TERMS AND CONDITIONS
The Permittee Jack Biggane, residing at 8871 Oregon Road, Cutchogue, New York as part of
the consideration for the issuance of the Permit does understand and prescribe to the following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or clam for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Mr. Cichanowicz:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, October 20, 2010 regarding the above matter:
WHEREAS, Creative Environmental Design on behalf of JACK BIGGANE applied to
the Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated August 31,2010, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Headng was held by the Town Trustees with respect to said
application on October 20, 2010, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of JACK BIGGANE to
construct a timber stairway on the bluff; with the condition that the project conforms to
Chapter 236 of the Town Code-Storm Water Management; and as depicted on the site
plan prepared by Creative Environmental Design, received on August 31, 2010, and
stamped approved on October 20, 2010.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are requirad at a fee of $50.00 per inspection. (See attached schedule.)

Jack Biggane - Wetland Permit for Timber Stairway
Dear Mrs. Dohefity:
I am in receipt of an E-Mail from Mark Terry, LWRP Coordinator, requesting a review
of the proposed action. From the aerial photographs available on the internet, it is evident
that storm water runoff and drainage issues have been created by existing site development.
It is recommended that these drainage issues be addressed as a condition of any new
permits issues for this site.
As I understand the current situation, DEC & Trustee Permits have already been
issued to repair the bluff face. I have discussed this matter with Dave Chicanowitz. He is
the contractor currently in the process of armoring the bluff. His solution to modify the
drainage was to install another drain further south to keep storm water away from the bluff.
If this new leaching pool is also installed in clayed soils, it will not solve the current problem.
I suggested, at the very least, that a test hole be drilled at this new location to verify soil
types and the depth to which well draining soils are present. If necessary, this new pool
location should be excavated by crane to reach good drainage material to prevent the sub-
surface saturation of unstable soil found in this area. If this excavation is deemed to be too
deep, other areas of the site should be investigated to find good drainage.
The bluff erosion that has already taken place indicates the presence of unstable soils under
saturated conditions. It is recommended that the Board of Trustees consider requiring a
formal drainage review subject to Town Code Chapter 236 for Storm Water Management. If
you have any questions concerning this project, please contact my office.

Thanks for the response. I support the common stairway approach. The real concern is another failure of
the bluff slope, if that happens the survival of the vegetation would be Iow and ability of the stairs to hold
is slim. I recommend that we really address the drainage/erosion before the Board allows a structure to
be built on the bluff. Even though the Board permitted a restoration plan there is no indication that it will
be successful. This area is prone to slope failure due to surface and subsurface influences. Jamie and I
discussed that the erosion is from crest to toe indicating storm or groundwater influence.
Frankly, I think this area contains the most unstable bluff in the Town. In the same area the new O'mara
stairs failed and fell down the bluff. The vegetation that they planted did not hold, the slope was too
severe.
I would like the opportunity to go out to the site and see if there is anything that could be done. I was
going to go with Jamie today but he attended a class. Could you give us that opportunity? In the event
that the Board wants to move forward my recommendation is that the action is INCONSISTENT pursuant

to policy 4.1. The action is located within the CEHA.
4.1 Minimize losses of human life and structures from flooding and erosion hazards.
The following management measures to minimize losses of human life and structures from flooding and
erosion hazards are suggested:
A. Minimize potential loss and damage by locating development and structures away
from flooding and erosion hazards.
1. Avoid development other than water-dependent uses in coastal hazard areas. Locate new
development which is not water-dependent as far away from coastal hazard areas as practical.
a. No development is permitted in natural protective feature areas, except as specifically
allowed under the relevant portions of 6 NYCRR 505.8.
b. Avoid hazards by siting structures to maximize the distance from Coastal Erosion Hazard
Areas.
I will deliver a more formal review tomorrow, but in the interest of time this will suffice.

Hi Mark,
The road is not near this site. Years ago the trustees requested that a drain be placed in the area
of the bluff to catch the property runoff at the Iow point. It was an idea that did not work. I
believe Mr. Biggane has since abandoned this catch basin. However, the damage has been done.
Mr. B. currently has a permit to restore this area. I believe that this area is the best location for a
set of stairs and it will serve 2 properties.
They would like to do the stairs asap as to get the fall planting done. If you have time before
tonight, you can give me a call.

Could you forward this the Board? As I discussed with you, I spoke to Jamie Richter and he and I would like to
go out and evaluate the site more closely to determine the source of storm water contributing to the severe
erosion. He mentioned that the mad drainage may be influencing the erosion.

Creative Environmental Design on behalf of JACK BIGGANE requests a Wetland Permit to construct a
timber stairway on the bluff. Located: 8871 Oregon Rd., Cutchogue. SCTM#83-1-34
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
CONSISTENT with the denoted following Policy Standards and therefore is CONSISTENT with the
LWRP.
This recommendation was made with consideration of the conditions and best management practices
required in Wetlands Permit (7174) issued by the Board of Trustees in 2009 and the Engineering
Report dated October 1st, 2010 and drafted by Jamie Richter, Office of the Town Engineer requiring
that the action comply with Chapter 236 Stormwater, Grading and Drainage Control Law.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
