WHEREAS, DECLARANT is the owner of certain mai property located on Sound Drive, Greenport,
Town of Southold, County of Suffolk, State of New York, described in the Suffolk County Tax Map as District
1000, Section 33, Block 1, Lot 6, and known as Lot No. 107 on "Map of Eastern Shores at Greenport, Section"
filed in the Suffolk County Clerk's Office as Map No. 4586 on March 7, 1066, which is more particularly
bounded and described as set forth in Schedule "A" annexed hereto, hereinafter referred to as the Property;
WHEREAS, the Property is situated on lands within the jurisdiction of the Board of Trustees of the
Town of Southold (hereinafter the "Trustees") pursuant to Chapter 275 of the Town Code of the Town of
Southold or its successor, and various activities conducted upon the property may thus be subject to the
regulation and approval of the Trustees prior to being conducted;
WHEREAS, the DECLARANT therefore made application to the Trustees for a permit pursuant to the
Wetlands Law of the Town of Southold to undertake certain regulated activities; and
WHEREAS, as a condition of the granting of a Wetlands Permit to undertake such regulated activities,
the Trustees required that a ten-foot wide "nonturf buffer" be established adjacent to and landward of the top of
the bluff,
NOW, THEREFORE, the DECLARANT does hereby covenant and agree as follows:
1) Upon the substantial completion of the aforementioned permitted activities there shall be
established and subsequently maintained adjacent to and landward of the top of the bluff on the
subject premises a ten-foot wide "nonturf buffer" as defined by Chapter 275 of the Town Code;
and
2)
These covenants shall mn with the land and shall be binding on the DECLARANT, her heirs,
assigns, purchasers, or successors in interest and may be modified only upon resolution of the
Board of Trustees.

Dear Mrs. Doherty:
The captioned permit authorizing construction of a swimming pool and house additions/renovations was issued
on 20 October 2010 and later amended on 23 March 2011 to reflect the roof deck proposed atop the proposed
porch being constructed in place of the existing garage.
As a result of deliberations with the Board of Appeals, changes were made to the site plan that resulted in a
decrease in the scope and corresponding lot coverage of the proposed structures. Specifically, the width of the
proposed porch has been reduced by 4 feet from 17.1' to 13.1', and the proposed waterside deck that was
proposed in place of the existing deck has been eliminated in favor of a proposed masonry patio, which together
result in a net decrease in lot coverage of "buildable land" from the existing 16.57 percent to a proposed 14.05
percent.
Therefore, we are submitting the attached application for an Administrative Amendment so that the approved
plan associated with the Town Wetlands Permit is consistent with what was approved by the Zoning Board of
Appeals, The most recem site plan prepared by John C. Elders Land Surveyor, last dated July 25, 2011, also
depicts two sets of access stairs to the on-grade patio and a proposed chimney.

The Permittee Mary Beth Henson, residing at 3300 Sound Drive, Greenport, New York as part
of the consideration for the issuance of the Permit does understand and proscribe to the
following:
That thc said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
bench between high and low water marks.
That if furore operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said'Permittec will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction
to the deed of the subject parcel. Such evidence shall be provided within ninety (90)
calendar days of issuance of this permit.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittce will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, October 20, 2010 regarding the above matter:
WHEREAS, EN-Consultants, Inc. on behalf of MARY BETH HENSON applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated September 29, 2010, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on October 20, 2010, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,

Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the

The installation ora drainage system of drywells and the removal of existing stone walls and a portion of the existing driveway will occur more
than 100 feet from the top of bluff and therefore beyond Chapter 275 jurisdiction. Thus, a letter of non-jurisdiction or statement in the permit

The proposed project includes the renovation and expansion of an existing dwelling located more than 150 feet from the tidal
wetlands and waters of Long Island Sound, where all work is proposed more than 150 feet from wetlands and the only existing
structure (hot tub) located less than 150 feet from wetlands is being removed. The minimum existing principal structure setback
of 39 feet from the top of bluff will be maintained and not further encroached upon. A 10'-wide non-turf buffer will be
established in place of existing lawn adjacent to the top of the bluffto increase the property's ability to absorb runoff adjacent to
the bluff, and a drainage system of leaders, gutters, and drywells will be installed more than 100 feet from the bluff to capture &
recharge roof runoff from the entire finished dwelling structure. With the removal of an existing hot tub and raised masonry
patio, the project will result in only a 509 square foot increase to the structural coverage of the parcel, approximately 200 square
feet less than the area of lawn to be removed. A project-limiting fence and staked haybales will be set in place landward of the
Bluffand Coastal Erosion Hazard Area to restrict and contain site disturbance during construction. Therefore, the project will
have no significant adverse impact on the adjacent tidal waters/wetlands.

The project will protect and improve water quality and thus be consistent with Policy 5 through the establishment of a 10'-wide nonturf
buffer in place of existing maintained lawn area adjacent to the top of the bluff. The existing naturally vegetated slope will remain
undisturbed and continue to serve as a buffer adjacent to Long Island Sound. The surface water nmoff absorption capacity of the site
will be increased not only by the replacement of lawn with this buffer but also via installation of a drainage system of leaders, gutters,
and drywells to capture and recharge roof runoff from the entire finished dwelling structure.

The proposed project includes the renovation and expansion of an existing dwelling located more than 150 feet from the tidal wetlands
and waters of Long Island Sound, where all work is proposed more than 150 feet from wetlands and the only existing structure (hot tub)
located less than 150 feet from wetlands is being removed. The minimum existing principal structure setback of 39 feet from the top of
adjacent to the top of the bluff to increase the property's ability to absorb runoff adjacent to the bluff, and a drainage system of leaders,
gutters, and drywells will be installed more than 100 feet from the bluff to capture & recharge roof runoff from the entire finished
dwelling structure. With the removal of an existing hot tub and raised masonry patio, the project will result in only a 509 square foot
increase to the s~uctural coverage of the parcel, approximately 200 square feet less than the area of lawn to be removed. A
project-limiting fence and staked haybales will be set in place landward of the Bluff and Coastal Erosion Hazard Area to restrict and
contain site disturbance during construction. The project will have to comply with the terms ora Town Wetlands Permit and is beyond
the jurisdiction of the New York State Tidal Wetlands Act due to its location landward of the top of a bluff whose elevation exceeds 10
feet above mean sea level. Although a 100-foot bluff setback cannot be achieved due to the location of the preexisting nonconforming
dwelling, existing bluff setbacks from the principle structure will be maintained and not encroached upon, and the newly proposed
swimming pool will be located partially more than 100 feet from the top of bluff. Therefore, the project will be consistent with Policy 6.
