29, 2006 in Libor 12485 page 439~ and in the case of Parcel I1 described on Schedule A hereto, the same premises conveyed
to tha party of the first part by deed, dated December 28, 2006 and recorded in the Office of the Suffolk County Clerk on
December 29, 2006 in Libor 12485 page 438.
TOGETHER with all right, title and interest, if any, of the party of the first part in and'to an~,,streets and roads abutting the
above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of
the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first pad covenants that the party of the first part has not done or suffered anything whereby the said
premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section t3 of the Lien Law, covenants that the party of the first part will
receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied
first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as
if it read "parties" whenever the sense of this indenture so requires.

at the northwesterly end of said road, said monument being 1308.64 feet North of a point
which is 1381.63 feet West of another monument marking the United States Coast and
Geodetic Survey Triangulation Station "Chocomount 2" (which said "Chocomount 2"
monument is located on the summit of the highest hill on Fishers Island, New York, about
2 1/4 miles west of the eastern end of Fishers Island, and lies South 79 degrees 29
minutes 46"seconds East from North Dumpling Light in Fishers Island Sound); and
RUNNING THENCE South 69 degrees 29 minutes 10 seconds West, 121.37 feet to
another monument;
THENCE North 62 degrees 22 minutes 30 seconds West, 15.00 to the shore of Fishers
Island Sound;
THENCE with the meanders of said Sound North 01 degree 51 minutes 00 seconds East,

bounded and described as follows:
BEGINNING at point on the northerly side of a road forty-five feet wide, which point is set
1171.84 feet Nodh of a point which is 935.94 feet West of a monument marking the United
States Coast and Geodetic Survey Triangulation Station "Chocomount 2" (which said
"Chocomount 2" monument is located on the summit of the highest hill on Fishers Island,
New York, about 2 1/4 miles west of the eastern end of Fishers Island, and lies South 79
degrees 29 minutes 46 seconds East of North Dumpling Light in Fishers Island Sound);
and
RUNNING THENCE westerly along the nodherly side of said road forty-five feet wide
along the arc of a curve bearing to the left having a radius of 247.99 feet, a distance of
171.09 feet to a point of tangent;
THENCE South 81 degrees 59 minutes 40 seconds West still along the northerly side of
said road forty-five feet wide, a distance of 66.67 feet to a point of curve;
THENCE westerly and northwesterly still along the northerly and northeasterly side of said
road forty-five feet wide along the arc of a curve bearing to the right having a radius of
