SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated September 30, 2010, stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP: This application was referred for reviewed under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued his reply dated October 13, 2010; based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: Subject property is a conforming 74,146 sq. fi. lot improved with a two story single-family dwelling. It has 124.42 feet of frontage on North View Dr., 430.74 feet along the western property line, 258.75 feet on Long Island Sound and 374.63 feet along the eastern property line as shown on the survey dated June 12, 2010 prepared by John C. Ehlers, LS. BASIS OF APPLICATION: Request for Variance from Article Ill, Code Section 280-13C, based on an application for building permit and the Building Inspector's September 13, 2010 Notice of Disapproval, concerning construction of an accessory structure; proposed construction of an art studio is not a permitted use. RELIEF REQUESTED: The applicant proposes to construct an accessory structure to be used as an artist's studio with an office, which per code is not a permitted use. ADDITIONAL INFORMATION: The applicant testified at the public hearing that he is an artist whose paintings are displayed and sold at a gallery in New York City. The applicant's architect/representative submitted to the Building Department architectural drawings, which included plans for a proposed accessory structure labeled "studio", presumably for an artist. The Board defines an Artist Studio as the physical location for creating artwork and a location for the public and/or private viewing and/or sales of same created artwork. The Board defines an Page 2 - November 16, 2010 ZBA File#6424 - Adams CTM: 1000-13-1-2 Artist Workshop as a physical location for creating artwork and expressly prohibits the public and/or private viewing and/or sales of same created artwork. The submitted architectural drawings also indicated an office within the proposed accessory structure. An office is not a permitted use in an accessory structure. The Board asked the applicant to submit revised plans noting only a workshop. Three letters of support were submitted by the applicant's agent at the Public Hearing. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 21, 2010, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-bi3}(b)(D. Granting of alternative relief for an Artist Workshop will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The creation of artwork within an accessory structure will have little or no impact to nearby properties. The structure will not be visible from the street. 2. Town Law §267-b{3){b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant can redefine the accessory structure's use as an Artist's Workshop. The activities that would define the office, in the proposed accessory structure, may be performed within the principal dwelling. 3. Town Law §267-bi3~(b}(3). The variance requested herein is substantial. An Artist's Studio and its related commercial uses, for sales and as a public/private art gallery, are not permitted in a residential district. As redefined and amended, the use of the proposed accessory structure as an artist's workshop is a permitted use. 4. Town Law $267-b(3}(b)(4}. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The proposed accessory structure will be raised on pillars and therefore will cause no land disturbance 5. Town Law $267-b(3)(b}(5}. The difficulty has been self-created, insofar as the applicant's architect labeled the proposed accessory structure as a studio having an office, both of which are not permitted uses. 6. Town Law §267-b. Grant of alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an Artist's Workshop in an accessory structure, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Goehringer, and duly carried, to DENY, as applied for, and GRANT ALTERNATIVE RELIEF: As shown in the architectural plans dated revised 11-02-10 prepared by Ryall Porter Sheridan Architects as pages A001, A002, Al01.1, A301 and the survey dated June 12, 2010 prepared by John C. Ehlers, LS. Showing the proposed accessory structure to be used as an artist's workshop Conditions: 1. Public viewing of artwork is prohibited. 2. There shall be no commercial or private sales of artwork from the accessory structure. 3. An office is not permitted in the accessory structure. 4. No cooking or sleeping shall take place in the accessory structure That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Page 3 - November 16, 2010 ZBA Fde#6424 - Adams CTM: 1000-13-1-2 Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Demolition Notes 1. Contractor shall perform all operations of demolition and removal indicated on the drawings and as may be required the work.
