(631) 765-1809 · Fax (631) 765-9064 FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF JULY 13, 2010 ZBA APPLICATION #: 6382 APPLICANTS/OWNERS: Frank J. and Donna Scarola and Donna Perrin PROPERTY LOCATION: 4850 Sound Ave., Mattituck, NY SCTM#1000-121-3-6 BASIS OF APPLICATION: The applicants request a Special Exception pursuant to Article III, Section280- 13B, sub-section 14 of the Zoning Code, to operate a Bed and Breakfast within their existing single-family dwelling, accessory and incidental to their residential occupancy under the Building Department's Certificate of Occupancy -No. Z-33826 dated 7/10/09. The proposal is for two bedrooms for lodging and serving of breakfast to the B & B casual, transient roomers, which will be in addition to the three B&B bedrooms approved on 2/28/10 in ZBA decision # 6350, for a maximum total of five bedrooms. The subject property consists of a two-story barn that was renovated into a very large home approximately 2 years ago. This home lies on a parcel with three large barn storage buildings. Total lot area is 96,567 square feet, or 2.217 acres. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on June 30, 2010 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, and upon review of the code requirements set forth pursuant to Article III, Section 280-13B(14) to establish an Accessory Bed and Breakfast, the Board finds that the applicant complies with the requirements for the reasons noted below: 1. Frank J. & Donna Scarola and Donna Perrin, the applicant(s) herein, are the owners of the property, located at 4850 Sound Ave., Mattituck 9onsisting of 96,567.61 sq. ft., with 157 feet on Sound Ave., 354.56 feet on the east property line, 275.62 feet on the south property line and 506.51 feet on the west property line. It is improved with a single-family dwelling, (partly one and partly two story), and three accessory buildings as shown on the survey by Nathan Taft Corwin III, L.S. dated last revised Sept. 9, 2009. The 50% owner/applicant Donna Perrin, will continue to occupy same as her principal residence while managing and operating the Accessory Bed and Breakfast facility, as confirmed by Donna Pen-in at the public hearing 2. The applicant's plans comply with the on-site parking requirements and provide for seven parking spaces, two for the principal single-family use and one for each of the five Accessory Bed and Breakfast bedroom(s), as noted on the above survey by Nathan Taft Corwin. The applicants comply with the requirements of a dwelling unit as defined in Section 280-4 of the Zoning Code. All buildings on site will be accessible for fire and police protection. 4. The Accessory Bed and Breakfast, as applied for, is reasonable in relation to the District in which it is located, adjacent use districts, and nearby and adjacent residential uses. It is compatible with its surroundings and the character of the neighborhood and community in general, particularly with regard to visibility, a proper parking area for guests and overall appearance. 5. The Special Exception is accessory to the principal dwelling use and will not prevent the orderly and reasonable use of adjacent properties. Dedicated accessory B&B space is noted at 3,473 sq. ft. The dedicated owner space is noted at a minimum 3,656 sq. fl., with the mechanical area shown as 456 sq. ft., per floor plans submitted by owner's agent, North Fork Permits, dated Jan. 28, 2010, page A- l, received in the Zoning Board on March 12, 2010. 6. This accessory will not prevent orderly and reasonable uses proposed or existing in adjacent use districts. The use will be in harmony with and promote the general purposes and intent of this chapter. The subject parcel is located on an improved private road, serviced from a Public Rd. 7. No evidence has been submitted to show that the safety, health, welfare, comfort and convenience or the order of the Town of Southold will be adversely affected by this proposed use of a Bed and Breakfast in this location. 8. This Accessory Use is authorized by the Zoning Code Section 280-13B(14) with Zoning Board of Appeals as noted herein, and issuance of a Certificate of Occupancy from the Building Inspector is required by code before the Bed and Breakfast use may be occupied. 9. No adverse conditions were found after considering items listed under Section 280-142 and 280-143 of the Zoning Code. 10. Submission of a Certificate of Compliance or similar document will be necessary for issuance by the Building Inspector certifying that the premises conforms to Chapter 280 of the Zoning Code for an Accessory Bed and Breakfast use. RESOLUTION OF THE BOARD: In considering all of the above factors, motion was offered by Member Goehringer, seconded by Member Weisman (Chairperson), and duly carried to; GRANT, the Special Exception permit for an Accessory Bed and Breakfast, to be used only in conjunction with the applicants-owners residence, as applied for, As shown on the floor plan submitted by North Fork Permits, dated Jan; 28, 2010, page A-l, and received by the Board of Appeals on March 12, 2010, and on the survey by Nathan Taft Corwin HI, L.S. dated last revised Sept. 9, 2009. SUBJECT TO THE FOLLOWING CONDITIONS: 1. Owners shall occupy this single-family dwelling as their principal residence. This permit can only be used for its intended use, not any other use. 2. There shall be a flexible chain ladder properly installed in any/all second floor bedroom areas. 3. The owners of the subject property are required to maintain proper access of ingress and egress to their home during the existence of this Special Exception ' 4. Signage shall be established on the subject premises stating that no guests at any time are permitted to back out on Sound Avenue, when exiting the property with a vehicle. 5. This Special Exception is limited to five (5) bedrooms and common areas for the Bed and Breakfast use as indicated on the floor plan submitted by the agent for the applicants, North Fork Permits, dated Jan. 28, 2010, page A-l, received by the Board of Appeals on March 12, 2010. 6. Applicants agree to file for the proper inspection by the Building Inspector and to comply with all of the requirements, for the purpose of receiving a new updated Certificate of Occupancy, for a five (5) Bedroom B&B. The SWPPP shall be prepared prior to the application for Building Permit. 2. The SWPPP shall describe the erosion and sediment control practices and where required, post-construction storm water management practices that will be used and/or constructed to reduce the pollutants in storm water discharges and to assure compliance with the terms and conditions of Town Code Chapter 236 for Storm Water Management prior to the issuance of a Town Building Permit. In addition, the SWPPP shall identify potential sources of pollution which may reasonably be expected to affect the quality &storm water discharges, 3. All SWPPPs that require a post-construction storm water management practice component shall be prepared by a qualified design professional that is knowledgeable in the principles and practices of storm water management and treatment. 4. The owner, contractor or operator must keep the SWPPP current so that it at all times accurately documents the erosion and sediment control practices that are being used or will be used during construction, and all post-construction storm water management practices that will be constmeted on the site. At a minimum, the owner, contractor or operator shall amend the SWPPP: a. whenever the current provisions prove to be ineffective in minimizing pollutants in storm water discharges fi.om the site; b. whenever there is a change in design, construction, or operation at the construction site that has or could have an effect on the discharge of pollutants; and c. to address issues or deficiencies identified during an inspection by a Building inspector, or other regulatory authority. 5. The Building Department may notify the owner, contractor or operator at any time that the SWPPP does not meet one or more of the minimum requirements of the building permit. The notification shall be in writing and identify the provisions of the SWPPP that require modification. Within fourteen (14) calendar days of such notification, or as otherwise indicated by the Town, the owner, contractor or operator shall make the required changes to the SWPPP and submit written notification to the Town that the changes have been made. If the owner, contractor or operator does not respond to the Town's comments in the specified time flame, the Town may issue a stop work order and/or suspend the current Building Permit. 6. Prior to the commencement of construction activity, the owner, contractor or operator must identify the contractor(s) and subcontractor(s) that will be responsible for installing, constructing, repairing, replacing, inspecting and maintaining the erosion and sediment control practices included in the SWPPP; and the contractor(s) and subcontractor(s) that will be responsible for constructing the post- construction storm water management practices included in the SWPPP. The owner, contractor or operator shall have each of the contractors and subcontractors identify at least one person from their company that will be responsible for implementation of the SWPPP. 7. The owner, contractor or operator shall have each of the contractors and subcontractors identified in item # 6 above sign a copy of the following certification statement below before they commence any construction activity: "I hereby certify that I understand and agree to comply with the terms and conditions of the SWPPP and agree to implement any corrective actions identified by the building inspector during a site inspection. In addition to providing the certification statement above, the certification page must also identify the specific elements of the SWPPP that each contractor and subcontractor will be responsible for and include the name and title of the person providing the signature; the name and title of the contractor responsible for SWPPP implementation; the name, address and telephone number of the contracting firm; the address (or other identifying description) of the site; and the date the certification statement is signed. The owner, contractor or operator shall attach the certification statement(s) to the copy of the SWPPP that is maintained at the construction site. If new or additional contractors are hired to implement measures identified in the SWPPP afier construction has commenced, they must also sign the certification statement and provide the information listed above. 8. Erosion and sediment control component - All SWPPPs prepared pursuant to a Building Permit Application shall include erosion and sediment control practices designed to comply with Town Code Chapter 236 for Storm Water Management and implement site improvements for Erosion and Sediment Control. Where erosion and sediment control practices are provided, the owner, contractor or operator must demonstrate that, at a minimum, the erosion and sediment control component of the Town SWPPP shall include the following: a.'Background information about the scope of the project, including the location, type and size of project; b. A description of the soil(s) present at the site, including a test hole indicating depth of ground water; d. A construction phasing plan and sequence of operations describing the intended order of construction activities, including clearing and grubbing, excavation and grading, utility and infrastructure installation and any other activity at the site that results in soil disturbance; e. A description of the minimum erosion and sediment control practices to be installed or implemented for each construction activity that will result in soil disturbance. Include a schedule that identifies the timing of imtial placement or implementation of each erosion and sediment control practice and the minimum time frames that each practice should remain in place or be implemented; f. A temporary and permanent soil stabilization plan that meets the requirements of the most current version of the technical standard, New York State Standards and Specifications for Erosion and Sediment Control, for each stage of the project, including initial land clearing and grubbing to project completion and achievement of final stabilization; g. A site map/construction drawing(s) showing the specific location(s), size(s), and length(s) of each erosion and. sediment control practice; h. The dimensions, material specifications, installation details, and operation and maintenance requirements for all erosion and sediment control practices. Include the location and sizing of any temporary sediment basins and structural practices that will be used to divert flows from exposed soils; i. A maintenance inspection schedule for the contractor(s) to ensure continuous and effective operation of the erosion and sediment control practices.
