The meeting began at 7:07 p.m. with four LPC members present. Adoption of Meeting Minutes: ?? ACCEPTANCE OF MEETING MINUTES FROM OCTOBER 12, 2010 ?? MOTION made by Ray Huntington, seconded by Eric Keil, to accept the October 12, 2010 LPC meeting minutes, as amended by John Sepenoski. Motion carried: 5/0 Land Preservation Applications and Inquiries: ?? SCTM #1000-107-10-10.1 (Girards) Review landowner’s revised offer of Development Rights Easement as part of Conservation Subdivision [executive session re: discussion of purchase offer] Town Board SEQRA & Elect to Purchase Resolution was withdrawn by Town Board at their meeting held on October 19, 2010. Mr. Girards (landowner) has decided to amend his application to the LPC for the sale of an 8± acre development rights with 2± reserve area, to apply for an 80/60 conservation subdivision with two residential building lots that will need to go before the Planning Board for approval. This revised plan will require setting aside approximately1.65 acres for subdivisionopen space resulting from the clustered lots in the conservation subdivision. The ±8 acre easement area will include the ±1.65 acres subdivision open space.The LPC members were not in favor of the proposed plan as proposed lots are not contiguous, and result in segmentation of preserved lands and create a residential lot adjacent to existing preserve land.LPC did not find plan acceptable. LPC decided to review with Town Board. MOTION, made by John Sepenoski, as amended by Ray Huntington, and seconded by Maureen Cullinane, that after discussion, the Land Preservation Committee is not in favor to proceed with Girards’ lot design presented to them on October 26, 2010, but because of history of this project, LPC to request discussion with Town Board by committee liaison, Albert Krupski, Jr, (Town Councilman) to instruct Committee on how to proceed. Motion carried: 5/0. ?? SCTM #1000-52-5-60.2 (Yaxa) Field Inspection report and review of PDR application John Sepenoski, Maureen Cullinane, Ray Huntington, Lillian Ball, Melissa Spiro and Melanie Doroski were present at a field inspection on October 20, 2010, as conducted by property owner, Dean Yaxa. Parcel is irregularly shaped leading from the intersection of Colony Drive and Albertson Lane to the marshlands and Arshamomaque Pond. There is a residential home, chicken/turkey coops, barns, and horse pastures (horses boarded and riding lessons provided by Mary Mulcahey). The property lies between two parcels: one recently sold that is an approved subdivision, and the other that is seeking subdivision approval, leaving a potentially preserved parcel lying between to potential subdivisions. LPC instructed Melissa to find out what landowner is hoping to achieve by selling development rights easement. LPC is willing to review the application again if the landowner would proceed with a bargain sale. ?? SCTM #1000-55-2-10.1 (Moffat/Wolfe) Update re: status LPC offer, and extension of offer, has expired. Tom McCarthy, real estate broker representing landowners, is in touch with Melissa Spiro on a regular basis and has informed Melissa that offer is still under consideration and they are waiting for the completion of a property survey and are exploring the creation of one additional lot. Addition to Agenda: ?? SCTM #1000-45-5-3 & 5.4 (Sill) Update re: status Randy Parsons, The Nature Conservancy, is working with landowner’s relatives to bring about sale of property to Town. He is working on securing an Option to Buy Agreement between landowner and The Nature Conservancy, if Town will be willing to then buy property from TNC at the appraised nd value. Still waiting for 2 appraisal of waterfront accessed via LIRR crossing to be completed. LPC discussed future use of existing residential dwelling. LPC would not recommend that Town keep house for any purpose. Applications & Inquiries for Uses or Structures on Preserved Property: ?? BITTNER GRADING AND PLANTING PLAN Maureen reported on her conversation with James Richter, in the office of the Town Engineer, regarding regrading and restoring the contour of the dune line and face above high tide line to conform with the existing elevations east and west of the area disturbed by house and bulkhead removal. Jamie felt that the grading existing at this time was appropriate; whereas the Committee members do not. The LPC would like to see the grade matched to the existing beach and dune adjacent to the area where bulkhead was removed in accordance with Special Conditions (page 2 or 4) of the DEC permit. MOTION made by John Sepenoski, seconded by Lillian Ball, to request by memo to the Southold Town Board, that the Southold Town Board take necessary steps to implement the grading plan prepared by Maureen Cullinane for the Bittner Property. Motion carried: 5/0 Stewardship and Management: ?? BITTNER UPDATE OF TASK LIST / WORK John Sepenoski reported on Bittner Task List and memo Melissa received from Jim McMahon (DPW) in work that has been completed. Some debris has been removed but more remains and John and Lillian are willing to volunteer their time and service to compiling debris if DPW will remove from roadside disposal areas that they establish. Lillian reported that she discovered a large number of mushroom species (both poisonous and non- poisonous) that are growing on the Bittner property. ?? FARMLAND BOND POLICY Ray Huntington opened discussion as he felt that while the draft clarifies legal obligations, the process is cumbersome and therefore costly to operate and does not strategize the timing of sales/ownership.Other members found the documentacceptable as revised and amended as areas of LPC concern discussed at last meeting had been addressed to their satisfaction. This 10/13/2010 revised version will be presented for approval at November 4, 2010 Town Board meeting. ?? AG PDD INQUIRY During Melissa’s recent attendance at an Agricultural Advisory Meeting, a landowner showed interest in the AG PDD. Melissa advised LPC that they would need to refresh their knowledge of the AG PDD and implement groundwork for 2011. ?? EASEMENT LANGUAGE AND DEFINITIONS Ray Huntington reported on his progress defining “Agricultural Production” on preserved lands. He presented one pink and one yellow paged worksheet listing activities and uses on preserved land and asked that the committee complete the worksheets with their input and return them to Melanie. Findings will be discussed at next LPC meetings. Melanie was instructed to send worksheets with instructions to absent members, Chris Baiz and Monica Harbes. Informational: ??
