DECLARATION made this 26th day of October, 1977, by MARY W. I-I.ACNISH
and RUTH LESSARD, residing at Westphalia Road, Mattituck, New York, hereinafter
called the "Owners";
WHEREAS, the OWners have title to certain lands situate, lying and
being at Westphalia Road, Mattituck, in the Town of Southo1d, County of Suffolk
and State of New York, said lands hereinafter being more particularly described;
and
WHEREAS, it is the OWners' intentions that the aforesaid lands be sub-
divided into a minor subdivision consisting of not more than three residential
lots;
NOW, THEREFORE, the following described lands shall be restricted as
hereinafter set forth:
All that certain plot, piece or parcel of land, situate,
lying and being at Mattituck, Town of Southold, County of
Suffolk and State of New York, bounded and described as follows:
BEGINNING at a point on the northeasterly side of Westphalia
Road,. at the northwesterly corner of the land herein described
and the southwest corner of land of V. Haas and R. Olmsted; from
said point of beginning running thence North 400 33' 50" East
688.0 feet to the westerly side of Mattituck Creek;
RUNNING THENCE southeasterly along the ordinary high w~ter
mark of Mattituck Creek, the tide line being South 510 31' 20"
East 185.04 feet to land now or formerly of Karl Guiler;
RUNNING THENCE along said land South 340 07' 40" West 603.0
feet to a monument on the northeasterly side of Westphalia Road;
RUNNING THENCE along the northeasterly side of Westphalia
Road the following two (2) courses and distances:
(1) North 700 00' West 192.77 feet, thence
(2) North 700 33' 20" Ivest 77.23 feet to the point or
place of BEGINNING.
DECLARANTS do hereby warrant, covenant and represent that on approval

of the aforesaid described lands as a minor subdivision by the Planning Board of

the Town of Southold, no further application will be made to that Board or to
any other Board in the Town of Southold to further subdivide any of the lots
set forth in said minor subdivision.
DECLARANTS do hereby further warrant, covenant and represent that the
aforesaid described lands within the minor subdivision cannot be subdivided in-
to more than three lots and that each such lot shall comprise an area of not
less than 30,000 square feet.
DECLARANTS do hereby further warrant, covenant and represent that the
foregoing restrictions and agreements shall bind the undersigned, his heirs,
successors and assigns, and any and all person or persons who shall succeed to
the ownership of any of the lots shown on said aforedescribed premises in said
minor subdiv~sion by transfer or otherwise.
IN WITNESS WHEREOF, the Declarants have caused their hands and seals
to be affixed this 26th day of October, 1977.
