The proposed construction of this single-family dwelling, notes a front yard setback of 31' +/-, lot coverage of 26% +/- after construction. PROPERTY FACTS/DESCRIPTION: The applicant's property is a non-conforming 21,322 square foot lot, located in the R-80 Low-Density Residential Zone District, and improved with a single-story, one*family home. The dwelling faces Bennett Lane to the east, and fronts 200 linear feet along Bennett Lane and 110 feet along Clearview Avenue to the south, 200 feet along the western boundary and 103.22 feet along the northern boundary of the property. BASIS OF APPLICATION: Request for a Variance under Sections 280-122A and 280- 124, based on the Building Inspector's revised September 18, 2008 Notice of Disapproval concerning a proposed new dwelling, after demolition of the existing building, which new construction will create a new degree of nonconformance and will create an increase in the degree of nonconfm'mance, with regard to the front yard setback at less than the code-reqnired minimum of 40 feet on this parcel containing 21,322 square feet. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on December 4, 2008, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: Page 2 - December 18, 2008 ZBA # 6231 -- John Tagios, Applicant CTM Parcel 70-8-35 AREA VARIANCE RELIEF REQUESTED: The applicant is proposing to build a new two-story dwelling, while retaining the existing foundation and demolishing the remainder of the existing one-story dwelling. The setback requested at 31.5 feet as shown on the site survey amended September 16, 2008 by John T. Metzger, Land Surveyor. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law §267-b(3)(b)(3)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because the front yard setback requested is 37 f~et to the foundation and 31 feet to the front entrance at the easterly wall. The neighborhood consists of similar homes in this residential neighborhood, and many vary with different styles and sizes. In this application, the applicant plans to retain and build upon the existing foundation for a new two-story dwelling, 390 square fbot garage, 375 square foot first-floor deck and 60 square foot second-floor deck. The elevation of the new construction measured from ground varies between 30'6" to 32'10" to the top of the ~'idge. The lot coverage will be conforming at 14.5% fbr the new dwelling construction, and at 18.3% with a swimming pool structure and patio at grade. 2. Town Law §267-b(3)ib)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because the applicant wishes to retain and use the existing foundation for the new construction. 3. Town Law §267-b(3)(b)(3). The variance requested herein is not substantial. 4. Town Law §267-b(3)(b)(5). The difficulty has not been self created since the fi'ont yard setback is already nonconforming, and the new dwelling will be almost entirely built upon the existing fbundation. 5. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Town Law §267-b.
