This permit can be revoked upon failure to follow the applicable provisions of these parts or comply with any special conditions of issuance. All leak detection, overfill and level alarm probes and panel boxes must be maintained in satisfactory working condition at all times. 4. This permit must be conspicuously posted at the facility where the toxic/hazardous materials are located. Failure to post the permit may result in delivery operator refusing to make a delivery of toxic/hazardous materials, including fuel oil. The Permit to Operate does not imply that all facilities are in compliance with applicable codes. The owner and operator of the facility are responsible for ensuring that all storage facilities are in compliance. All facilities are subject to inspection without notice. Violations of the Suffolk County Sanitary Code are punishable by fines of $1000 per day, per violation. Violations of the New York State Petroleum Bulk Storage Code are punishable by fines of up to $37,500 per day, per violation.
