Minutes & Discussion Notes from Meeting held
Tuesday, November 9, 2010 at 7:00 p.m.

The meeting began at 7:10 p.m. with six LPC members present.

ACCEPTANCE OF MEETING MINUTES FROM OCTOBER 26, 2010

MOTION made by Ray Huntington, seconded by Maureen Cullinane, to accept the October 26, 2010
LPC meeting minutes, as amended.
Motion carried: 5/0/2 (Monica Harbes & Chris Baiz abstained from voting)
Land Preservation Applications and Inquiries:

Status update from Town Board meeting and Planning Board meeting
Discuss next step [executive session if discussion of potential purchase offer]
Melissa, LPC members (John, Eric, Maureen, Ray) met with several members of the Planning Board,
Heather Lanza (Planning Director) and planning staff at a joint Planning Board/Land Preservation
meeting to review Mr. Girard’s proposed Conservation Subdivision proposal for 2 residential lots; one

located around the existing dwelling and one located at northeasterly corner of property and 3 lot to
be preserved via Town’s PDR purchase. Determination made at meeting that both lots should be
clustered to northwest side of property.
LPC members discussed the concept plan from the joint Planning Board/Land Preservation meeting
and other options including:
(A) The design that was the subject of the Town Board public hearing (2 acre Reserve around
existing house);
(B) Two lots clustered on northwest corner with one lot remaining with preserve acreage; and
(C) Two lots clustered on northwest corner designed to allow access to farm lot with no lot remaining
with preserved acreage.
MOTION made by Lillian Ball, seconded by Eric Keil, to keep purchase offer price per buildable acre
the same no matter what option landowner decides upon.
Motion failed: 3/4 (yes – Lillian, Maureen, Eric; no – John, Ray, Chris, Monica)
Discussion continued. It was noted that although Concept Plans (B) and (C) as presented to the
Committee were good options, they were not as good as what had been agreed to by the Committee
when purchase offer was presented to landowner for Concept Plan (A) and therefore, lower offer
purchase price warranted.
MOTION made by Ray Huntington, seconded by Chris Baiz, to keep presented purchase offer to
landowner, Richard Girards, the same if landowner decides to stay with original LPC application
Concept Plan (A) as presented to Committee. If either (B) or (C) Concept Plan options are decided
upon by landowner to move forward with this project, then a lower offer per buildable acre warranted
and would be presented to landowner for Concept Plans (B) or (C), although good plans, were not as
good as what had been offered with landowner’s application and agreed to by Committee.
Motion carried: 5/2 (yes – Eric, John, Ray, Chris, Monica; no – Lillian, Maureen)
Melissa to set meeting with Richard Girards and will confirm meeting date with LPC members who
are able to attend.

Status update & review of survey
LPC member, Monica Harbes, was not present for any discussion on this project due to family
relationship to applicant.
Melissa met with landowner, Peter Harbes, concerning retail parking area along Sound Avenue and
dirt farm road which provides access to 2 overflow parking areas on adjacent lot to east in addition to
access to residential dwelling on adjacent lot. It was agreed that surveyor be instructed to draw an “L”
shaped area that would include the retail parking area and dirt accessway being about 0.16 acre.
Area would be included within the easement area; however, payment would not be made for this area
but easement would allow for a pre-existing parking along Sound Avenue, access to parking areas on
adjacent lot and access to residential dwelling on adjacent lot.
Anticipated closing date for development rights easement on or before December 10, 2010.

Concept Plan shown to LPC members. Irrigation well and agricultural reserve area will remain with
farm lot.
Melissa gave update re: Planning Board Conservation Subdivision Open Development Area Sketch
approval anticipated on November 15, 2010.

Status update & review of survey
Anticipated closing date for development rights easement on or before December 10, 2010. Melissa
working to move project along for USDA-NRCS (federal) grant.
Conservation Subdivision before Planning Board is designed with irrigation well within Lot 1. This was
discussed at joint Planning Board/Land Preservation meeting and decision, to proceed as designed,
was made.
Melissa gave update re: Planning Board Conservation Subdivision Open Development Area Sketch
approval anticipated on November 15, 2010.

Review of request for as-built fuel storage containment unit
Request for “as-built” fuel storage containment unit was reviewed by LPC.
MOTION made by John Sepenoski, seconded by Eric Keil, to approve applicant’s request for “as-
built” fuel storage containment unit that was given Suffolk County Health Department approval (File
#17269 – Registration #10-0282) and is located within Town’s development rights easement area.
Written LPC approval to be sent to landowner, Louis Caracciolo, Jr.

UPDATE TASK LIST STATUS REPORT
John Sepenoski’s report distributed to LPC.
Ray asked by LPC to draft memo to Town Board regarding completed and incomplete tasks.
Bittner property. Report from Lillian Ball and John Sepenoski that this very afternoon they had found
exposed cesspool and pipes at the water’s edge and sticking out of the sand dunes. Lillian showed
photos that will be forwarded to Town Board.
