II DECLARATION OF PROTECTIVE COVENANTS made this 13th day of

wife, residing at Mattituck, Suffolk County, New York.
WHEREAS, Stanley J. Sledzieski and Helen Sledzieski, his
wife, are the owners of certain lands situated at Mattituck,
Town of Southold, Suffolk County, New York, as conveyed by
John Sledzieski and Frances Sledzieski, his wife, by deed dated
February 27, 1951 and recorded.in Suffolk County Clerk's Office
on March 1, 1951 in Liber 3188, Page 550 and from Leo B. Sledzies i
by deed dated December 3, 1954 and recorded in Suffolk County
Clerk's Office on December 3, 1954 in Liber 3802, Page 325; and
WHEREAS, a portion of said lands are now referred to as
"Sunset Knolls," as shown on a certain map dated Aug. 31, 1967

entitled "Map of Subdivision of Sunset Knolls, Mattituck, To.m
of Southold, Suff. Co., N. Y: ,." by Robert A. Kart, Land Surveyor,
N.Y.S. Lie. No. 28725, Riverhead, N. Y., filed in the Office of
the Clerk of the County of Suffolk on ;:;;:;Uv.4R)'" ,s'Th 1968,
File No.~Od3 and in order to provide for the beneficial and
harmonious development and use of "Sunset Knolls", Stanley J.
Sledzieski and Helen Sledzieski, his wife, desire to impose
certain restrictions and covenants upon "Sunset Knolls" which
!' shall be binding on all the purchasers and mortgagees of ind.ivid-
ual lots, their heirs, executors, administrators and assign3.
NOW, THEREFORE, the following restrictions and covenan"s
are hereby imposed upon the above "Sunset Knolls":

1. No building other than one private dwelling for the use and
I occupancy of one family and one private garage shall be erected
I on anyone lot. A one-story dwelling erected thereon shall have

I a first floor area of not less than 1,000 square feet and a
II two-story dwelling shall have a first floor area of not less

II than 800 square feet, not including porches or garage. A
detached garage erected thereon shall conform to the dwe~ling.
2. The premises shall not be used for the manufacture or sale
of merchandise or goods of any kind, for any trade or business
whatsoever, or for the display of any advertising or commercial
signs.
3. No stables, open cesspools, or outside toilets shall be
erected on said premises. No nuisance shall be created or
allowed on said premises, and no use shall be made thereof that
shall be dangerous to the health of or offensive to the ,senses of
sight or smell of the sellers, their heirs, or assigns or owners
of the premises adjoining the premises hereby conveyed and
neighboring properties.
4. No fences or hedges over four feet in height shall be
erected on said premises and any such fence or hedge shall be
maintained and kept in good appearance.
5. No part of any dwelling or garage shall be constructed on
anyone lot within ten feet of other boundaries of said lot.
6. No fowl, poultry, animals or live stock shall be kept on said
premises other than two (2) domestic pets.
7. No mobile homes or trailers shall be kept, used or allowed
on said premises except when kept in an enclosed garage, with
the exception of boat trailers which shall be kept in the rear
of the premises. .

8. Flat roof construction shall not be used on any buildings
and all buildings m~st be completed within one year from
commencement of construction.

9. Stanley J. Sledzieski and Helen Sledzieski, his wife,
II reserve the right to dedicate all streets, roads, drainage areas,
easements to the Town of Southold for highway and drainage
purposes.
10. These covenants and restrictions shall run with the land
hereby conveyed and shall bind and inure to the benefit of the
said parties hereto, their heirs, administrators and assigns
until January 1, 1988 and said covenants and restrictions may be
enforced by action for damages or injunctions or both until the
said first day of January 1988.
11. The covenants and restrictions herein imposed may be modi-
fied or amended by Stanley J. Sledzieski and Helen Sledzieski,
his wife, their successors and assigns.
12. Stanley J. Sledzieski and Helen Sledzieski, his wife, their
successors and assigns reserve the right to convey other portions
or all of the land of which the above "Sunset Knolls" are now a
part, or portions or all of any other neighboring lands which may
hereafter be acquired by them with other and different covenants,
conditions, restrictions and reservations than those herein
contained.
IN WITNESS WHEREOF, the foregoing Declaration has been
executed by Stanley J. Sledzieski and Helen Sledzieski, his wife,
