Dear Mr. Uellendahl:
The Southold Town Board of Trustees reviewed the site plan prepared by Frank
Uellendahl, Architect, last dated October 29, 2010, and received on October 29, 2010,
and determined that the construction of a proposed deck extension with a hot tub is out
of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter
111 of the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the
Coastal Erosion Hazard Area (Chapter 111 ) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of
the coastal erosion hazard area as indicated above, or within 100' landward from the
top of the bluff, without further authorization from the Southold Town Board of Trustees
pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility
to ensure that all necessary precautions are taken to prevent any sedimentation or other
alteration or disturbance to the ground surface or vegetation within Tidal Wetlands
jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland
jurisdictional boundary and the coastal erosion hazard area and your project or erecting
a temporary fence, barrier, or hay bale berm.
This determination is not a determination from any other agency.

Dear Members of the Southold Town Board of Trustees,
Attached please find an application regarding the request for a Letter of Non-Jurisdiction by your Board
for the above referenced deck extension seaward of the existing residence.
My clients wish to extend their existing deck in width and length and incorporate a hot tub on the lower
level of the deck.
The total width of the two-leveled deck is 25 feet and the total length is 28'-9',
The current deck measures 17 feet wide and 14 feet long.
The distance from the proposed deck to the high water mark measures ca. 177.5 feet and to the grass
line ca.145 feet.
I believe that the proposed deck extension does not require an administrative wetland permit and
qualifies for the issuance of a Letter of Non-Jurisdiction because it exceeds the 100 feet distance
requirement.
