PO Box 539 Mattituck, NY 11952 RE: 250 SOUND BEACH DRIVE, MATTITUCK SCTM# 99-1-16.1 Dear Mr. Lomaga: Thank you for your letter of June 11, 2013 concerning the split-rail fence at 250 Sound Beach Drive in Mattituck, SCTM# 99-1-16.1. This fence has a valid Trustees Administrative Permit #6104A and a New York State Department of Environmental Conservation Permit #1-4738-01297-00003, and is in compliance with said permits. The Southold Town Board of Trustees conducted a site inspection on July 10, 2013 at high tide which was at 13:45. At that time the edge of the water was 35' seaward of the seaward end of the fence. J ~ ' ,a " t_r~~~ a • iP , ~ Dear Trusteds June 11, 2013 in regard to an ongoing matter, we would like to bring to your attention an update as we have observed, and would request a meeting when appropriate. The matter of interest is the egress to the beach at Inlet Drive in Mattituck. Included here are photographs demonstrating our concerns. We believe the fence can be erected after Aprii 1~` and removed in December. Also no mechanized equipment or vehicles are to appear on the beach. The observations shown here question possible action by the Board of Trustees. Facts: 1. Fence was erected on March 30, 2013 2. Photos 1 and 2 show piles of debris collected and left on the beach. in the piles were bales of hay likely used in prior environmental requirements 3. Photos 1 and 2 further show sections of the fence well beyond the water extent at high tide 4. After the fence was erected an array of numerous quad tracks could be seen 5. How is the mean high tide established? 6. Can an official survey be seen done by The Town of Southold of this property? 7. Other towns as well are being affected by abuses to public beach access as shown in the included articles. Therefore, why wn Southold Town not enforce a defense of our public rights? The permit holder must retain the services of an environmental monitor to ensure that no disturbance to endangered threatened species occurs as a result of the authorized activities. The monitor shall be present whenever work is underway and shall report to the NYSDEC Office of Natural Resources, Attn: Chip Hamilton on a weekly basis. Environmental Monitor Qualifications The environmental monitor must be a qualified field biologist experienced with tern and plover biology. His/her qualifications shall be submitted to NYSDEC Office of Natural Resources (Attn: Chip Hamilton, NYSDEC Region 1, Sony Brook University, 50 Circle Road, Stony Brook, NY 11790-2356), and must be approved by the Department prior to the commencement of any regulated activity from April 1 to August 31 (inclusive) of any calendar year. 5. Fence Installed and Removed Seasonally The approved fence must be installed and removed each year. The fence may not be installed prior to April 1 of each calendar year, and must be completely removed by December 1 of each calendar year. 6. Fence Installed Using Hand Tools Installation of the approved fence must be done by hand. The use ofgas-powered equipment, heavy machinery or vehicles on the beach is prohibited. 7. Fence Located Landward of Apparent High Water The approved fence must be located landweard of Apparent High Water at all times. At no time shall any portion of the fence extend into the water, and seasonal changes in the High Water limit may necessitate adjustment or shortening of the fence. s. No Disturbance to Vegetated Tidal Wetlands, Dunes There shall be no disturbance to vegetated dune areas or vegetated tidal wetland areas as a result of the pennitted activities. 9. No Construction Debris in Wetland or Adjacent Area Any debris or excess material from construction of this project shall be completely removed from the adjacent area (upland) and removed to an approved upland area for disposal. No debris is permitted in wetlands and/or protected buffer areas. lo. State Not Liable for Damage The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized which maybe caused by or result from future operations undertaken by the State for the conservation or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such damage. 11. State May Require Site Restoration If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. State May Order Removal or Alteration of Work If future operations by the State of New York require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people of the State, or cause loss or destruction of the natural resources of the State, the owner maybe ordered by the Department to remove or alter the structural work, obstructions, or hazards caused thereby without expense to the State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other modification of the watercourse hereby authorized shall not be completed, the owners, shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood capacity of the watercourse. No claim shall be made against the State of New York on account of any such removal or alteration. 13. Precautions Against Contamination of Waters All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project. GENERAL CONDITIONS -Apply to ALL Authorized Permits: 1: Facility Inspection by The Department The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation (the Department) to determine whether the pennittee is complying with this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71- 0301 and SAPA 401(3). The permittee shall provide a person to accompany the Department's representative during an inspection to the permit area when requested by the Department. A copy of this permit, including all referenced maps, drawings and special conditions, must be available for inspection by the Department at all times at the project site or facility. Failure to produce a copy of the permit upon request by a Department representative is a violation of this permit. 2. Relationship of this Permit to Other Department Orders and Determinations Unless expressly provided for by the Departrrlent, issuance of this permit does not modify, supersede or rescind any order or determination previously issued by the Department or any of the terms, conditions or requirements contained in such order or determination. Permit Modifications, Suspensions and Revocations by the Department The Department reserves the right to modify, suspend or revoke this permit. The grounds for modification, suspension or revocation include: a. materially false or inaccurate statements in the permit application or supporting papers; b. failure by the permittee to comply with any terms or conditions of the permit; c. exceeding the scope of the project as described in the permit application; d. newly discovered material information or a material change in environmental conditions, relevant technology or applicable law or regulations since the issuance of the existing permit; e. noncompliance with previously issued permit conditions, orders of the commissioner, any provisions of the Environmental Conservation Law or regulations of the Department related to the permitted activity. 6. Permit Transfer Permits are transferrable unless specifically prohibited by statute, regulation or another permit condition. This indemnification does not extend to any claims, suits, actions, or damages to the extent attributable to DEC's own negligent or intentional acts or omissions, or to any claims, suits, or actions naming the DEC and arising under Article 78 of the New York Civil Practice Laws and Rules or any citizen suit or civil rights provision under federal or state laws. Item B: Permittee's Contractors to Comply with Permit The permittee is responsible for informing its independent contractors, employees, agents and assigns of their responsibility to comply with this permit, including all special conditions while acting as the permittee's agent with respect to the permitted activities, and such persons shall be subject to the same sanctions for violations of the Environmental Conservation Law as those prescribed for the permittee. Box 1179 Southold, New York 11971 Dear Southold Trustees: We have been informed of a neighboring fence installed below the high tide mark to the west of Breakwater Beach that is blocking the passage of residents as they walk westerly along the shoreline. The fence may be negatively affecting the public's right to use the beaches below the high tide mark. The NY State public mast waters are the waters of the State, and the public trust lands are the lands now, or formerly, beneath those waters to the high tide mark. The Public Trust Doctrine is important in establishing the right to use and pass over the foreshore of tidal waters. Quoting a case involving the use of land in Hempstead Harbor Tucci v. Salzhauer, 336 NYS 2d 721), the Court defined the public's right in the foreshore: "When the tide is in, he may use the water covering the foreshore for boating, bathing, fishing and other lawful purposes; and when the tide is out, he may pass and repass over the foreshore as a means of access to reach the water for the same purposes and to lounge and recline thereon." It is important that the trustees maintain the rights of both the public and the littoral property owners in order to manage the waterfront. Al, your letter states that the present bamer was moved for a beach clean up project and that sand is now piled up against it ,making the beach now accessible to drive on the beach. I would ask that in the future, before permission is given to anyone to gain access across a Southold Town road end, that the Highway Department be consulted with first. Because in this case the person cleaning the beach pushed the sand against the guardrail to ride over it to gain access to the beach. Feel free to contact my office if you have any questions.
