Box 2124 Greenport, NY 11944 RE: STUART THORN 19375 SOUNDVIEW AVENUE, SOUTHOLD SCTM# 1000-51-1-20.1&21 Dear Mr. Costello: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wednesday, December 11, 2019: WHEREAS, Costello Marine Contracting Corp., on behalf of STUART THORN applied to the Southold Town Trustees for an Amendment to Wetland Permit#7429 and Coastal Erosion Permit #7429C under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated October 25, 2019, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found to be Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, 2 NOW THEREFORE BE IT, RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to Permit#7429 and Coastal Erosion Permit #7429C to install a 12' rock revetment using 3-5 ton rocks in the space between west end of existing bulkhead and proposed rock revetment on adjacent neighbor's property; and as depicted on the site plan prepared by Costello Marine Contracting Corp., dated October 14, 2019, and stamped approved on December 11, 2019. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of$50.00 per inspection. (See attached schedule.) Located: 19375 Soundview Avenue, Southold. SCTM# 1000-51.-1-20.1 & 21 S.E.Q.R.A. NEGATIVE DECLARATION OF ENVIRONMENTAL SIGNIFICANCE: WHEREAS, the Southold Town Board of Trustees are familiar with this project having visited the site on December 4, 2019, and having considered Costello Marine Contracting Corp. plans for this project dated October 14, 2019; and the survey of Nathan Taft Corwin III, Land Surveyor, last dated September 22, 2010, shown at the Trustee's December 9, 2019 work session; and WHEREAS on December 11, 2019 the Southold Town Board of Trustees declared itself Lead Agency pursuant to S.E.Q.R.A.; and WHEREAS, on December 11, 2019 the Southold Town Board of Trustees classified the application of STUART THORN as an Unlisted Action pursuant to S.E.Q.R.A Rules and Regulations. A Short Environmental Assessment Form and a field inspection have been completed by the Board of Trustees; and it is hereby determined that it will not have a significant effect on the environment, and; WHEREAS, in reviewing the Costello Marine Contracting Corp. plans for this project dated October 14, 2019; and the survey of Nathan Taft Corwin III, Land Surveyor, last dated September 22, 2010, shown at the Trustee's December 9, 2019 work session, it has been determined by the Southold Town Board of Trustees that all potentially significant environmental concerns have been addressed as noted herein: • No existing rocks or boulders are to be utilized, moved, or relocated on the beach; • Access to the site for construction will be by barge, access by or over the bluff will be prohibited; • Damage to existing vegetation will be kept to a minimum; • As time progresses continued soil loss at the toe of the bank will contribute to site instability; • A site inspection by the Southold Town Board of Trustees on December 4, 2019 recognized the need for a stabilization/erosion control plan. THEREFORE, according to the foregoing, the Southold Town Board of Trustees Approve and Authorize the preparation of a Notice of Negative Declaration pursuant to SEQRA for the aforementioned project. I understand that Mr. Perros's staircase crosses onto my property and that it is his intent to remove the existing staircase and construct the new stairway entirely on his property. I hereby give my permission to remove any part of the staircase that impedes onto my property,along with the concrete debris located beneath the lowest platform of the stairway. Once the staircase and debris are removed,however, an approximately 12-foot portion of shoreline fronting my property between my existing bulkhead and west property line would be left unprotected Therefore, Costello Marine Contracting has submitted a request on my behalf to amend my bulkhead permit to allow that area of shoreline to be protected with a 12-foot stretch of armor stone consistent with the design of the proposed Perros revetment, thus creating a continuous shoreline structure between our two properties. The application would be better served by a re-engineered plan. See attached report. Vote of Council: Ayes: All Motion Carried 12 October 2010 The Conservation Advisory Council cannot support the present application of Stuart Thom, 19375 Soundview Ave. Southold to armor the base of a wood bulkhead with 425 tons of rock consisting of 1-3 ton rock for the following reasons. The present seawall is now footed at or below mean high water (MHW) on state titled public land which is contrary to the statement in the application (see photo). The placement of 425 tons of rock on public land would illegally deny safe public passage along the shore. This large volume of rock placed upon public property represents a taking of public land by a private party which can only be legally executed by public referendum. This is of particular concem to the CAC as an extensive length of the shoreline bordering this eastern section of Soundview Ave has suffered recent major erosions involving a number of property owners who are or have been permitted to protect their properties by armoring the base of seawalls or bulkheads much of it maybe below MHW.. This effectively closes off thousands of feet of public land adjacent to a town beach from lawful public passage. Such applications are legally obligated to provide a means by which the public can safely navigate the state titled public land. The massive hardening of this section of the shoreline will result in transfer and intensification of storm surges eastward to erode the unprotected shoreline at the east end of Soundview Ave, Route 48, the Town Beach and Hashamomuck Bay. The project location faces the Long Island Sound. This coastal area endures extreme wave energies and most properties are bulkheaded to prevent further erosion. Southold Town code also states that the bulkheads along this shoreline be armored with rock. So are proposal is consistent with the Town's regulations. Policy 2 Preserve historic resources of the Town of Southold. Our proposal will have no effect on the historic resources of the Town of Southold. Policy 3 Enhance visual quality and protect scenic resources throughout the Town at Southold. Our proposal will not have a significant effect on the visual quality. The rock will soften the coastal line visually by giving it a more natural look than a fiat faced bulkhead. NATURAL COAST POI TCZES Policy 4 Minimize loss of life, structures, and natural resources from flooding and erosion. Placing the rock armor will soften the reflective wave energy that is generally seen with fiat faced bulkheads. The rock breaks then disperses the energy so that properties down shore will not be as affected by the reflective energy. The rock will also protect and reinforce the bulkhead so that the bulkhead has a greater chance of being functional for more than 30 years.
