14,'ITNESSETH, that the party of the first part, in consideration of Ten Dollars and other lawful
consideration, lawful money of the United States, paid by the party of the second part, does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever,

situate, lying and being at near the Village of Southold, in the Town of Sout.hold, County of Suffolk and State of
New York, being more particularly bounded and described as follows:
BEGINNING at the northwesterly comer of the premises herein described on the easterly line of lot no.
46, as shown on a certain map entitled, "Map of Goose Bay Estates at Southold, Long Island" filed in the Suffolk
County Clerk's Office on November 13, 1934, as Map No. 1176, and which point lies l0 feet southerly from the
northeasterly corner of said lot no. 46, measured along the easterly line of said lot no. 46 on a course running
South 17 degrees 34 minutes 30 seconds West and being the center line of said lot no. 46; running thence in a
general easterly direction along lands now or formerly of Herbert Rosenberg and on the extension of the center
line of said lot no.46, a distance of 150 feet to the westerly line ora certain 30 foot private right of way; running
thence in a general southerly direction and along the westerly side of said p/'ivate right of way South 17 degrees
34 minutes 30 seconds West a distance of 80 feet to a point and other lands of Rix R. McDavid; running thence
in a general westerly direction along other lands of Rix R. McDavid and on the extension of the center line of lot
no. 42, as shown on said "Map of Goose Bay Estates, at Southold, Long Island" a distance of 150 feet to a point
on the easterly line of said lot no. 42 and being the center line thereof and being distant 10 feet northerly of the
southeasterly corner of said lot no. 42, measured along the easterly line thereof on a course running North 17
degrees 34 minutes and 30 seconds East; running thence along the easterly line of lots numbered 42, 43, 44, 45,
and 46 as shown on said "Map of Goose Bay Estates at Southold, Long Island", on a course running North 17
degrees 34 minutes 30 seconds East a distance of 80 feet to the point or place of beinning.
TOGETHER with three (3) rights of way described as follows:
1. Together with a right of way 30 feet in width from the northeasterly corner of the premises southerly about
792 feet; thence easterly at right angles to said 30 foot right of way about 168 feet to land formerly of Sadie
Gagen and to another 30 foot right (No. 2) as described below; 2. Also with a right of way 30 feet in width over
said land formerly of Sadie Gagen and adjoining the westerly boundary thereof, from North Bay~iew Road
northerly about 1680 feet to a dredged central landing to Goose Creek; 3. Also with a right of way 30 feet in
width, the northerly line of which is the extension easterly of the northerly line of the premises hereinabove
described, from the northeasterly corner of said premises easterly about 170 feet to said land formerly of Sadie
Gagen and to said 30 foot right of way (No. 2) described above.
Being and intended to be the same premises conveyed to the party of the first part by deed dated February
I2, 1980 and recorded in Liber 8782, Page 315.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to
said premises,

TO HA VE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part, covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will
apply the same first to the payment of the cost of the improvement before using any part of the total of the same
for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
