Dear President Doherty
and Board:
It is my understanding that the Board will be making the
compliance inspection on March 161h. I have enclosed a proposal and
invoice from Case' s Creek landscaping for the additional vegetation
which will be planted as the Board requested.
The picket fence, the sod, and irrigation was removed within
100 feet Of Spring High Tide this winter, however, the planting can
not be completed until Spring. The landscaper has been directed to
plant as soon as weather permits. Mr. Tenedios will provide you
with a written guaranty that the work will be completed in the
Spring.
Please provide a compliance certificate for the building
department. We are awaiting a C.O.

1. All of the premises hereinabove described shall be known
and designated as residential plots.
Z. No structure shall be erected, altered, placed or permitted
to remain on any lot other than one detached single-family dwelling not to
exceed two storles in height. No dwelling shall be erected, placed or permitted
to remain on any lot unless it has an enclosed garage, attached or unattached,
for not less than one (1) car, and all such garages and accessory buildings
must conform in architectural exterior design with the dwelling.
3. No dwelling, having a ground floor area of the main floor
structure of less than one thousand two kundred {1, 200 sq. ft.) square feet,
exclusive of one-sto~y open porches and garage, shall be erected, placed
or permitted to remain on any lot.
4. No dwelling shall be erected or placed within sixty-five
(65~) f~et of any front lot line, except that the front lot line setback requirement
shall be side street lines and side lot lines shat1 be such as to conform' with the
then effective zoning ordinance of the town of Southoldo
5. No animals livestock or poultry of any kind shall be raised,
bred or maintained on any lot, except for dogs, cats, or other household pets,
provided they are not raised, bred, or maintained for any commerical purpose.
6. No lot shall be used or maintained as a dumping ground for
rubbish, trash, or garbage. All rubbish, trash or garbage shall be kept in
closed sanitary containers, which containers shall be kept out of the public
view and in the rear of the premises.
7. No building, wall pier or any other structure shall be
erected, altered, or moved onto any lot, nor shall any preliminary grading to
any portion of any 10t be done, without the prior written approval of the Declarant,
his heirs, and asslgns.:'No mobtle homes will be ~pproved.
8. No fence, wall or hedge of over four (4) feet in height shall
be permitted within (10) ten feet of a side line nor within fifty (50) feet of any
street line or water front.

My client applied for an "Administrative permit" for a fence.
Chapter 275 allows fences as close as 50 feet from wetlands. The
fence is absolutely necessary because Mr. Tenedios and his family
have found trespassers from the public beach on his porch and in
his back yard. In order to comply with your ~special condition",
Mr. Tenedios had John Ehlers stake the distance of 100' from Spring
High Tide. As you can see from the photographs enclosed, if my
client relocates the fence to 100' he is left with a narrow @ 5-6
foot path between his stairs and his yard. Only the portion of the
fence around his house is closer than 100' from the Spring High
Tide. This is not safe for emergency vehicles and equipment. The
existing fence maintains a clear path around the rear of the house
and once the garage is constructed, the west side of the house will
be the main unobstructed access for emergency vehicles.
My client will remove the sod and irrigation seaward of the
100' He is also willing to increase the planting beds from the
existing fence to the 100' (stake in photograph). The planting
beds would increase the vegetative non-turf buffer (environmental
benefit per Storm Water Runoff educational bulletin) but not
interfere with access of emergency vehicles. The house and
accessory structures are all more than 100' from the Spring High
Tide, the fence is landward of the CEH Line, he only asks for a few
feet of encroachment into the 100' setback which will maintain a
safe area for emergency access.
The Board's permit condition creates a dangerous condition for
both the Tenedios Family and emergency personnel. We ask you to
reconsider this condition, allow the fence to remain as built,
condition that additional natural vegetation be planted. This
a matter of fire and emergency safety.
