b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or

c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in pan for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

NAME OF APPLICANT: Bellmart Properties, LLC (Charles Mattina)
PROPERTY LOCATION: 545 Koke Drive Southold, NY SCTM#1000-87-5-14
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMiNISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its
reply dated June t5. 2010 stating that this application is considered a matter for local determination as there
appears to be no significant county-wide or inter-community impact.
LWRP: This application is not subject to review under Chapter 268 because the variance relief requested does not
involve features that relate to a regulated natural feature or a bulkhead or other shoreline.
PROPERTY FACTS/DESCRIPTION: Subject properly is a non-conforming 15, 371 square foot lot in the R-40
zone. I! contains a single-family dwelling currently under construction. It has 130.69 feet of frontage on Koke
Drive, 112.90 feet along the westerly lot line, 116.86 feet along the northern lot line and 150.28 along the easterly
lot line. There also is shown on the survey dated Feb. 17, 2010, by Peconic Surveyors, a fifteen foot wide
easement along the eastern property line.
BASIS OF APPLICATION: Request for Variance from Code Section 280-124, based on an application for
building permit and the Building Inspector's March 1, 2010, Notice of Disapproval conceming deck additions at
less than the code required front yard setback of 35 feet at; 545 Koke Dr., Southold, NY. SCTM#1000-87-5-14.
RELIEF REQUESTED: The applicant proposes to construct a deck addition to the front of their home with a
setback from the road of 25 feet where 35 feet is required.
AMENDED APPLICATION: During the hearing, the applicant was asked if Lhey would accept alternative relief
and to reduce the size of the deck to make it conform more to the code. The Board asked the agent to submit a
copy of the building plans submitted to the building department in conjunction with the permit for the house. On
July 8, 2010, the Board received the requested plans.
ADDITIONAL iNFORMATION: The Board received six letters from neighbors in support of the application and
one e-mail from a neighbor against the application.

FINDINGS OF FACT/REASONS' FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on June 30 2010, at which time written and
oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and
other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following
findings:
On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following
findings:
1. Town Law §267-bO)(b)(1). Grant of the variance with alternate relief of will not produce an undesirable
change in the character of the neighborhood or a detriment to nearby properties. Open decks to take advantage of
water views are not uncommon and with a reduced depth, the proposed open deck in the front yard will improve
the appearance of the house, which now includes by code a landing and large set of steps from the existing
bedroom sliding doors to grade: These steps will be removed and replaced with a shallow elevated deck that will
only be 5 feet less than the code required front yard setback.
2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible
for the applicant to pursue, other than an area variance. The dwelling has a sliding door in front that accesses the
master bedroom, Applicant stated at the public hearing that his mother, who is wheel chair bound, would be
utilizing the deck "to enjoy the bay views and the sunshine." While the existing 10 by 13.8" covered front porch
area which is located directly to the north east of the proposed deck, would provide nearly the same view of the
bay, it would not be open to the sky. Because the house is setback at the conforming 35.3' from the road, any
construction on the front of this dwelling would require a variance.
3. Town Law §267-b(3)(b}(3). The variance requested herein is substantial. The request is for 71% relief from
the code. When considered in the context that the applicant had full knowledge of the need for a variance when he
placed his house on the lot, as evidenced in testimony given at the hearing, granting a variance as applied for would
be substantial.
4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that alternate relief in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
granting of a reduced variance will further mitigate any impacts that this proposed nonconforming deck structure
may have on the visual character of the neighborhood and the environment. The deck will cause no drainage issues.
5. Town Law §267-b{3)(b)(5). The difficulty has been self-created. The applicant testified that a survey showing
the proposed deck was submitted to the building inspector as part of the original permit process for the dwelling.
Further testimony indicated that the building inspector informed the applicant that the inclusion of the proposed
deck would result in a disapproval of the building permit and the need for a variance. The applicant chose to build
the house without the deck and apply for a variance aRer the fact.
6. Town Law §267-b. Grant of alternative relief is the minimum action necessary and to enable the applicant to
enjoy the benefit of a deck with a view of the. Bay while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Weisman (Chairperson), seconded by Member
Goehringer, and duly carried, to
DENY, the Variance as applied for, as shown on the survey from Peconic Surveyors PC, updated Feb. 17, 2010,
and GRANT ALTERNATIVE RELIEF as noted below:
1. The deck shall be constructed no closer then 30 feet to the front property line with railings per code.

2. The deck shall run along the 30 foot front yard setback no more then 13 feet 8 ½ inches in the proposed
location.
Conditions:
1. The deck must remain open to the sky.

approval and filing, two sets of the final survey and architectural drawings~ conformin.~ to the alternative
relief granted herein. The ZBA will forward one set of approved, stamped drawings to the Building
Department. Failure to follow this procedure may result in the delay or denial of a building permit, and may
require a new application and public hearing before the Zoning Board of Appeals.
Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's
diagrams or survey site maps, are not authorized under this application when involving nonconformities under the
zoning code. This action does not authorize or condone any current or future use, setback or other feature of the
subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are
expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not
increase the degree of nonconformity.
