WITNESSETH, that the party of the first part, in consideration ofTEN ($10.00) dollars,
lawful money of the United States paid by the party of the second part, does hereby grant and release unto
the party of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being at Cutchogue, Town of Southold, County of Suffolk and State of New York and
known and designated as "Fisherman" Beach, Lot No. Ten (10), and part of Lot No. Nine (9), as shown on
Map entitled, "Sub-division Map of Peconic Bay Properties, Inc., surveyed February 6, 1931 by Otto W.
Van Tuyl, Surveyor, filed April 15, 1931 in the Suffolk County Clerk's Office as Map No. 786 of Maps,
which said lot and part of lot when taken together are more particularly bounded and described as follows:
BEGINNING at a point on the southwesterly side of Haywaters Road (private) at the point where said
southwesterly side of Haywaters Road is intersected by the division line between Lots 9 and 10 on the
above map; which said point is distant 585 feet northwesterly from the comer formed by the intersection of
the southwesterly side of Haywaters Road with the northwesterly side of Landing Road; running thence
along said last mentioned division line South 31 degrees 55 minutes 20 seconds West 73 feet; thence South
58 degrees 04 minutes 40 seconds East 10 feet; thence South 35 degrees 49 minutes 30 seconds West 40
feet; thence North 58 degrees 04 minutes 40 seconds West 7.28 feet to the said last mentioned division line;
thence South 31 degrees 55 minutes 20 seconds West 117.10 feet to the shores of Cutchogue Harbor;
thence northwesterly along the shores of Cutchogue Harbor to the division line between lots 10 and 11 on
the above map; thence North 35 degrees 11 minutes 20 seconds East along said last mentioned division
line, 222 feet to the southwesterly side of Haywaters Road; thence South 54 degrees 50 minutes 10 seconds
East along the southwesterly side of Haywaters Road 65 feet to the point or place of BEGINNING.
TOGETHER WITH all the right, title and interest of the party of the first part of, in and to the lands under
water known as Cutchogue Harbor in front of and adjacent to the above-described premises.
SUBJECT TO covenants, restrictions and easements of record affecting said premises.
BEING AND INTENDED TO BE the same premises conveyed to the Grantor by deed dated June 14,
1967 which deed was recorded in the Office of the Clerk of the County of Suffolk in Liber 6172 at
page 182.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said
premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement, and
wilt apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first
above written.
