TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the dght to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.

ALL that certain plot, piece or parcel of land, situate, lying and being a part of the
Oyster Point Condominium, Town of Southold, County of Suffolk and State of
New York, known and designated therein as Home Unit Number 9 together with
a 1/34th undivided interest in the common elements of the said condominium
hereinafter described as the same is defined in the Declaration of Condominium
hereinafter referred to. The real property above described is a home unit shown
on the plans of the Oyster Point Condominium prepared and certified by Nelson
and Pope, filed in the Office of the Clerk of the County of Suffolk on the 10th day
of November, 1986 as Condominium Plan Number 146, defined in the
Declaration of Condominium entitled, "Oyster Point Condominium, made by
Oyster Point Associates", under Article 9-B of the New York Real Property Law
dated October 8, 1986 and recorded on the 10th day of November, 1986 in Liber
10164 of Conveyances at Page 431, covering the property therein described.
The home unit being conveyed is also designated as Unit Number 9 in Building
B. The land area for the Oyster Point Condominum property is described as

BEGINNING at a monument on the easterly side of Fifth Street, said point being
distant, 250 feet southerly as measured along the easterly side of Fifth Street
from the corner formed by the intersection of the easterly side of Fifth Street and
the southerly side of Clark Street;
RUNNING THENCE from said monument, south 82 degrees 41 minutes 10
seconds east along land now or formerly of Satkoski, 166.15 feet to a monument
and land formerly of Lynch and now or formerly of E. Birenbaurh and M.J.
Roman;
THENCE along the last mentioned land, the following two courses and distances:
