Southold Tc, v:n Clerk CTM 111-3-t4 & 15 (combined/merged) FINDINGS OF FACT pROPERTY FACTS/DESCRIPTION: The applicant's property consists of approximately 59,400 square feet, referred to on the Suffolk County Tax Maps as ID Nos. 1000-111-3-15 and 14, and shown on the November 7, 1978 survey prepared by Roderick VanTuyl, P.C. with the following dimensions, commencing at the northerly lot line: 180' x 384.75' x 68.76' x 112.97' x 304.91 feet. The property is improved with a single-family, one- story frame house 9+/- feet from the easterly lot line and 52+/- feet from the southerly lot line along West Cove Road. The 1978 VanTuyl survey also shows the premises consists of Lots I and 2 on the Map of Alonzo Jersey, filed in the Suffolk County Clerk's Office as Map No. 763. .BASIS OF APPLICATION: Article II, Section 100-26, based on the Building Department's January 13, 2006 Notice of Disapproval, amended March 8, 2006, stating that County Tax Map Parcel Numbers 15 and 14 are merged pursuant to Zoning Code Section 100-25, which states: "Merger. A nonconforming lot shall merge with an adjacent conforming or nonconforming lot which has been held in common ownership with the first lot at any time after July 1, 1983. An adjacent lot is one which abuts with the parcel for a common course of fifty (50) feet or more in distance. Nonconforming lots shall merge until the total lot size conforms to the current bulk schedule requirements." The property is located in the R-40 Low-Density Residential Zone District, with a code {imitation of 40,000 square feet minimum lot size. ~: The Applicant requests a Waiver to unmerge properties that do not meet the zoning e 40,000 square foot minimum lot size requirement for each. The premises is currently approximately 59,400 square feet, and the applicant proposes an undersized lot consisting of approximately 30,500 square feet with 91.73 feet along West Cove Road (CTM 15), and the remaining area of approximately 28,100 square feet with 90 feel along West Cove Road (CTM 14) with the applicant's dwelling. ZONING CODE. SECTION 100-26: Under § 100-26-A, if a lot has merged, the Zoning Board of Appeals may waive the merger and recognize original Icl lines upon public hearing and upon finding that: (1) The waiver will not result in a significant increase in the density of the neighborhood. (2) The waiver would recognize a lot that is consistent with the size of lots in that neighborhood. 'Page 2 - April 13, 2006 · ~,ppl. (4) The netural details and character of the and character of the contours and slopes of the lot will not be significantly changed or altered in any manner, and there will not be a substantial filling of land affecting nearby environmental or flood areas. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 30, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony presented, materials submitted and personal inspection, the Board makes the following findings: Grant of a waiver to unme e a/an area of 28 200+/- s uare feet from the exis#n 59 400+/- s uare foot lot size is not consistent wi~h lot in the nei hborh . A waiver would result in the creation of [wo nonconforming lots, the first with 28,200+/- square feet (CTM 14) and 30,500+/- square feet (CTM 15) - instead of a minimum of 40,000 square feet for this R-40 Low-Denslfy Residential District. The weatedy portion of the applicant's property (CTM 15) would also be nonconforming as to lot width with frontage of 91.73 feet along West Cove Road, and the easterly portion (CTM 14) w~uld be nonconforming as to lot width with frontage of 90 feet, instead of the code required 150 feet for each. There are lots in this residential development which meet or exceed the zoning requirement of 40,000 square feet (CTM 111-3-16, CTM 111-3-9; CTM 111-2-6; CTM 111-2-8.1; CTM 111-2-3,1. Othem that are less than 40,000 squa re feet are mainly improved with single-family dwellings. A single and separate search was prepared December 1, 2005 by Calharine J. King, for LandAmerica Commonwealth. The 2005 saamh shows John J. Johnstone conveying CTM 14 in 1978 to Irma and Emil Voigt Sr., who died on 7/22/1998; and conveying CTM 15 Irma Voigt on 3/8/1978. For at least seven years, the property was not held In single and separate ownership, remaining in the same name (or COmmon ownership) of Irma Voigt, since the passing of Emil Voigt Sr. in 1998. 2. Proof was not submitted to show that a waiver will avoid an economic hardship. It has been this Board's determination on numerous occasions in the past, that it is not sufficient for an applicant to satisfy the economic hardship requirement of the statute merely by submitting that the properties would be more valuable in an unmerged state rather than merged. This determination has been upheld by the Supreme Court and Appellate Division. In this instance, applicant has not offered any showing of hardship other than that found by this Board and the New York courts to be insufficient for a grant of waiver of merger. The property has been in common ownership with a merged area of 59,400+/. square feet since 1998 and continuously to the present date. The applicant has entered into two separate contracts of sale (with conditions) on January 11, 2006, to sel the westady and easterly portions of the foot parcel (CTM 14 and 15), after the properly had merged, applicant's 59,400+/- square Proof was not submitted lo show that a waiver will avoid an economic hardship. The applicant indicated that the property would become more valuable if the lot waiver were granted, but the record does not show that there is an economic hardship for the property to remain as one lot of 59,400~-/. square feet. Information was 'Page 3 -April 13, 2006 Appl. No, 5844 - Irma Voigt CTM 111-3-14 and 15 (merged/combined) submitted indicating that Mrs. Voigt wishes to sell the property (CTM 14 and 15) which will be mom valuable in an unmerged state rather than merged. The town's assessment records show that CTM 14 was sold for $79,000 in 1979; and CTM 15 was sold for $10,000, The applicant submitted Jnfom'lafion indicating that the taxes, paid for the 2004-2005 lax year, were $6,476.46 on the entire premises with a 6500 combined assessment value. Thera is no proof demonstrated in the record to show that the westerly portion of the applicant's property was maintained separately for purposes of building a new single-family dwelling. No application to an agency for building or other authorizat~on was filed by the owner(s) for over 10 years was offered. There also was no proof demonstrated to show the value of the property as exists w~th the merger to support applicant's claim of economic hardship. The applicant states that the estimated value of the prapert7 as exists is valued at $622,000, but that the property would become more valuable if sold under the contract of sale and if a waiver to unmerge were granted. Applicant is not obliged to sell when someone has a desire to u~merge the properties for the purpose of acquiring the vacant portion of the premises or to provide a benefit f~r increased income. 3. No evidence was submitted by applicant with recard to environmental imoacts and ~otential effects undor Section 100-26A14}.
