Planitzer Property Location: South Side of Ocean View Avenue, Fishers Island CTM 9-11-3.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review fails under the Type I! category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: The property consists of 2.32 acres with direct frontage along Ocean View Avenue, as shown on the September 10, 2007 Site Plan prepared by CME Associates for the applicant. The premises is improved with a single-family dwelling, which dwelling is undergoing construction involving renovations and additions on the first and second floors (B.P. #33485-Z issued 10/23/07 and amended during December 2007). BASIS OF APPLICATION: Zoning Code Section 280-14, based on the Building Inspector's October 30, 2007 Notice of Disapproval concerning proposed alterations to an existing third- story living area in a single-family dwelling, for the reason that the Code limits construction to 2% stories in height. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning reply dated December 10, 2007, states that the application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on January 24, 2008, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Section 280-14 of the Zoning Code that limits the number of stories of a single-fmnily dwelling to two and one half, for the proposed renovation Page 2 - February 7, 2008 ZBA # 6112 - R. Planitzer CTM 9-1173.1 and alterations to the existing third floor (existing with a 20 foot by 20 foot master bedroom and bath with dormers). The third story will be reduced in scope by removal of dormers, and the proposed renovations and alterations will be in the same footprint and not change the use of the third floor area as a master bedroom and bathroom. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because the house has existed in its present form since 1973 when it was built in conformity to a building permit issued by the Southold Town Building Department which, upon completion of construction issued a Certificate of Occupancy that has, and still remains at this time, in force. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant wishes to continue the use of the third story of the house with some alterations to the outside of the structure. These alterations will decrease the degree of nonconforming by eliminating the dormer. 3. The variance granted herein is not substantial. In fact after construction, the nonconformity will actually be less. 4. The difficulty has not been self-created. The original house was built relying on a legal building permit issued by the Southold Town Building Department. The difficulty has been created by an administrative change in the definition of the legality of a third story of this house. 5. There has been no evidence submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an existing master bedroom and bathroom after alterations which will eliminate the dormer, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. The prindpal work with the current project was to replace all of the exterior finishes and windows on the house. We have installed hurricane-rated windows, Iow-maintenance stucco and standing seam roof. The majodty of the house has been left otherwise intact. We submitted for a building permit in Sept. 2007 and received it in Oct. 2007. That work induded: 1. Replace all extedor finish materials and windows. 2. Add a one-story, 425 sf addition to the back of the house. 3. Add a one-story, 77 sf extension to the existing kitchen. 4. Divide a two-story space into two separate rooms. 5. Cosmetic renovations, but otherwise leave the rest intact. There was no requirement from the building department that a sprinkler system would have to be installed at this time. Some time after construction was underway, the owners decided that they wanted to remove the existing dormers on the third floor. We advised that this would require a zoning variance. The maximum number of stories allowed by the zoning ordinance is 2.5, and any work to the non-conforming third floor-- regardless if it decreases the non-conformity, which would be the case here--had to be approved by the Zoning Board of Appeals. The owners wanted to proceed anyway, and because of the lengthy and costly process decided to include the interior renovation of the third floor in the variance as well. The third floor is 20' x 20', essentially one open space. The ZBA approved the variance for this work in February 2008. We submitted for a building permit and were given an amendment to the original permit in March 2008 to include the third floor. At this time, we were advised by the building department that a sprinkler system was required, and a note to that effect was added to the third floor plan of the 2008 permit amendment drawings before the amendment was granted. And herein lies the confusion. When it came time to install the sprinkler system, it was assumed by everyone involved that the sprinkler system was only required for the third floor and egress, and that's the system that was installed. This assumption was made for the following reasons: Even though the existing house had a finished third floor, we were not required to install a sprinkler system as a condition of the 2007 permit. We assumed this was the case because we weren't doing any work to the third floor. Why, then, would we have to sprinkler the entire building when we received the permit amendment for the third floor work when the only substantive work to the third floor was a decrease in the non-conformity by removing dormers? The third floor was existing and CO'd since 1978. It was our interpretation of the code at the time that "additions, alterations or repairs to any structure shall conform to that required for a new structure without requiring the existing structure to comply with all the requirements of this code..." The third floor is what makes the house non-conforming. It was our interpretation, and it made sense in this case, that we were required to bring the non-conforming part of the building up to code without bringing the entire building up to code. The local inspector and fire chief walked through for the rough plumbing inspection and inspected the system. No red flags were raised. The construction of the house is now completely finished. The petitioner is seeking relief from: 19 NYCRR Part 1220, The 2007 Residential Code of New York State, Section R3i3.3, which requires that buildings having a height of three stories shall be equipped throughout with an automatic sprinkler system installed in accordance with NFPA 13D. [The petitioner requests a building having a height of three stories that is not equipped throughout with an automatic sprinkler system.] FINDINGS OF FACT 1. The building that is the subject of this petition is a one-family dwelling. 2. The building was originally constructed in 1978 with a small third story of approximately 1,400 square feet, containing a bedroom and a bathroom. The third story is not in an attic area. Although the State Building Construction Code, in effect at the time of construction, limited a one-family dwelling of Type 5 construction to a height of two stories above a basement or cellar, or above finished grade where there is no basement or cellar [Section A204(613)a], the building incorrectly received a certificate of occupancy with the third story. There w&re dormers on the third story that were retn~)ved, and that space was reconfigured. A variance was required from the Zoning Board of Appeals of the Town of Southold for the work on the {hird story because the building height within the town is limited to two-and-a-half stories. When the zoning board variance was approved, the building permit for the renovations was modified. At that time, the Building Department of the Town of Southold informed the petitioner that an automatic sprinkler system would be required. However, the petitioner was under the assumption that the sprinkler system would only be required for the third story and the path of egress to the exterior, when, in fact, it was required throughout the building. At this time, the limited area sprinkler system has been installed. The building has a Code-complying stairway to the third story. The petitioner has stated that because the building is already constructed, installing a Code- complying automatic sprinkler system throughout the entire building would be both physically and economically impractical. The petitioner has proposed that the installed limited area automatic sprinkler system will cover the entire third story and the path of egress down to an exit at grade on the first story. Appendix J Section AJ604.3 of the current Residential Code of New York State stipulates that a third story above grade may be created in an existing attic without requiring the installation of a sprinkler system throughout the entire dwelling, provided all of the following conditions are met: 1. The building was legally occupied before January 1, 1984. 2. The finished space and its means of egress to the exterior are equipped with a limited ~ . area sprinkler system installed in accordance with NFPA 13D. /, 3. The finished Space is provided with: 3.1 A second exit stair meeting the requirements of §RR311.5, or 3.2 An emergency escape and rescue opening, meeting the requirements of Section R310, located directly above a roof or other structural appurtenance from which access to grade does not exceed a vertical distance of 14 feet. 4. The entire dwelling is equipped with smoke alarms in compliance with Section R313 and monitored by an approved supervising station in accordance with NFPA 72. The petitioner has proposed that the building will be equipped with smoke alarms in compliance with Section R313, and monitored by an approved central station supervisory service in Petition No. 2010-0253 Page 3 accordance with NFPA 72. 12. The petitioner has proposed that an emergency escape rescue opening, meeting the requirements of Section R310, located directly above a roof or other structural appurtenance from which access to grade does not exceed 14 feet, will be provided. 13. The subject building was occupied before January 1, 1984. Although the third story is not within an attic, the proposed third story would meet all of the criteria in the current requirements found in Appendix J Section AJ604.3 of the current Residential Code of New York State. CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would entail practical difficulties or unnecessary hardship, and would be unnecessary in light of alternatives which ensure the achievement of the code's intended objective or in light of alternatives which, without a loss in the level of safety, achieve the code's intended objective more efficiently, effectively, or economically. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 19 NYCRR Part 1221, Section R313.3, be and is hereby GRANTED. Furthermore, it should be noted that the decision of this Board is limited to the specific building and application before it, as contained within the petition, and should not be interpreted to give implied approval of any general plans or specifications presented in support of this application.
