Vote of Council: Ayes: All Motion Carried 15 September 20:10 The Conservation Advisory Council cannot support the present application of Anna Costas c/o Renee Argentinis, 20795 Soundview Ave. Southold to armor the base of a collapsing seawall with :150 tons of rock consisting of 1-3 ton rock for the following reasons. The present seawall is now footed below mean high water (MLW) on state titled public land. The placement of 150 tons of rock on public land would illegally deny safe public access and lateral passage along the shore. This is of particular concern to the CAC as an extensive length of the shoreline bordering this eastern section of Soundview Ave has suffered recent major erosions involving a number of property owners who are or have been permitted to protect their properties by armoring the base of seawalls or bulkheads. This effectively closes off thousands of feet of public land adjacent to a town beach from lawful public passage. The hardening of extensive lengths of shoreline by immobile rock placed on top of natural unconsolidated sediment represents a habitat change with physical and ecological repercussions that are presently unknown and requires a coastal management or environmental review. This piecemeal approach of each application being considered on its merits as isolated from the local coastal system is not sound management practice. The combination of extensive lengths of vertical seawall/bulkhead walls which are basely armored by immobile rock will have a fundamental effect on littoral transport of sediment. This massive hardening of the shoreline will change the physical dynamics of how the sea interacts with an unnaturally modified coastline with results that are usually unwanted. Jill M. Doherty. Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: (2) Erosion control. Installation of an erosion control structure is necessary during any building, grading, landscaping or site work activity within Trustee jurisdiction. This structure may include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt booms. The placement of the erosion control structure(s) shall be determined by the Trustees or their designee. All intertidal construction and excavation requires the installation of a Silt boom that will retain all suspended sediments within the immediate proiect area. The proposal to construct new deck and moving new deck 8' landward is INCONSISTENT. § 275-11. Construction and operation standards. A. General. Platforms associated with stairs may not be larger than 32 square feet. [Amended 10-11-2006 by L.L. No. 17-2005] It is unclear if the new deck would be located 8' from the top-of-bluff line or from its current location. Policy 4.1 "Minimize losses of human life and structures from flooding and erosion hazards." The following management measures to minimize losses of human life and structures from flooding and erosion hazards are recommended: specifically A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 1. Avoid development other than water-dependent uses in coastal hazard areas. Locate new development which is not water-dependent as far away from coastal hazard areas as practical. no development is permitted in natural protective feature areas, except as specifically allowed under the relevant portions of 6 NYCRR 505.8. avoid hazards by siting structures to maximize the distance from Coastal Erosion Hazard Areas. To further the above policy, it is recommended that the new deck be located landward of the Coastal Erosion Hazard Area to the .qreatest extent practicable. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. The existing concrete splash on this property has been damaged by the recent spring storms. The owner would like to maintain the property and provide safe access to the waterfront by repairing and/or rebuilding the existing structures. Our proposal will not have any effect on the commtmity character or preservation of open space. Policy 2 Preserve historic resources of the Town of Southold. This property has no significant historic resources. Policy 3 Enhance visual quality and protect scenic resources throughout the Town of Southold. All structures exist. The current conditions of these structures are unstable threatening the integrity of the upland property. Our proposal is just an attempt of the upland property owner to maintain his property. The present conditions of these structures are not aesthetically pleasing so the visual quality and scenic resources will be restored to when the area was stable. NATURAL COAST POLICIES Policy 4 Minimize loss of life, structures, and natural resources from flooding and erosion. The existing bulkhead is needed to protect the upland property. The new bulkhead will help control further erosion of this bluff and will not increase flooding or erosion in this area. Policy 5 Protect and improve water quality and supply in the Town of Southold. This proposal will not have any impact on the water quality and supply of the Town of Southold. Policy 6 Protect and restore the quality and function of the Town of Southold's ecosystem. This proposal will not have any impact on the Town of Southold's ecosystem. Policy 7 Protect and improve air quality in the Town of Southold. This proposal will not have any impact on the air quality of the Town of Southold. Our proposal is to reconstruct and/or repair existing structures. The present condition of the bluffarea is poor and is unsafe. This property is used by the upland property owners to engage in water dependent activities such as fishing and swimming. These activities will continue at this site. Policy 11 Promote sustainable use of living marine resources in the Town of Southold. The site conditions at this point are poor. The repairs of these structures will help stabilize the area landward of the high water mark. There should be no significant effects on the living marine resources.
