THIS INDENTURE, made the I ~Vt.day of October, two thousand and nine,
BETWEEN
BEVERLY B. LUHRS, residing at 1083 Pinedale Drive, Bedford, Virginia 24523,
as Executor of the Last Will and Testament of Margaret G. Brooks a/k/a Margaret Irene Brooks
deceased who died a resident of Southold, Suffolk County, New York on August 23, 2009,
Surrogates File No. 2009-1920, party of the first part, and
BEVERLY B. LUHRS, residing at 1083 Pinedale Drive, Bedford, Virginia 24523,
party of the second part,'
WlTNESSETH, that the party of the first part, by virtue of the power and authority given in and by
said last will and testament, and in consideration of consideration of TEN and 00/100 ($10.00)
dollars, release unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, with the buildings and improvements thereon erected, situate, lying and being in the village of
Greenport and Town of Southold, County of Suffolk and State of New York, and shown and
designated on a Map entitled, "Map of Fleetfield, Town of Southold" as and by Lot # 6, Section 2,
which said map is filed is filed in the office of the Clerk of the County of Suffolk as and by Map #
1351 on the 6friday of February, 1942.
This conveyance is made by the party of the first part pursuant to and in accordance with Article
THIRD of the Last Will and Testament of Margaret G. Brooks dated November 3, 2007.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed
dated January 9, 1992 and recorded in the Office of the Clerk of Suffolk County on January 15, 1992
in Liber 11412 page 237.
TOGETHER with all fight, title and interest, if any, of the party of the first part in and to any streets
and roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate which the said decedent had at the time of decedent's death in said
premises, and also the estate therein, which the party of the first part has or has power to convey or
dispose of, whether individually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD
the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part, covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party &the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the
improvement and will apply the same first to the payment of the cost of the improvement before
using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year
first above written.
