(adj.to Darby's Cove), Fishers Island,NY CTM 1000-10-4-12.3 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated May 14, 2010 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP: This application was referred for reviewed under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued his reply dated July 26, 2010, based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The Applicant's property is an 11,278 sq. ft. non-conforming waterfront parcel in the R-40 District. The northerly lot line measures 117+/- feet along adjacent residential property. The Easterly lot line measures 100+/- feet along a salt water bay known as Darby's Cove. The Southerly lot line measures 104+/-feet along adjacent residential property, and the Westerly lot line measures 100 +/- feet along a private right of way. The property is improved with two [2] existing seasonal single family dwellings, two [2] accessory sheds, and two [2] docks which provide watercraft access to Darby's Cove. The existing improvements and the Applicant's proposed improvements, including an "as built" shed, are shown on the site survey prepared by CME Associates Engineering, Land Surveying& Architecture, PLLC, and dated May 2, 2009. BASIS OF APPLICATION: Request for Variances from Code Sections 280 Code Sections 280-122A and 280- 124, based on an application for building permit and the Building Inspector's March 18, 2010 Notice of Disapproval, Amended July 20, 2010, concerning additions to one of two existing seasonal dwellings, 1) proposed addition is not permitted, it shall create new nonconformance or increase the degree of nonconformance, 2) lot coverage at more than the code required maximum of 20%. The proposed new lot coverage is 21.6%. In addition,the"as built" 12ft.x8ft. shed is not permitted pursuant to 280-15[F] which permits a front yard location on waterfront parcels with a front yard principal setback. The existing shed is setback 5+/- feet when 35 feet is required. Page 2—November 16,2010 ZBA File96393-McNamara CTM: 1000-104-12.3 RELIEF REQUESTED: The applicant originally requested the variance relief necessary to create new nonconformance and increase the degree of nonconformance, by proposing to construct additions to one of two existing seasonal residential dwellings on the property. The proposed new construction included a 14.5 ft. x 8 ft. bedroom addition and a proposed 20.5 ft x 8 ft enclosed porch which would increase the lot coverage to 21.6% where the code allows a maximum of 20% lot coverage. Further, the Applicant is requesting a 5+/- front yard setback for an existing an"as built" shed where the code requires 35 feet. AMENDED APPLICATION: During the July 29, 2010 hearing, the applicant was asked to bring the site plan into more conformity with the Code and to address the concerns noted in a neighbor's letter dated July 22, 2010. The Applicant subsequently submitted a letter dated Oct. 4, 2010, stating their intention to not pursue a variance for construction of additions but to only pursue the variance relief for the existing shed. The Applicant appeared at the continuation of the Public Hearing held on Oct. 21, 2010, and formally withdrew the request for any and all variance relief with regard to the proposed additions, which the Applicant had decided not to construct. The Applicant retained the request for variance relief with regard to the location of the "as built" shed with a non- conforming 5 foot front yard setback, therefore bringing the revised site plan into more conformity with the code. ADDITIONAL INFORMATION: An adjacent neighbor submitted a letter dated July 22, 2010 which stated their objections to the Applicant's proposed new construction. At the Public Hearing held on Oct. 21, 2010, the Applicant told the ZBA that because of a change in the family members situation they no longer needed to construct the proposed additions. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 29,2010, and continued the public hearing on Oct. 21, 2010, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance for the 5 foot front yard setback for the "as built" shed will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The shed is located adjacent to a dead end private right of way utilized by the Applicant and several neighbors. It is well screened from public view by natural vegetation 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Considering the sloping terrain on the property, the small size of the parcel, the location of the other structures, and the close proximity to the driveway, the Applicant needed to situate the shed within a very confined area, and therefore with such a non-conforming front yard setback in relation to the private right of way. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is substantial, and is an 85+% reduction from the code required 35 foot setback. However, due to the topography and existing setback of the houses to the water,the current location of the shed which is landward of the existing houses causes the least impact on the cove: 4. Town Law 4267-W)M(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The shed is screened from the private right of way by landscape plantings and natural vegetation. The private right of way has limited use by a small number of residents. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created since the Applicant built the shed without applying for a building permit or a variance for the reduced setback prior to the construction. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an "as built" shed with a nonconforming front yard setback, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Dinizio, seconded by Member Weisman (Chairperson), and duly carried, to GRANT, the variance for the as built shed (ONLY)as applied for, and shown on the site survey prepared by CME Associates Engineering, Land Surveying&Architecture, PLLC, and dated May 2,2009. Conditions: The shed shall be used for storage only. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps,are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code,other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. TOWN OF SOUTHOLD Thank you for the recently returned request for a building permit with a list of deficiencies and observations. We realized that the proposed addition and porch would require a variance due to the road setback requirement and the lot coverage regulations. It was our intention to receive a letter of disapproval for these problems so that we could seek a variance before having the complete set of plans drawn up. We plan to remove a second story balcony and would like to replace part of the present deck with an enclosed porch.The proposed porch and addition are the minimum area that would provide added living space needed due to an aging family member coming to stay with us.The porch would provide an enclosed sitting area with a water view.The addition will provide an area for viewing a television and additional floor space upstairs to make the smaller bedroom usable by an older person. ere does not appear to be a viable alternative to the sites selected. Currently,the house at its closest, sits 56.7 feet from the tidal wetlands.The proposed porch would be 48.6 feet from the wetland; the addition on the side of the house would be 56.7 feet from the wetlands.The existinlot coverage is 20.5 % of the total lot area and the proposed additions would bring that to CME Associates Engineering, Land Surveying and Architecture provided all these figures.As a consequence,we have.applied to the Board of Trustees and have received tentative approval pending an inspection. An application for a NYDEC permit has been submitted and a variance is being requested from lot coverage and wetland setback regulations. The elevations have been added to the construction drawings.The flood zones are listed as NOTE 10 on the survey. I feel he might have forgotten the two bedrooms and additional bath that he had added. The concerns about the septic system are groundless.No plumbing work will be done and the capacity for occupancy is not being changed. His calculations of a 400 sq ft total are simply erroneous. His additional points... 1. The septic system is not part of the permitting process as no plumbing work or changes are being done. 2. The work done by my brother,the owner of Skyline Custom Carpentry,on his cottage,was not septic related. 3. Hydrology? 4. 1 couldn't understand the"less seasonal' concept.Houses without heat or water in the winter are seasonal. 5. The sheds are considered in the calculation by the surveyor. 6. The deck and balcony were on the plans submitted to the Town when the permit for the work was issued in 1982 and existed when the CO was issued. 7. I would like to state again that my wife and I (the aging family members in our home) continue to live with the same space constraints in our home on Fishers Island with a growing family and grandchildren as the McNamara family. We however must error on the side of the Building Department's judgement dated March 18, 2010 denying their application for permit. We agree with the Building Department that adding to the non-conformity and over building that has occurred on lot 67 & 68 (viewed as one tax parcel) would have a negative impact overall. By my calculation the proposed additions total nearly 400 sq ft (not the 280 sq. ft listed on the permit by applicant) which is substantial to the scale of the current dwelling, this increases the already non-conforming buildings to a degree that is worrying in terms of capacity and infrastructure. (ie: Septic system) The welfare of Darbies Cove and the environment is of utmost concern for our generation and the many already living with us! Additionally, we have concerns regarding the non-conformance and infrastructure of the existing dwellings (2 houses and 2 sheds) on lot 67&68. 1. There was no Septic map/plan provided to us or in the materials submitted for permitting, who will review the current status and capacity of this system? Or has this been done as part of the permitting process and not provided to us? 2. Was the work done on July 17 & 18`h by Skyline Construction on the front of lot 68 in fact septic related digging and replacement? 3. The above begs the question of what is the Ground Water table for this location? 4. What is the term "seasonal" defined as in terms of Southold's Building & Zoning Board? As plans submitted appear to make the "cottage" less seasonal. 5. Are non-inhabitable sheds on property (2 on lots 67 & 68) considered in the proposed lot coverage ratio? As one is quite large. 6. Is the current deck and balcony discussed in application and plans (reduction of deck and balcony removal) in fact a Lot 67 or 68 permitted structure?And does this count in lot coverage ration? 7. I find the $21,000 estimated cost of nearly 400 sq. ft of building on Fishers Island indicates that the applicant will not be using a contractor?
