SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued a reply dated January 25, 2008 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 8,523 square foot parcel in the Low-Density Residential R40 District measuring 82.12 feet wide along the southerly boundary of Old Orchard Road and 114.2 feet deep along the westerly boundary line. The property is improved with a single-family dwelling as shown on the 03-03-2008 survey prepared by Kenneth M. Woychuk, Licensed Surveyor. BASIS OF APPLICATION: Request for Variances under Sections 280-124, based on the Building Inspector's Notice of Disapproval concerning proposed additions to the existing single'family dwelling, which new construction will be less than 35 feet from the rear yard lot line, less than 35 feet from the front yard lot line, and with lot coverage in excess of the code maximum limitation of 20%. RELIEF REQUESTED: The relief requested concerns proposed additions at the northeast side of the dwelling which results in a setback of 23.6 feet from the rear lot line, addition at the front of the dwelling which results in a nonconforming setback of +/- 26 feet, and lot coverage at 23.43%, all shown on the corrected survey dated 03-03-08 prepared by Kenneth M. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The subject property is fiat and there are no drainage issues. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an enlarged dwelling while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Chairman Goehringer, and duly carried, to GRANT the variance as applied for, and shown on the survey by Kenneth M. Woychuk, Licensed Surveyor, dated 03-03-08 and drawings by Mark K. Schwartz, AIA, Architect, labeled New Addition Plans/Sheet A-1 and Elevations A-3 dated August 16, 2007 and stamped received by the ZBA on Jan. 07, 2008. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. However, we have discovered a discrepancy with the Site Plan and survey. Please review the aRached revised Site Plate As you can see, the revised Site Plan indicates the existing structure with proposed additions shifted 10' back towards the rear property line. In light of the unfortunate discovery regarding the survey of fall 2007, we would like the opportunity to review with you, in the form of an addendum to the minutes of our recent hearing, the reasons for our request of a variance. 1. Our house, as it stands today, is set back approximately 31.2' feet from the rear property line. The house which borders on this same property line is set back approximately 26 feel A fence just on the neighbors property separates our respective parcels of land. The proposed plan for construction gives ns a set back on the north side of the house of 23.3'. 2. The home on the South side of our property is set back about 3-4 feet from our property line. Our home is about 15.1 feet from this same property line. 3. We want if at all possible to avoid a second story. Reasons include original tenets of Gardiners Bay estates which prohibited or at least strongly discouraged second story homes. We also are concerned about blocking evening sun on our south neighbors evening sitting area. While the tenet has not been followed by all, some egregiously, we are determined to stick to it. This place is successful from a community standpoint because of the general adherence to these ideals and parameters. 4. We are interest~l in maintaining the original character of this cottage, and so that people will have no problem indentifying our effort as such. The changes are based on the need for, we feel, a modest increase in living space. 5. Finally in light of the rear set back issue, we realize there is more room the north side of the property. We are hoping to avoid expanding any more in this direction for the following reasons: The first is the open view back through into the abutting property, It is important in the character of the property. · To expand into the North side of the propery could create a rear house width of 50 feet- a wall like appearance to our neighbor in the back....? We are concerned that this might provide a home that appeared to cover the lot to much. · Narrowing the north side of the property would deprive us of a place for winter storage of our boat. It would be inappropriate to store the boat in the front yard. · The final reason is general recreation- children playing the full gamut of yard games- bocce, volleyball, badminton, croquet, etc. To summarize, when considering these reasons, we feel 23.3 foot rear set back is consistent with the style of this neighborhood and will impact these abutting properties least of other options.
