Box 1179 Southold, New York 11971 Dear Town Trustees: In response to your letter of November 28, 2006, attached, I would like to point out that the wood decking on the walkway was removed in preparation for the installation of an entire new structure. This action was taken, when I was advised by your office to proceed with whatever repairs were required. The advice and the following action of removing the old decking has resulted in an unfair and inappropriate resolution in my case, since the absence of the decking is the principal reason that you are denying me the right to continue the repairs I staded. Please reconsider this matter, applying for a Wetland Permit will be costly, time consuming, and in my thinking unjustified with the "grandfather-rights" that prevail. When the property was purchased by me, its cost covered the value of the wooden walkway, ramp, and float which were in existence and approved by the Town Trustees. Aside from maintenance and repair expenses, why should I be required to bear the additional costs in starting from scratch with another Wetland Permit? As stated in my letter of November 8, 2006, in the process of making repairs, I am willing to upgrade the wooden walkway to meet present day requirements. Yours truly, Frank F. Box 728 Southold, NY 11971 Dear Town Trustees: This chronological report encompasses grandfather clauses for the erection of a wood walkway, ramp and floats for my property at Stillwater Avenue, Cutchogue, NY and my repairs, use and activities at this location: - June 28, 1972, Wetlands Permit No. 4 was issued to Russell Allan Stassen for the erection of a 200' x 2' wood walkway across the wetland, 2 ft. above high water. - September 12, 1972, Permit No. 758 was issued to Russell A. Stassen to place two floating docks, each 3' x 10', at this site. - September 28, 1984, Permit No. 1884 issued to Russell A. Stassen for a dock at East Creek. Hurricane Gloria in 1985 devasted the walkway, ramp and floats at my property, just a few months after it was bought from Russell A. Stassen. The ramp and floats disappeared. Despite many searches, they were not found. November 4, 1987, The Board of Trustees determined that I would be allowed to replace the floats and to repair the walkway and ramp. The walkway was repaired fully, but I held up on replacing the ramp and floats, still hoping to find them or to obtain used floats at a reduced cost. Meanwhile, I applied for and was granted a mooring site for my 22' sailboat on Eugene Creek for several years by the Town. I used an inflatible dingy to get from my property to the sailboat, a distance of approximately 200'.--so-6- ~'e",-¢~ ~ ~ ,~".- My sailboat was then loaned to my daughter and son-in-law for about five years, and it was located on Aresconk Creek in Center Moriches, NY, the site of their home. The loan was made to them because of health prob- lems - on three occassions, suspected head attacks kept me in ICU's. It was finally determined that I needed a new heart valve. The aoda valve was replaced at St. Frances Hospital. After a long needed dredging of the inlet at Cedar Beach, I was able to bring my sailboat to Dryad's Basin at my Southold waterfront home for local use. I kept the sailboat at this location fo about five years, but the inlet began to shoal slowly, and ~ have had to keep my sailboat out of the water for about five years. Although, physically fit, I couldn't sail from my home. In May of last year, I went to the Trustee's office to ascertain what was needed to enable me to repair the walkway at my facility at Cutchogue. What I had in mind was to moor my sailboat on Eugene Creek again. I was told by the woman I contacted, that the Repair Permit that I possessed in the past was authorization to proceed with any repairs. I went to the site at Stillwater Ave., Cutchogue, and I noted that about 25% of the walkway decking material was gone (did someone need firewood?). I personally removed whatever remained of the decking and their supports so that an entire new deck could be installed - A quantity of 2 x 6's and 4 x 4's have been located at this site to make these repairs. At this point, the Trustee's Office has asked me to stop proceedings. To go through the procedures for a new permit will be time consuming and expensive for me. I recognize that rulings for walkways over the wet- lands have changed. Whereas, a two foot height was observed when the walkway was originally erected, I believe it is now 3 1/2' high. I will be glad to meet the present requirements for the walkways in my repairs. But please, with grandfathered rights, do not require me to apply for a new permit. I am a senior citizen who is two months shy of 90 years old. I would like to have some sailing fun in the remaining years on this earth.
