The meeting began at 7:10 p.m. with five LPC members present. Adoption of Meeting Minutes: ?? ACCEPTANCE OF MEETING MINUTES FROM NOVEMBER 9, 2010 HOLD – not prepared in time for meeting Land Preservation Applications and Inquiries: ?? SCTM #1000-107-10-10.1 (Girards) Landowner re-activated PDR application on 11/17/10 without Conservation Subdivision component. Review procedure to proceed with application. After meeting with Melissa Spiro and several LPC members, landowner Richard Girards has decided to return to original plan as outlined at the time of the Town Board public hearing. Resolution to elect to purchase the development rights easement will be on the November 30, 2010 Town Board agenda for resolution adoption. According to LPC legal counsel, the existing contract previously signed by landowners is acceptable “as is” and will be signed by Supervisor Russell once resolution is adopted by Town Board. ?? SCTM #1000-84-1-11 & 12.1 (Demchak) Federal Grant Update. Last week, Melissa received information that federal approval was given for sod farm soil testing and easement language. Melissa note error in appraisal that is now being reviewed by feds and has notified appraiser to make corrections and forward to the feds for review. Moving forward with this project to close by December 10, 2010. Town Board public hearing for Demchak’s Open Development Area is set for November 30, 2010. ?? SCTM #1000-107-5-1.1 (Swain) Status Update. Peconic Land Trust is the facilitator for this project. Landowner has accepted LPC’s offer for development rights easement purchase and also adjacent landowner’s offer to buy fee title to property once development rights are sold to Town. Information to prepare contract will be sent to LPC attorney. ?? SCTM #1000-45-5-3 & 4 (Sill) Status update. Town Board proceeded with setting public hearing for November 30, 2010 for the purpose of purchasing both Sill lots located in the Pipes Cove target area for $538,000. The Nature Conservancy, facilitator for this project, has entered into an Option to Buy agreement with landowner. nd TNC and Town have ordered and await 2 appraisal for south parcel. Option between TNC and landowner is contingent on appraisal supporting purchase offer. Melissa’s review calculates that one sanitary flow credit will be available upon termination of life estate if Town Board proceeds with banking it. ?? SCTM #1000-14-2-29.2; 29.3; 29.4 & 1000-19-2-2; 3; 12.1 (Passas/Vasilas) Appraisal review [executive session]. Concept Plan proposing four residential lots along Long Island Sound, and a residential building lot along Old North Road to be included with the 25± acre development rights easement area was reviewed by Committee. Several of the lots are not on CPF list and will need to be added if landowner proceeds with sale to Town. Landowner is still considering his options for full subdivision or conservation subdivision of the total 36± acres and decision will be influenced by potential LPC’s purchase offer for the development rights easement area. MOTION made by Eric Keil, seconded by Chris Baiz, to authorize and direct Melissa Spiro, Land Preservation Coordinator, to present a purchase offer to Nicholas Pappas and Sophie Vasilas, landowners, for a 25± acre development rights easement on agricultural land owned by Orient East . LLC, Orient West LLC, and Orient Point LLCThe Land Preservation Committee’s offer is based on the Concept Plan for a proposed Conservation Subdivision for 5 lots (4 on LI Sound and 1 on Old North Rd with the 25± acre development rights easement). The triangular area situated between Old North Road and Main Road (NYS Rt 25) will be included within the easement area. The Land Preservation Committee’s offer does not restrict the location or allowance for agricultural structures. The purpose for this proposed acquisition is for farmland protection and to complete a “block” of preserved farmlands in this area. The parcels are located within the R-80 (20.3± acres) and R-40 (15.7± acres) zoning districts. Motion carried: 4/1 (no – Ray Huntington due to language in easement) ?? SCTM #1000-19-1-8.4 (Terry, Fred & Ethel) Appraisal review [executive session]. HOLD – not ready for review. To be presented at next LPC meeting. ?? SCTM #1000-56-7-4.1; 5 & 11 (Principi) Review new open space application. A review of the survey provided by landowner shows that the 4.5 acre lot has many encroachments. The areas surrounding Principi lots, and the Principi lots have known drainage issues. Drainage was discussed. It was discussed that perhaps Town should purchase for drainage purposes, although purchase would not help drainage situation other than eliminating potential for development which would have the potential to make drainage situation worse. There was an interest in preserving this property; however, landowner anticipates a purchase offer more than what LPC would recommend purchasing the property for. No interest to move forward on this project unless landowner is willing to consider a very significant bargain sale. ?? SCTM #1000-102-2-16 & 6.6 (Edson) Review new farmland development rights application. Landowner Lewis Edson has offered a sale of a development rights easement to all but 80,000 sq ft around residential home and Santa’s Christmas Tree Farm shop (farmstand) to the Town. Since he is proposing to keep all road frontage along NYS Rt 25, access to the proposed easement area can be provided by an existing recorded right-of-way across a residential lot on Depot Lane, being part of an approved subdivision of Deborah Edson. Landowner is willing to also consider a sale of the development rights easement on residential lot he retained as a part of said subdivision, said lot having road frontage on Depot Lane. MOTION made by Ray Huntington, seconded by Chris Baiz, to direct Melissa Spiro, Land Preservation Coordinator, to commission an appraisal of the proposed development rights easement area as presented in Lewis Edson’s application, and that the determined value of a buildable acre be the same for the approved residential lot on Depot Lane as development rights easement acreage when, and if, offer is presented to landowner. Motion carried: 5/0 ADDITION TO AGENDA: ?? SCTM #1000-125-3-4.1 (Sawicki) Status update. Landowner’s attorney notified Melissa and Town Clerk that they no longer want to proceed with Open Development Area (“ODA”) for which a Town Board public hearing has been scheduled for November 30, 2010. They are withdrawing said application. Landowner’s still want to proceed with closing on development rights easement. Plan to schedule th closing on or before December 10. Applications & Inquiries for Uses or Structures on Preserved Property: None Stewardship and Management: ?? BITTNER GRADING & PLANTING Status Update. Lillian, Maureen, and Jim McMahon finished planting shrubs at Bittner property. Lillian reported that beach grass was not planted deep enough and that many plants were uprooted. Suggestion was made to request Parks Department to be sent to clean up debris on beach that is migrating to the east. Al Krupski will bring this request to the Town Board. ??
