WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration paid by
the party of the second part, does hereby grant and release unto the party of the second parL the heirs or succ~essors and
assigns of the par~y of the second part forever.
ALL that certain plot, piece or parcel of land, wilh the buildings and improvements thereon erected, situate, lying and
beinginthc Town of Southold, at Indian geck, County of Suffolk and State of New
York, being more part:icularly bounded and. described on SCHEDULE "A" annexed
hereto and made a part hereof.
BEING AND INTENDED TO BE thirteen (13%) percent of the one-half interest
owned by the Grantor herein in the same premises described in Deed from Winds
Way Building Corp. to Vincent J. Freda and Carol U. Freda, his wife, dated
February 6, 1992 and recorded in the Suffolk County Clerk's Office on February
20, 1992 in Liber 11420 at page 379, and pursuant to a renunciation by Carolyn
Ury Freda a/k/a Carol U. Freda, of her right as Surviving Tenant by the Entirety to
the one-half interest of Vincent J. Freda, deceased (See Suffolk County Surrogate's
Court File No. 209P2004).
TOGETHER with all right, title and interest, if any. of the party of the first part. in and to any streets and roads
abutting the above-described premises to the center lines thereof; .TOGETHER with the appurtenances and alt the
estale and rights o1' the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein
granted unto ibc party of the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants lhat the party of lhe firsl part has not done or suffered anythi'ng whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part. in compliance with Section 13 of the Lien Law, cove~.ants that the party of the
first part wilt receive the consideration for this conveyance attd will hold the right i~o receive such consider-
ation as a trust fund to be applied first for the purpose of paying the cost of the improvement and wilt apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as il' it read "parlies" whenever lhe sense of this indcm'ure so requires.

SCHEDULE "A"
ALL that certain plot, piece or parcel of land, with the buildings and
improvements thereon erected, situate, lying and being at Indian Neck, Town of
Southotd, County of Suffolk and State of New York, being bounded and
described as follows:
BEGINNING at the comer formed by the intersection of the Southerly side
of Parkers Lariding with the Northerly side of Indian Neck Road;
THENCE from said point of beginning atong the Southerly side of Parkers
Landing, North 52 degrees 10' 0" East, 230 feet, more or less, to the shore tine of
Richmond Creek;
THENCE along said shore line of Richmond Creek as it winds and turns,
900 feet, more or less, to lands now or formerly of Day;
THENCE along land now or+formerly of Day, South 19 degrees 00' 00"
East, 407 feet, more or less;
THENCE still along said lands due West, 305 feet, more or less, to the
Easter!y side of Indian Neck Road;
THENCE along said Indian Neck Road, the following courses and
distances:
1, North 26 degrees 28' 50" West, 225 feet to a point;
2. Thence South 89 degrees 31' 30" West, 274.10 feet to a point;
3. Thence North 73 degrees 37' 00" West, 342.79 feet;
4. South 89 degrees 18' 10" West, 209.91 feet to the point or place of
BEGINNING.
TOGETHER with a Five (5) Foot Wide Pedestrian Right of Way for
purposes of access to the beach over the 8.3 acre parcel owned b.y the Grantor
in Deed recorded on 4/'23/91 at Liber 11251 cp 248, which said Easement was
amended by Amendatory Easement Agreement dated 1130192 made between
Louise O. Day and Winds Way Building Corp., which Easement is bounded and
described as foI~ows:
BEGINNING at a point on the property line between land of Winds Way
Building Corp. and land of Day, the following two courses and distances:
