SUFFOLK CO_IYNTY ADMINISTRATIVE CODE: This application has been referred as r~quired under the Sn.{~ Ik County Adm.i-~t~a~iv~ Code Sections A 14-14 to 28, and the Suffolk County Department of Planning reply dated March 11, 2008 states that the application is considered a matter for local determination as there appears to be no significan~ coun ~ty-w~de or inter-community impac~ PROPEttTY FAOTS/~ESCRIPTION: The applicants' property consists of · total area of 26,180 square feet measured to a tie line 109.70 ~eet alomg the average high water mark of Little Peconic Bay, 229.99 feet a~ong the eastern beund~ry of the lot, 119.19 feet along the northern boundary, and 235.58 feet at the western boundary as described and shown on the32-1-2004 survey, amended 5-5-2008 by John C. Elilars, licensed land. surveyor. BASIS OF APPLICATION: Zoning Code Sections 280-15 and 280-116B, based on the Building Inspector's amended February 6; 2008 and amended June 17, 2008 Notices of Disapproval concerning proposed new construction. The reasons stated in the disapproval cf the building permit applicafio~ are: (1) the proposed ~ew dwelling construction will be less than 75 feet from the bulkhead, (2) the proposed swimming pool will be in a side yard instead of a code-required rear yard; and (8) New York Town Law, Section 280-a to detemnine the need, if any, for base improvemen~ and clearance within the right-of-way easement g~.ving access to this property from Indian Neck Lane. FINDINGS.OF FAOT Page 2 - July 24, 2008 C. and R, Riccio # 6140 ~ a~-g. 1 land 86-7-3.1) V_~RIAlqCE R.W.I.II~.F REQUESTED: The applicants ~equeet variances for: (1) the proposed new clwel]jng construction with porch at 50'2' ins~ad of 75 feet from the bulkhead; (2) the proposed swimming pool w/Il be in a aide yard instead of a code-required rear yard, and (3) in addition, the applicant~ by May 6, 2008 letter addressed to the Board o£ Appeals prepared by the/r attorney~ Patrlda C. Moore, requested that consideration under New York Town Law, Section 280.A be included in this application. ~bi~ is related to relie£ under New York Town Law, Section 280-A for safe/Lee access, since the applicants' lot does not front directly on a Town S~reet, and relates to base improvements and vel~/cle clearance over the same traveled, ex/sting right-of-way that the appl/cants have used to access their property under ea-~emente or deeds under titie. LWRP DETERMINATION - CODE CHAPTER 268: The Board finds the proposed action CONSISTEICI~ with LWI~P review, based upon the following factors: L The existing home is approximately 20 feet from the bulkhead. The proposed home is to be location at 50 feet from the same. a. The proposed location of the pool will be in the side yard, which will benefit the neighbor, and create a greater distance from the bulkhead than exists. b- The 280-A access condition granted as par~ of this dec/sion will provide for the drej~i,~g of water from the slope of the dxiveway. This is at the point of access on the pub]Jo road of Indian Neck Lane. The Town is under a Federal mandate to contain water flow into creeks, and open bodies of water (Bays and the LI Sound). 2. The new location of the home will decrease the non-cordormity, by iuereaaing the distance/rom the bulkhead.. a. The new location of the sept/e system and dry wells for roof runoff will be located well landward of the house. This will reduce the env/ronmen~l impact of sewerage and rainwater into the open bay. b. 2, proposed pump out drain pool will provide for discharge of pool water, well landward/tom the bulkhead. 3. The setback at 50 feet from the bulkhead is more than double the sx~t/ng setback with more conformity. ~EASONS FOR BOARD ACTION: O~. the basis of testflnony presented, materials submit~ed and personal inspections, the Board makes the following findings: 1. Town Law ~267.b(3)(b~¢.2}(1}. Grant of the variances w/Il not produce an undesirable cb.~e in the character of the neighborhood or a detriment to ~arby properties because: A: The ex/sting house will be demolished and a new house con$tructed further back f~om the bulkhead ~andward of the existin~ structures), r~e new house will be in line with ne/ghbor/ng homes. The new owners considered a eeoo~d floor adc]/tion to ~he sxls/~ng residence but demalition axld reconstruct/on further back is more environm eld.tallY appropriate. 08/0§/2008 11:12 FAX 631 765 4643 MOORE LAW OFFICES ~003 Page 3 - July 24, 2008 C. sad It. Rtccio # 6140 CTM 98-6-! (and 86-7.3.1) B: The propose locatlon of the pool in the side yard will benefit the neighbor by keeping ~he distance from their f~ox~t yard t~ tile pool.at the maximum diztance pos~ble. C: Access to this parcel was granted by the aciion this board under appeal 1535 on May 25, 1972 and is currently the legal accses ~o this property. They do not propose W change this access, 2. Tow~ Law .~267-b¢3~(b](2). The benefit sought by the applicant~ cannot be achieved by some me~he~ feasibXe ~or the applicants to pursue, other thml au area variance because: A: The new location of the btgldlng will clzcreas~ the ~isting non-~o~ormity and is dictated by the location of the septic and drywall system which are located landward of the house in an effo~t to reduce the environmental impact to the bay. B: The location of the pool in the side yard keeps the. stxucture away from the b,,!lrhead. 3. Town Law 1267rb¢3bib](3), The variance requested herein is not substantial. The setback requested (50 feet from the bu)~head) is 100% greater than that of the existing structure. 4. Town Law ~267-bi3~(b~(Sk The di~culty has not been se]/c~eated. The existLug house was constructed prior to regulations, the disturbed area will be planted and the house w/ll be placed further back then the sxisting structure. 5. Town Law .~267-b(3}ib)(4~ There has been no evidence submitted to suggest that a vari~ce in this residential ne~ghborheod may have an adverse impact on the physical or environmental conditions in the neighborhood. The proposed house will comply with energy codes and construction standards. A backwash drain w/ll be prey/dad ~or the pool to prevent draining into the bay. The property is stable, vegetated and contains both a full bulkhead and an additional timber wall_ The new consimuctlon is further back than the existing sfructure. 6. ~7.&2~_~a~ The grant of the requested relief ~or the new house and pool is the minimum action necessary and adeauate to enable the applicant to em~oy the benefit of this property while preserving a~ud protecting the neighbor~oed and the health~ safety and welfare of the community. I~.I~-q0LUTION OF THE BOARD In considering all of the above factors and applying the balancing test under New York ~own Law 267-B, mo~ion was offered by Member Simon, seconded by Chairman Goehringer, ~ Grant the variances applied f~r, as shown on Site Plan Drawing A-1 revised July 3, ........ ,._r,_x~.,~ · 'e~._t0 th_e__ibllowing conditions regarding Page 4- Jul~ 24, ~008 C. and R. The 3mm glass-bulb pendent sprinklers permit the efficient use of residential water supplies for sprinkler coverage in residential fire protection design. The Iow flow F1 Res sprinklers are specially engineered for fast thermal response to meet the sensitive fire protection application needs of the latest residential market standards (UL 1626 Standard *). Upon fire conditions, rising heat causes a sprinkler's heat-sensitive glass-bulb to shatter, releasing the waterway for water flow onto the deflector, evenly distributing the discharged water to control a fire. Be sure that orifice size, temperature rating, deflector style and sprinkler type are in accordance with the latest published standards of The National Fire Protection Association or the approving authority having jurisdiction. When using F1 Residential Sprinklers for systems design to NFPA 13D or NFPA 13R, use listed area of coverage and minimum flow and pressure requirements shown in Bulletin 135. For systems designed to NFPA 13, use information in this bulletin. The number of design sprinklers shall be the most hydraulically demanding sprinklers as required by NFPA 13. Flows and pressures can not be below the baseline flows and pressurers. NFPA 13 For residential sprinkler syst e~,~s designed to NFPA 13. a minimum densi~ of 0.1 gpm/ft' must be provided over the "design area' that includes the four (4)hydraulically most demanding sprinklers for the actual coverage areas being protected by the 4 sprinklers. The minimum required discharge from each of the four most hydraulically demanding sprinklers shall be the ~ otthe following: 1.The flow rates given in the Reliable Residential Sprinkler Technical Bulletins referenced in Table A for NFPA 13D and 13R as a function of temperature rating and maximum allowable coverage area (for actual coverage areas less than or between those indicated in the respective technical bulletin, it is required to use the minimum required flow for the next largest coverage area); or 2. A minimum discharge density of 0.1 gpm/ft2 applied over the "design area" consisting of the four most hydraulically demanding sprinklers for the actual coverage areas being protected by the four sprinklers. The maximum dimension of the actual cove. rage area cannot be any greater than the maximum coverage area indicated in the technical bulletins referenced in Table A. Design Note: Using the As = S x L method to determine the sprinkler protection area of coverage, in accordance with NFPA 13, apply the 0,1 gpm/ft' density to this area to determine the minimum required flo~v. Compare this flow to the minimum 0.05 gpm/f~ cULus Listed flow for the appropriate coverage area in the technical bulletin for the specific residential sprinkler. If the flow stated in the technic,~al bulletin is less than the calculated 0.1 gpm/ft' density flow required, the .1 density flow must then be used in the equation Q=K~/P. solving for P, to establish the minimum required pressure usin.~ the sprinkler K-factor. Note: In many cases the hsted flow of individual residentia} sprinkler,~ may exceed the required minimum 0.05 gprn/~ density. Reliable has available residential sprinklers with larger K-factors (K=5.8 and K=7.6) that wi~ provide lower pressure demands for 0.1 gpm/ft~ densities in NFPA t3 residential applications.
