State May Kequire Site Restoration If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may lawfully require, remo~~e all or any portion of the uncompleted structure or fill and restore the site to its former condition. Yost Permit Sign The permit sign enclosed with this permit shall be posted in a conspicuous location on the worksite and adequately protected from the weather. 3. Within 30 days of completion of project, the bottom portion of the form must also be signed and returned, along with photographs of the completed work. yYork Area Limits Any work, disturbance, and or storage of construction materials shall be confined to within the limit of clearing and ground disturbance shown on the approved plan. 5. Materials Disposed at Upland Site Any demolition debris, excess conshucdo? materials, and/or excess excavated materials shall be immediately and completely disposed of on an approved upland site more than 100 feet from any regulated freshwater wetland. These materials shall be suitably stabilized so as not to re-enter any water body, wetland, or wetland adjacent area. No Equipment in Wetland Heavy equipment, including bulldozers, backhoes, payloaders, etc., shall not be operated in the wetland. All work in the wetland is to be done by hand operated tools or long reach equipment from upland locations. 7. Straw Bales Prior to commencement of any construction activities, a continuous row of straw bales shall be staked end to end as needed along the "Limits of clearing, grading and ground disturbance line" as shown on the approved plans. s. Straw Bales to Be Entrenched Straw bates shall be entrenched two to four inches into the ground. 9. Maintain Bales The bales shall be maintained, repaired and replaced as often as necessary to ensure proper function, until all distm-bed areas are permanently vegetated. The average useful life of a bale is approximately 3-4 months. Sediments trapped by the bales shall be removed to an approved upland location before the bales themselves are removed. 10. Clean Fill Only All fill shall consist of clean soil, sand and/or gravel that is free of the following substances: asphalt, slag, flyash, broken concrete, demolition debris, garbage, household refuse, tires: woody materials including tree or landscape debris, and metal objects. The introduction of materials toxic to aquatic life is expressly prohibited. 11. Runoff and Discharges Directed to Drywells All roof runoff and/or pool discharges shall be directed to drywells located as shown on the approved plans. L. Seed, Mulch Disturbed Areas All areas of soil disturbance resulting from this project shall be seeded with an appropriate perennial grass, and mulched with straw immediately upon completion of the project, within two days of final grading, or by the expiration of the permit, whichever is first. 13. Temporary Mulch, Final Seeding If seeding is impracticable due to the time of year, a temporary mulch shall be applied and final seeding shall be performed at the earliest opportunity when weather conditions favor germination and growth but not more than six months after project completion. Lt. Minimum % Vegetative Cover Suitable vegetative cover is defined as a minimum of 85 % area vegetative cover with contiguous unvegetated areas no larger than 1 square foot in size. 15. Equipment Storage 100' from Wetland, Water Body All equipment and machinery shall he stored and safely contained greater than 100 feet landwazd of the regulated wetland or water body at the end of each work day. This will serve to avoid the inadvertent leakage of deleterious substances into the regulated area. Planting Requirement All that area west of the clearins limit line is to be allowed to revert to natural (a 4' wide path may be maintained as shown on the approved plans). Within 6 months of completion of the house, a continuous row of shrubs must be planted as shown on the approved plans. 17. Prohibited Treated Wood Creosote treated wood products cannot be used in New York State, except by the following entities: railroads companies for track and grade infrastructure; cotporate, public and municipal owned electric utilities for utility poles. 18. Wood Debris and Wash Water All treated wood must be aged in the open air for at least three months prior to in-water use. Wood with surface deposits must be washed for at least 5 minutes under running water poor to use. This washing must occur more than 100 feet from a wetland or waterbody. Wash water and any wood debris, such as sawdust, must not enter any wetland or waterbody. 19. Use Pressure Treated Wood Where treated wood lumber is to be used in the construction of in- water structures, only pressure treated wood with a preservative and treatment process approved (stamped or otherwise marked as certified) by the American Wood Preservative Association can be used. Wood treated with CCA (Chromated Copper Arsenate) or ACQ (Alkaline Copper Quat) can be used in all aquatic environments. Wood treated with Pentachlorophenolcgn only be used in freshwater applications. 30. Vegetation Clearing Restrictions No woody vegetation, located greater than 1 foot from the path, stairs, catwalk, or dock may be cut for the installation of the path, stairs, catwalk or dock. After installation, natural vegetation must be allowed to grow back to the edges of the path, stairs, catwalk and dock. y 21. State Not Liable for Damage The State of New York shall in no case be liable for any damage or injury to the stucture or work herein authorized which may be caused by or result from future operations undertaken by the State for the conservation or improvement of navigation, or for other ptnposes, and no claim or right to compensation shall accrue from any such damage. 2z. Conformance With Plans All activities authorized by this permit must be in sU-ict conformance with the approved plans submitted by the applicant or applicant's agent as part of the permit application. Such approved plans were prepared by Garrett A. Strang, last revised 5/4/1? and stamped NYSDEC approved on 6/7/1?. 23. State Nlay Urder Removal or Alteration of Work if future operations by the State of New York require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered by the Department to remove or alter the structural work, obstructions, or hazards caused thereby without expense to the State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other modification of the watercourse hereby authorized shall not be completed, the owners, shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood capacity of the watercourse. No claim shall be made against the State of New York on account of any such removal or alteration. Precautions Against Contamination of Waters All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project. GENERAL CONDITIONS -Apply to ALL Authorized Permits: 1. Facility Inspection by The Department The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation (the Department) to determine whether the permittee is complying with this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71- 0301 and SAPA 401(3). The permittee shall provide a person to accompany the Department's representative during an inspection to the permit area when requested by the Department. A copy of this permit, including all referenced maps, drawings and special conditions, muse be available for inspection by the Department at all times at the project site or facility. Failure to produce a copy of the permit upon request by a Department representative is a violation of this permit. Relationship of this Permit to Other Department Orders and lleterminations Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind any order or determination previously issued by the Department or any of the terms, conditions or requirements contained in such order or determination. 3. Applications For Permit Renewals, Modifications or Transfers The permittee must submit a separate written application to the Department for permit renewal, modification or transfer of this permit. Such application must include any forms or supplemental information the Department requires. Any renewal, modification or transfer granted by the Department must be in writing. SCTM#31-12-12 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the denoted following Policy Standards and therefore is CONSISTENT with the LWRP provided the following: If the action is approved, to further Policy 5: Protect and Improve Water Quality in the Town of Southold and Policy 6; Protect and Restore the Quality and Function of the Town of Southold Ecosystem it is recommended that a minimum 20 foot natural vegetated buffer be required landward from the edge of wetlands, where existing vegetation (trees) occur. NATURAL VEGETATED BUFFER a land area of a certain length and width where existing vegetation occurs prior to the commencement of any grading or clearing activity. Vegetation shall be maintained to achieve a minimum percent ground cover of ninety-five (95) percent. To achieve the percent ground cover indigenous, drought tolerant vegetation shall be planted. Survival of planted vegetation shall be (ninety) 90 percent for a period of three (3) years. Maintenance activities within the buffer are limited to removing vegetation which are hazardous to life and property, trimming tree limbs up to a height of fifteen feet (15') to maintain ~ • viewsheds, replanting of vegetation and establishing a four foot (4') wide access path constructed of pervious material for access to the water-body Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
