paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being at Mattituck, Town of Southold, County of Suffolk and
State of New York, known and designated as part of lots 6 and 7 on a
certain map entitled, "Map of Subdivision for Mattituck Estates,
Inc., Mattituck, Town of Southold, Suffolk County, May 5, 1965, July
19, 1965, Alden W. Young, Professional Engineer and Land Surveyor,
N.Y.C., Lic. No. 12845, Riverhead, New York" and filed in the Office
of the Clerk of the County of Suffolk on September 8, 1965 under File
No. 4453, said parts of lots when taken together are bounded and
described as follows:
~ BEGINNING at a point on the easterly side of Cardinal Drive
which point is located the following three courses and distances from
a monument set at the northeasterly terminus of an arc of a curve
connecting the easterly line of Cardinal Drive with the southerly
side of Main Road: (1) on a curve to the left with a radius of 50.00
feet for a distance of 78.54 feet to a point in the easterly line of
Cardinal Drive; (2) South 1° 51' 40" East along the easterly line of
Cardinal Drive 123.71 feet; C3} South 6° 37' 10" West still along the
easterly line of Cardinal Drive 26.58 feet to the point or place of
BEGINNING; running thence from said point of beginning North 88° 08'
20" East 233.93 feet; thence South 4° 37' 10" West 65.00 feet to a
monument; thence South 69° 24' 30" West through Lot 6 and Lot 7 as
shown on the above mentioned map 261.33 feet to a monument set on the
easterly line of Cardinal Drive; thence northerly along the easterly
line of Cardinal Drive the following two courses and distances:
(1) on a curve to the right having a radius of 209.99 feet for a
distance of 22.87 feet; (2) North 6° 37' 10" East 127.13 feet to the
point or place of BEGINNING.
BEING AND INTEDED TO BE the same premises conveyed to the party
of the first part by deed dated January 14, 1981 and recorded in the
Suffolk County Clerk's Office on February 17, 1981 in Libor 8960 Page
377.
TOGETHER with all fight, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETI-IER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration as
a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first
to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word '~pany" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
