Dear Mr. Herrmann:
The Southold Town Board of Trustees reviewed the survey prepared by John C. Ehlers
Land Surveyor, last dated November 24, 2010, and received on January 5, 2011, and
determined that the construction of a proposed in-ground swimming pool, patio, and
drywell, is out of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code
and Chapter 111 of the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the
Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of
the coastal erosion hazard area as indicated above, or within 100' landward from the
top of the bluff, without further authorization from the Southold Town Board of Trustees
pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility
to ensure that all necessary precautions are taken to prevent any sedimentation or other
alteration or disturbance to the ground surface or vegetation within Tidal Wetlands
jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland
jurisdictional boundary and the coastal erosion hazard area and your project or erecting
a temporary fence, barder, or hay bale berm.
This determination is not a determination from any other agency.

Dear Mrs. Doherty:
We represent Barbara Davy and Elizabeth Fan-ell, who plan to construct an inground swimming pool,
patio, and drywell, all as depicted on the site plan prepared by John C. Ehlers Land Surveyor, last dated
November 24, 2010, a copy of which is enclosed along with photographs of the site and agent
authorization letter.
As all proposed work and related construction activities will occur more than 100 feet from the boundary
of freshwater wetlands associated with Silver Lake, as delineated by the New York State Department of
Enviromental Conservation, the proposed activities will occur beyond the jurisdiction of the Board of
Trustees pursuant to §275-3(C)(5) of the Southold Town Code. A project-limiting fence and staked
haybales will be emplaced along the 100-foot wetlands setback prior to construction to ensure that all
construction activities do in fact remain outside of the Trustees jurisdiction. Therefore, would you kindly
prepare a non-jurisdiction letter for the project that can be provided to the Building Department.
