County of Suffolk, through its duly authorized to~n clerk,
pursuant to the provisions of Chapter 6~ of the Laws
of 19~, aa last amended by Chapter ~-91 of the Laws of
19~?, for permission to create a park district in said
town to be known as Mattltunk Park District, the boundaries
of which are described in said petition, and

from the board of supervisors of Suffolk County asking
that notice be given to such board of ell applications
for permission to erect or extend districts in towns in
Suffolk County,
NO~, upon reading and filing the report of
Robert B. Haner, Esq., Asei~tant Director of the Bureau
of Municipal Accounts, and the Petition of the town board
of the town of Southold dated ~anuary 18, 1959, and it
appearing to me that thc creation of a park district in
said town, having the boundaries described es follows:
~BEGINNINO at a point where the Ri~rhead-
Southold town line touches Long Island Sound;
southerly on said line its full length to
Pcconic Bay; thence easterly along aaid Bay
to the eastern boundary of Sehooi District
No; 9; thence norhte~ly along said School
Dlstr~ct line to the property of the Long
Island Railroad; thence northerly on a line
bound~ on the east by lands of O. B. Tuthlll,

is desirable, that public interest mill be served by the
creation of such perk district, and that the cost of the same
will not be an undue burden upon the pro;~rty within such
proposed distr~ct.

Sir:
The Petition of the To~ Board cf the Town of Southold,
County of Suffolk and State o~ New York, for permission to
create the Nattituck Park District, in the Town of Southold, New
York, pursuant to Sec. l, Chapter 88~ of the Laws of 19~, as
amended by Chapter ~91 of the Laws of 19~?, respectfully shows:
This application is made pursuant to a Resolution of
the Town Board of the Town of Southold, adopted at a meeting of
said Town Board held in said Town on the ~nd day of August, 19~8,
a copy of which is heret~ annexed and made a part ~hereof, wherein
your Petitioner was d~ly authorized and directed to make this ap-
plication to you as Comptroller of the State of New York, for per-
mission to create a Park District in the village of Nattituck,
Town of Southold, County of Suffolk, and State of New York, in
compliance with Sec. l, Chapter ~8~ of the Laws of 19~, as
amended by Chapter ~91 of the Laws of
This application is made also pursuant to Chapter
of the Law~ of 19~, entitled "An Act to authorize the formation
of a park district in the town of Southold, Suffolk County, to
acquire lands for park purposes and to issue bonds therefor;, a
copy of which is attached hereto and made a part ~hereof, and
marked "Schedule A."
That the ~otal assessed valuation of all real
property in the Town of Southold, according to the assessment
roll for the year 1~8, was the sum of $~E,88~,0§1; that the
Mattituck Park District

assessed valuation of the proposed Park District, according to
said assessment roll, was the sum of $3,808,486.
That a Petition dated August l, 1938, was duly filed
and presented to the Town Board of the Town of Southold, on the
2nd day of August, requesting said Town Board to Create the
Mattituck Park District, of the Town of Southold; that said
Petition contains the names of more than fifty per centum of
the owners and resident owners of taxable real property within
the said proposed district, according to the 1938 assessment
roll, to wit; $1,424,825; that a copy of said Petition, duly
certified by the Assessor of said proposed Park District, is
attached hereto, made a part hereof, and marked -Schedule B."
That according to the 1938 assessmenaTroll of the
Town of Southold, there are Special Districts shown upon same,
which are embraced in the proposed district, attached hereto
and made a part hereof as ,,Schedule C", showing all of said
Special Districts, together with the assessed valuation of each
District and the amount of taxes levied in each of said Dis-
tricts for all tax purposes during the year ending December
31, 1938.
Attached hereto and made a part hereof, is a
certificate of the County Treasurer of Suffolk County, marked
-Schedule D", showing the payment of taxes in the area to be
included in the proposed district, during the three years last
past.
That at the present time, the Town of Southold
has a bonded indebtedness in the sum of $Z5,600.00, represented
by bonds maturing at the rate of $5,000 per annum, which bonds
were issued for the purpose of financing the Town's share in the
construction of State Highway #25 in said Tows; that in addition
to the bonded indebtedness, there is a further indebtedness due

That the total indebtedness of said town at the date hereof, is
the sum of $30,465.00.
That during the year ending December 31, 1938, taxes were
levied on real property, within the area to be embraced in the
proposed District in the Town of Southold,
as follows:

That, since this district is bounded on the north by
Long Island Sound, and on the South by Peconic Bay, it is pro-
posed to secure certain tracts of waterfront property, either
by gift or by purchase, which tracts will be laid out as public
parks for the use of the people of the district. It is essential
that such acquisition of property be done in the near future, as
plots
desirable frontag~on the Bay and the Sound are becoming scarce,
and it is now difficult for the public to find places where they
have access to the water. It is essential, also, that this be
done, as the summer population shuns villages where access to
Bay and Sound has not been saved for the public.
~e permanent population of the proposed district is
approximately 2,000, and there is a large influx of summer
residents during June, July, and August. While many of the latter
have purchased waterfront property, for most part the general
public has access to the water in the territory proposed go be

included in the Mattituck Park District only at scattered
points where the Town maintains roads leading to the water,s
edge; that this lack of access to the water is a serious
hindrance to the efforts of the people of the district in
their attempts to develop the summer activities of the
section; and that this condition can only become more serious
as time goes on. That available and desirable sites for such
improvements are already scarce, and become scarcer with every
passing year, and that such action, already too long delayed,
ought to be taken at this time, while there is still the op-
portunity to secure, either by gift or purchase at reasonable
prices, sites which will guarantee to the public for all time
easy and lawful access to the waters of Sound and Bay.
.WHEREFORE, The Town Board of the Town of Southold, County
of Suffolk, through its Town Clerk, lit. Russell L. Davlson,
respectfully prays and requests permission from yQu as Comp-
troller of the State of New York, to create said Mattituck
Park District, of the Town of Southold, County of Suffolk,
New York.

DO ENACT'AS FOLLOWs:
Establlehment of Park District
Authorized
Section 1. The town board of
the town of Southald in Suffolk
county, New York, on the written
verified petition of the taxable in-
habitants of the real property
hereinafter described whose names
appear on the last preceding as-
sessment rail of such towa as own-
ing .or representing more than
one-half of the taxable property
.within such territory, or as own-
~ng or representing more than one-
half of the taxable property owned
by the residents thereof, may es-
tablish a park district~ for the ac-
quisition, holding and owning of
land in such town, for park pur-'
poses, and within the following
described boundaries:
Boundaries
Beginning at-the point where
the Riverhead-Southold town line
touches Long Island sound south-
erly on s~id line it~ full length to
Peconic bay, thence easterly along
said bay to the eastern boundary
of school district number nine,
thence northerly along said school
district line to the property of the
Long Island railroad, thence north-
erly on a line bounded on the 'east
by lands of G. B. TuthiH, H. S.
Tuthill, Annie Butinowski and
Anion Bakowski to Long Island
sound and thence westerly to the
point or place of beginning.
Section 2. When such park dis-
trict has been established in the
manner above provided, the legal
I voters thereof may elect three res-
/lidents thereof to be the park com-
a female over twenty-one years
of age, fOr a term of one, two, and
three years respectively; and may
also elect a treasurer in such park
~istrict for a term of three years,
who shall be entitled iq. receive
~nd have custody of the funds of
the district and pay out the same

for, on the order of the park com-
missioners, which treasurer, be-
fore entering upon the duties of

Flret Election ·
Section 3. The f~rst election of
treasurer shay be called by the
clerk of the town of Southold,
within thirty days from the for-
mation of said district by the
of such election in at least four
of the most public places in said
district and publishing the same

For the acquisition and lthprove-
mens of ~uch land, the park com-
missioners may issue and sell
bonds of said park district in an
amount not exceeding the sum of
twenty thoUsand dollars, in the
manner hereinafter provided.
Bonds; Execution, Maturity, etc.
Section 6. Bonds issued under
authority con/erred by this act
shah be signed by the park com-
missioners and attested by the
town clerk. Such bonds shall be-
come dde within twenty y~rs
from the date of issue and shall
be so issued as to provide for the
payment of the indebtedness in
equal annual installments. They
shall bear interesi at a rate not
exceeding, five per centare per
annum and shay be sold for not
less than their par value. They
shah be sold on sealed proposals
or at public auction upon notice
published in a newspaper printed
in the town, and posted in at least
live public places in said park dis-
trict, at least ten days before the
sale, to the person who will take
them at the lowest rate of inter-
est. Such bonds shah be consecu-
tively numbered from one to the
highest number issued and the
town clerk shah keep a record of
the number of each bond, its date,
amount, rate of interest, when and
where payable, and the purcliaser
thereof or the person to whom
they are issued.
Power of Commissioners to Con-
tract. Meetings of Taxpayers to
Appropriate Moneys,
Section 7. Said park commis-
sioners shah have power to make
any and all contracts within the
appropriation voted by the resi-
dent taxpayers of the said park
district for the purpose of carry-
ing out the authorizalion and
powers herein granted. Whenever
the park commissioners in said
park district shall submit a re-
quest in v~iting fer an appropri-
ation of any sum of money for the
purposes her~in authorizedi the
clerk of the town of Southold
shall cai1 a meeting of the resi-
dent taxpayers of said district for
the purpose of voting upon the
question of appropriating such
morley; such meeting to be called
by a notice p~sted conspicuously
in at least four of the most publi~
places of said park district, and
published in a newspaper pub-
lished therein, for two weeks next
before the holding of any such
meeting, which notice shall state
the t/me, place, and purpose of
the meeting,

the public interest;
Therefore Be it Resolved: That
pursuant to Chapter 61 of the Laws

Dear Skipper:
The bill for the Mattituek Park District passed
the Assembly today and will, I think, certainly
pass the Senate next week and go to the Governor.
It would be a helpful thing if you, as Supervisor,
should sen~ a letter requesting the Governor's
signature on the bill or, if the Town Board is
meeting within a short time, it would be a good
thing to have a resolution of the Town Board sup-
porting it to go to the Governor.
In discussing the bill, you should refer to
Assembly Int. 380, Print 1978, by the undersigned.
I think we have done a pretty careful Job on the
bill and have not added to your difficulties any
more than we possibl~ could help under the new
Constitution. I am sure you agree with me that
the Park District is needed in Mattltuck and the
Commissioners are trying to do a good Job of
work on it.
I appreciate your letter regarding the Civil
Service bill. Frank Moore and I worked together
to try to give the local governments every pos-
sible option and chance to work out a Civil
Service plan which suited them and I think we
succeeded fa~ly well.
