SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type 11 category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its
reply dated September 30, 2010, stating that this application is considered a matter for local determination as there
appears to be no significant county-wide or inter-community impact.
LWRP: This application was referred for reviewed under Chapter 268, Waterfront Consistency review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The
LWRP Coordinator issued his reply dated October 13, 2010; based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records available to us, it is our
recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is
CONSISTENT with the LWRP.
PROPERTY FACTS/DESCRIPTION: Subject property is a conforming 74,146 sq. fi. lot improved with a two
story single-family dwelling. It has 124.42 feet of frontage on North View Dr., 430.74 feet along the western
property line, 258.75 feet on Long Island Sound and 374.63 feet along the eastern property line as shown on the
survey dated June 12, 2010 prepared by John C. Ehlers, LS.
BASIS OF APPLICATION: Request for Variance from Article Ill, Code Section 280-13C, based on an
application for building permit and the Building Inspector's September 13, 2010 Notice of Disapproval, concerning
construction of an accessory structure; proposed construction of an art studio is not a permitted use.
RELIEF REQUESTED: The applicant proposes to construct an accessory structure to be used as an artist's studio
with an office, which per code is not a permitted use.
ADDITIONAL INFORMATION: The applicant testified at the public hearing that he is an artist whose paintings
are displayed and sold at a gallery in New York City. The applicant's architect/representative submitted to the
Building Department architectural drawings, which included plans for a proposed accessory structure labeled
"studio", presumably for an artist. The Board defines an Artist Studio as the physical location for creating artwork
and a location for the public and/or private viewing and/or sales of same created artwork. The Board defines an

Artist Workshop as a physical location for creating artwork and expressly prohibits the public and/or private
viewing and/or sales of same created artwork.
The submitted architectural drawings also indicated an office within the proposed accessory structure. An office is
not a permitted use in an accessory structure. The Board asked the applicant to submit revised plans noting only a
workshop. Three letters of support were submitted by the applicant's agent at the Public Hearing.
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on October 21, 2010, at which time written
and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property,
and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following
findings:
1. Town Law §267-bi3}(b)(D. Granting of alternative relief for an Artist Workshop will not produce an
undesirable change in the character of the neighborhood or a detriment to nearby properties. The creation of
artwork within an accessory structure will have little or no impact to nearby properties. The structure will not be
visible from the street.
2. Town Law §267-b{3){b)(2). The benefit sought by the applicant can be achieved by some method, feasible for
the applicant to pursue, other than an area variance. The applicant can redefine the accessory structure's use as an
Artist's Workshop. The activities that would define the office, in the proposed accessory structure, may be
performed within the principal dwelling.
3. Town Law §267-bi3~(b}(3). The variance requested herein is substantial. An Artist's Studio and its related
commercial uses, for sales and as a public/private art gallery, are not permitted in a residential district. As redefined
and amended, the use of the proposed accessory structure as an artist's workshop is a permitted use.
4. Town Law $267-b(3}(b)(4}. No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
proposed accessory structure will be raised on pillars and therefore will cause no land disturbance
5. Town Law $267-b(3)(b}(5}. The difficulty has been self-created, insofar as the applicant's architect labeled the
proposed accessory structure as a studio having an office, both of which are not permitted uses.
6. Town Law §267-b. Grant of alternative relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of an Artist's Workshop in an accessory structure, while preserving and protecting
the character of the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Goehringer, and
duly carried, to
DENY, as applied for, and GRANT ALTERNATIVE RELIEF:
As shown in the architectural plans dated revised 11-02-10 prepared by Ryall Porter Sheridan Architects as pages
A001, A002, Al01.1, A301 and the survey dated June 12, 2010 prepared by John C. Ehlers, LS. Showing the
proposed accessory structure to be used as an artist's workshop
Conditions:
1. Public viewing of artwork is prohibited.
2. There shall be no commercial or private sales of artwork from the accessory structure.
3. An office is not permitted in the accessory structure.
4. No cooking or sleeping shall take place in the accessory structure
That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued.

Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by
the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals.
Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site
maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or
condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.

sole responalbilgy for any damage or injuries caused
by or during the execution of the work.

9. Plumbing and elestrical work shall be performed by
persons licensed in their trades, who shall arrange for
and obtain inspections and required sign-offs.
10. The Contractor shall do all cuffing, patching,
repairing as required to perform all of the work
indicated on the drawings, and all other work that may
be required to complete the job.
11. All piping and wiring shall be removed to a point of
concealment and shall be properly capped or plugged.
12 The Contractor upon complstion of the work, shall
arrange for Building's Department nspec ions and
signofls as required.
Demolition Notes
1. Contractor shall perform all operations of demolition
and removal indicated on the drawings and as may be
required the work. All work shall be done carefully and
neagy, in a systematic manner.
2. All exist, surfaces and equip, to remain shall be fully
pro ected from damage. Tige Contractor shall assume
full responsibility for damage and shall make repairs
required wihout additional cost to the Owner.
3. No debris shall be allowed to accumalate on the site.
Debris shall be removed by the Contractor as the job
proceeds. The site shall be left broom clean at the
completion of demolition.
4. No structural elements shall be removed unless
podions affected are adequately supported by either
temporary shoring or new structural elements as
required to protect the stability and integrity of the
existing structure,
5. The contractor shall provide adequate weather
protec on for the building and its contents during the
course of the work. All opening in any wall or root shall
be protected from all lorms of water penetration.
6. The contractor shall file all necessary Certificate of
nsurance with the Building Department, pay all fees,
obtain all permits and provide any and al/bonds
required by an agency in order to do the work herin
described.

The Board of Trustees issued a Wetland Permit for the action on July 21, 2010.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is CONSISTENT with the below Policy Standards
and therefore is CONSISTENT with the LWRP.
In the event that the action is approved, to further Policy 5: Protect and Improve Water Quality
in the Town of Southold the following is recommended.
1. Require that the proposed driveway be constructed of pervious materials.

Conservation has determined that:
The portion of the referenced property which is located landward of the line labelled "Top of
Bluff," as shown on the survey revised by John C. Ehlers on May 7, 2010, is beyond the
jurisdiction of Article 25 (Tidal Wetlands).
Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part 661) no
permit is required under the Tidal Wetlands Act. Please be advised, however, that no construction,
sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional
boundary, as'indicated above, without a permit. It is your responsibility to ensure that all necessary
precautions are taken to prevent any Sedimentation or other alteration or diSturbance to the ground
surface or vegetation within Tidal Wetlands jurisdiction which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and your project (i.e. a 15' to 20' wide construction area) or erecting a temporary fence, barrier,
or hay bale berm.
This letter shall remain valid unless site COnditions change.

All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a detemaination of consistency. *Except minor exempt actions including Building Permits

with Chapter 236 of the Town Code-Storm Water Runoff, the new sanitary system is to
be installed outside the jurisdiction of the Board of Trustees; and as depicted on the
survey prepared by John C. Ehlers Land Surveyor, last dated July 27, 2010, and
stamped approved on August 2, 2010.
IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.

That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to tkis permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.

time required to complete the work involved, but should circumstances warrant, request for

That this Permit should be retained indefinitely, or as long as the said Pennittee wishes to
maintain the structure or project involved, to provide evidence to anyone conccn~ned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.

To Members of the Zoning Board of Appeals:
Following the ZBA's comments at the Public Hearing on October 21,
2010, enclosed please find five (5) copies of Plans revised 11.02.10 for
the Pearlstein/Adams Workshop. The accessory structure's name has
been changed from "Studio" to "Workshop" to avoid any
misunderstandings about the Use, which will be used solely by the
owner/artist for making his own work, as conforming to Zoning, and will
not be used for art shows, exhibitions, or other commercial activities
within this residential Brown's Hills community.
At the October 11 Hearing, I raised a question of the wood platform at
grade to replace the existing (now removed) deck at the existing house
(see Plan 002). Even though the replacement of this deck was approved
by the Building Department and the deck was partially removed as per
the approved plans, Buildings Inspector Gillen made a site visit on
September 17, where he wrote a Violation and Stop Work Order and
called the Southold Police.
The Stop Work Order initially applied to all work on the project, and was
re-written on September 20 to apply only to the wood deck. The revised
Violation says that no work can be done until approval is given by the
ZBA,the Trustees. Please see attached Violation. Could you please

advise me what should be done to resolve the issue, and which rules
apply.
Enclosed please find also the two final Post Office receipts of notice to
the neighbors. You have already received letters of support from all
three neighboring property owners.

We are immediate neighbors of the property owned by Bill Adams and Alix Pearlstein in the
Brown's Hills neighborhood of Orient.
We are writing to support their application for an artist's studio to be built on their property.
Orient has a long and storied history of supporting artists and their works. So it seems
particularly fitting to have two new artists joining our community. Being able to work in this
setting provides the kind of inspiration and stimulation any artist can benefit from. A
properly sized studio space is something we are happy to endorse as a positive addition to
our community.
The proposed studio is not in sight of any of the surrounding neighbors nor is it visible from
the road. The setting is at the southern end of the property and poses no ecological
problems for the fragile bluff to the north.
We are happy to support the construction of this studio on Brown's Hills Road.

Please find enclosed a copy of the Legal Notice describing your recent application. The Notice
will be published in the next issue of the Times Review newspaper.
1) Before October 8th:
Please send the enclosed Legal Notice, with both a Cover Letter including your telephone
number and a copy of your Survey or Site Plan (filed with this application) which shows the
new construction area or other request, by CERTIFIED MAIL, RETURN RECEIPT
REQUESTED, to all owners of property (tax map with property numbers enclosed), vacant or
improved, which abuts and any property which is across from any public or private street.
Use the current owner name and addresses shown on the assessment rolls maintained by the
Town Assessors' Office located at Southold Town Hall, or Real Property Office at the County
Center, Riverhead. If you know of another address for a neighbor, you may want to send the
notice to that address as well. If any letter is returned to you undeliverable, you are requested
to make other attempts to obtain a mailing address or to deliver the letter to the current owner,
to the best of your ability, and to confirm how arranqements were made in either a written
statement, or during the hearing, providing the returned letter to us as soon as possible;
AND not later than October 15th: Please either mail or deliver to our office your Affidavit of
Mailing (form enclosed) with parcel numbers, names and addresses noted, and furnish to
our office with the green/white receipts postmarked by the Post Office. When the green
signature cards are returned to you later by the Post Office, please mail or deliver them to us
before the scheduled hearing. If any envelope is returned "undeliverable", please advise
this office as soon as possible. If any signature card is not returned, please advise the
Board during the hearing and provide the card (when available). These will be kept in the
permanent record as proof of all Notices.
2) Not Later October 16st: Please make arrangements to place the enclosed Poster on a
signboard such as cardboard, plywood or other material, posting it at your property for seven
