Box 1179 Southold, NY 11971-0959 Office Location: Town Annex/First Floor, North Fork Bank 54375 Main Road (at Youngs Avenue) Southold, NY 11971 FINDINGS, DELIBERATIONS, AND DETERMINATION MEETING DATE: OCTOBER 16, 2008 ZBA # 6173 - JOSEPH and CATHLEEN SHIPMAN PROPERTY LOCATION: 20685 Route 25 (Main Road), Mattituck CTM 108-3-5.5 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated June 24, 2008 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. PROPERTY FACTS/DESCRIPTION: The subject property is a 40,854 square foot parcel measuring 264.09 feet along Main Road (Route 25) to the south, 200.00 feet along the western boundary, 144.44 feet along the northern boundary, and 233.05 feet along the eastern boundary. The lot is improved with a tree farm, as shown on the survey by John C. Ehlers, Land Surveyor, dated March 3, 2005. BASIS OF APPLICATION: Request for a Variance as amended under Section 280-124, based on the Building Inspector's August 18, 2008 amended Notice of Disapproval which states that the proposed agricultural storage building on an existing tree farm property is not permitted for the reason that barns, storage buildings, greenhouses (including plastic covered) and other related structures, shall conform to the yard requirements for principal buildings, and the required minimum rear yard setback is 60 feet. RELIEF REQUESTED: The applicant requests a variance to construct an agricultural storage building with a setback of 10 feet from the rear property line. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, and personal inspections, the Board makes the following findings: 1. Town Law q267-b(3)(b)(3)(1). Grant of setback variance will not have a significant adverse environmental effect on the character of the neighborhood or be a detriment to nearby properties. The proposed building will be close to the adjoining part of a farm owned by the applicant and will not impact on neighbors' property. Page 2 - October 16, 2008 ZBA # 6173 -J. and C. Shipman, Applicants CTM 108-3-5.5 2. Town Law §267-b(3)(b)(2). The benefit of an agricultural storage building cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The Board finds that location of the building for the storage of agricultural equipment close to the adjoining lot is important to the operation of the farm. 3. Town Law §267-b(3)(b)(3). The variance is substantial. It is partially mitigated by the fact that the adjoining property is part of the same tree farm owned by the applicant. 4. Town Law §267-b(3)(b)(5). The need for a variance was self-created. It is a consequence of the layout of the farm, which is divided by a boundary near the middle of farm occupying more than one lot. 5. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that grant of this relief will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of new construction, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Member Weisman, and duly carried, to DENY the variance as applied for, and in the ALTERNATIVE, to GRANT a variance to allow a,J~-foo~] setback from the rear lot line. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
