THIS INDENTURE, made the 15th day of September, Two Thousand Ten
BETWEEN
RENEE P. CAREY a/k/a RENEE T. CAREY, as surviving tenant by the entirety, residing at 311
Fourth Street, Greenport, New York 11944,
party of the first part, and
EILEEN CAREY, residing at 74 Coptey Street, Quincy, Massachusetts 02170,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Village of Greenport, Town of Southold, County of
Suffolk and State of New York, known and designated on a certain map entitled Map of Wiggins
Estate, Greenport, N.Y., dated May 19, 1853, and signed by Nathaniel Corwin, Sidney L.
Griffing and J. Wickham Case, Commissioners in Partitions, as and by the Lot Number Thirty-
seven (37), said Lot Number Thirty-seven (37) being bounded with referenced to said Map as
follows, viz:
Northerly by Lot Number Thirty-six (36) now or formerly owned by Charles Capon;
Easterly by Fourth Street;
Southerly by Lot Number Thirty-eight (38), now or formerly owned by Edward S. Conklin; and
Westerly by Lot Number Seventy-five (75), now or formerly owned by John and Eliza Bahr, said
Lot Number Thirty-seven (37) being fifty (50) feet in width front and rear and one hundred and
sixty-five (165) feet in depth be the same more or less.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated August 29, 1958, and recorded September 3, 1958, in the Office of the Suffolk
County Clerk in Liber 4508, Page 99.
RESERVING, HOWEVER, a legal life estate in the above-described premises with the buildings
and improvements thereon erected, in and to the party of the first pan.
THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF
APPOINTMENT, exercisable as often as they may choose, to change their remainderman as
follows:
TO or among any one or more members of a class consisting of the party of the first part's
descendants, in any degree, whether presently living or born hereafter, in such proportions and
amounts, without regard to equality, outright or in trust, as the party of the first part may direct
and appoint during her lifetime by properly written and acknowledged instrument, and recorded
prior to death, making specific reference to this power of appointment. The party of the first part
may not appoint themselves, their estate, their creditors or the creditors of their estate, under any
circumstances.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except a}
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the 'improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year
first above written.
