The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested: A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 1. Avoid development other than water-dependent uses in coastal hazard areas. Locate new development which is not water-dependent as far away from coastal hazard areas as practical. b. Avoid hazards by siting structures to maximize the distance from Coastal Erosion Hazard Areas. The proposed use is residential and therefore is not a "water dependent use". The deck in not a permissible structure in the CEHA. Since the proposed 809 square foot deck could not be located outside of the FEMA flood zone VE (Velocity Hazard) and Coastal Erosion Hazard Area it is recommended that the Board consider requiring alternative natural materials (stone patio) to prevent adverse effects on the water body (these types of structures become debris and navigational hazards in the water body during and after storm events). It is recommended that the Board amend the application to meet and/or further the above policy to the greatest extent practicable and minimize the potential of future structural loss. I am also involved with transferring the DEC permit into the new owner's name as required before he can proceed with the project. No Seaward Extension of Bulkhead The new bulkhead shall be constructed in place of the existing bulkhead with no seaward extension of the outermost bulkhead face. 7. Backfilling All peripheral berms, cofferdams, rock revetments, seawalls, gabions, bulkheads or other approved shoreline Stabilization structures shall be completed prior to placement of any fill material behind such structures. 8. Bulkhead Height The new bulkhead height shall not exceed the height of the adjacent bulkheads. 9. Seeding Disturbed Areas All areas of soil disturbance resulting from the approved project shall be stabilized with appropriate vegetation (grasses, etc.) immediately following project completion or prior to permit expiration, whichever comes first. If the project site remains inactive for more than 48 hours or planting is impractical due to the season, then the area shall be stabilized with straw or hay mulch or jute matting until weather conditions favor germination. 15. Temporary Mulch, Final Seeding: If seeding is impracticable due to the time of year, a temporary mulch shall be applied and final seeding shall be performed at the earliest opportunity when weather .conditions favor 8ermination and growth hut.not more than six months after project completion. State May Require Site Restoration If upon the expiration or revocation of this permit, the project hereby authorized has not been completed~ the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. Removal will involve excavation behind the existing bulkhead and storage of the sand backfill material on the property. Sheathing will be installed by water jetting. The gravelly nature of the beach material may require the excavation of a narrow trench to facilitate the placement of sheathing with a water jet. Existing backfill material behind the bulkhead will be supplemented with sand material from an upland source to replace fill that has been lost. Access will be by property to the east after a fee has been negotiated with the property owner. The installation of the west wing will require encroachment on the property to the west. The neighbor to the west will be approached to negotiate access. A new bulkhead will protect the existing house and County Road 48 from ongoing coastal erosion, a positive environmental impact. Runoff of the jetting water may enter Long Island Sound. Because the beach matedal is sand and gravel little or no turbidity is anticipated from the runoff. The porous nature of the existing sand and gravel would indicate that runoff will be minimal. The existing turf grass behind the east bulkhead wing will be eliminated and replaced with suitable native vegetation. A single row of rock armor will be installed in front of the north bulkhead to protect the toe of the bulkhead during storm events. The project may disturb native vegetation on the property to the west which consists primarily of Amedcan beach grass. New beach grass or similar native vegetation will be planted to restore any disturbance to property to the west. The access property to the east will be restored to its original conditions and grades. There are no historical or archaeological artifacts in the vicinity of the area where construction will be undertaken. A new vinyl sheet bulkhead will be constructed along the same line as the existing bulkhead There is a deteriorated rock groin associated with the existing bulkhead, Policy 5 Protect and improve water quality and supply in the Town of Southold. 5.3 Protect and enhance quality of coastal waters. No excavation with a backhoe or ciamshell bucket is anticipated in front of the existing structure. Installation of vinyl sheets and piles will be with a water jet. The area behind the existing structure will be excavated to allow the installation of a tie red backing system. Excavated area will use existing sand and some sand from an upland location as backfill. No discharge into coastal waters from the backing excavation is anticipated.
