This Agreement shall be governed by and construed in accordance with the laws of the State of New York. 7 . This Agreement .constitutes the only and entire agreement between the parties, and all representations, understandings and agreements had between the parties with respect to the subject matter of this Agreement are merged herein. 8 . If this Agreement contains any unlawful provision, the same shall be deemed of no effect and shall be deemed stricken from this Agreement without affecting the binding force of the remainder. 9 . In the event that the Well or the Pipes .shall not be used and usable for a continuous period of one (1) year, then the easement herein granted to Grantee shall cease and be of no force and effect. 10. All equipment used by Grantee in connection with this well easement shall be contained below the surface of the ground and shall not be visible from the surface as presently constituted. Ho sheds or pump houses or any apparatus shall be placed above ground. 11 . Grantor shall have no obligation to maintain the Pipes and the Well unless required as a result of Grantor's negligence or willful act. In response to the significant loss of the most exposed easterly portion of the property during the past 10 years,a rock revetment was permitted to be installed in 2008,and that portion of the property has since remained stable. Currently,smaller stone rip-rap is proposed entirely landward of spring high tide on the westerly side of the property to stem the further erosion of the shoreline and beach grass that has continued since that time and to reestablish and maintain a more protected vegetated beach grass area. A retaining wall is also proposed farther upland near the edge of the lawn to provide a long-term erosion protection measure for the developed portion of the property. The vegetated area landward of the retaining wall will be backfilled,replanted,and maintained as a vegetated buffer seaward of the lawn. The project will therefore serve to stem and protect against the continued erosion of the shoreline and naturally protective vegetation while establishing or restoring vegetative buffer areas between the upland and tidal wetlands and waters of the Town.
