Construction standards require that adequate expansion area for the sanitary system be available. The site lacks area for future expansion. Findings and Facts 1. Parcel is 0.27 acre located in Groundwater Management Zone 4. 2. The yield at density is 162 gallons per day (gpd). 3. The project consists of conversion of the second story of an existing dry retail store from storage to non-medical office space. 4. Proposed design flow is 515 gpd. The proposed design (sanitary) flow is 318% of the allowable flow. 5. This site is legally occupied by dry retail stores. The "grandfathered" design flow from the existing use is 459 gpd. 6. If the project design sanitary flow rate exceeds the population density equivalent, a community sewerage system or on-lot sewage treatment system as applicable is required except where the project design sewage flow. The application exceeds the allowable sewage flow by 215 gpd and the "grandfathered" sanitary flow by 54 gpd. 7. Sewage disposal will be by septic tank and leaching pools. The applicant is proposing to replace the existing sewage disposal system consisting of single cesspools in two different locations, one of which is shown on the submitted plans to be partially outside the property boundaries. The proposed replacement will consist of a 1,200 gallon septic tank and two 10-foot (D by 9 feet effective depth David G. The leaching pool bottoms will be placed two feet above highest expected groundwater. 8. Department standards require area to be set aside for 50% future expansion of the leaching area, or area for one future leaching pool. Due to the small lot size and existing structures, a suitable expansion area is not available. Based upon the proposed sewage flow of 515 gpd, standards require 343 square feet (so of side wall leaching area to be provided. 9. The applicant is proposing to provide two leaching pools with a total of 544 sf of side wall leaching area (159% of the required leaching area). 10. Soil conditions are good with fine to medium sand encountered at 3 feet below existing grade. 11. Depth to groundwater is approximately 14 feet below existing grade. 12. Water service will be public water supplied by Suffolk County Water Authority. 13. The current building occupancy is a hardware store occupying 7,830 sf with 2,797 sf of storage in both the cellar and the second floor. The second floor storage is proposed to be converted to offices. The hardware store and other storage will remain. 14. The parcel consists of three separate tax lots on the 1981 tax map that have since been merged. Determination It was a 3 to 0 determination of the Board to grant the request for the variance to install the sewage disposal system as proposed and convert the storage space to offices, provided the following conditions are met: • The applicant shall covenant the property, in language acceptable to the County Attorney that the sanitary flow from the building shall be limited to the proposed design flow of 515 gpd and that offices shall be for non-medical uses only. • The existing cesspools shall be abandoned and removed to the satisfaction of the department. The system will be constructed to allow proper routine maintenance of the sewage system and has expansion designed into it. Unlike a residential dwelling, this occupancy can be temporarily vacated if required for future maintenance of the sewage disposal system. The 54 gpd increase in sanitary sewage flow is more than compensated for by removal of + David G. Additionally, the previous lots could have supported two separate buildings, each of which could have requested 300 gpd of design flow. Therefore, granting the variance will not have any adverse effect on groundwater. As per §760-609 of the Suffolk County Sanitary Code (Sanitary Code), the approval of the variance is in harmony with the general purpose and intent of the Sanitary Code to protect groundwater and drinking water supplies, surface water and other natural resources, and public health, safety and welfare. Ms. Steelman offered that if the existing window is inadequate for an escape window an escape window would be installed on the second' floor on the south face allowing "Emergency" egress by means of a portable or folding emergency exit ladder; the window would have signage denoting it as an "exit window". The Board of Fire Commissioners at their regular meeting on January 9'h , 2007 voted to accept this proposal as meeting their recommendation included in their letter to your office on October 24, 2006. Yakaboski working for the applicant, Richard Orlowski, submitted a new formal site plan for approval; and WHEREAS, on October 5, 2006, the Architectural Review Committee reviewed the architectural drawings and associated site plan materials and approved the project; and WHEREAS, on October 16, 2006, the Southold Town Planning Board, acting under the State Environmental Quality Review Act (6 NYCRR), Part 617.5 c, makes a determination that the proposed action is a Type II and not subject to review; and WHEREAS, on October 20, 2006, the Suffolk County Department of Planning responded after review and determined this matter is for "local determination as there appears to be no significant county- wide or inter-community impact(s)" and the Planning Board accepts this pursuant to 239L & M General Municipal Law; and -Orlowski Hardware Company Page Two January 9, 2007 WHEREAS, on October 25, 2006, the Mattituck Fire District responded that no additional requirements for fire protection were necessary but that consideration of a second emergency exit from the second floor proposed office area be considered and the Planning Board accepts this recommendation; and WHEREAS, on October 26, 2006, the Suffolk County Department of Public Works responded after review stating a permit is not required "since the proposed development is not adjacent to a County maintained road"; and WHEREAS, on October 27, 2006, the New York State Department of Transportation, under Case No. 06-379P, responded after review that a Highway Work Permit "will not be required as long as all work is progressed outside the State ROW and the State ROW is not used to perform any work"; and WHEREAS, on November 20, 2006, the Suffolk County Department of Health Services responded after review that an application has been received under reference number C10-06-0015 and the application is incomplete pending the submission of the following items: • Office of Pollution Control approval for sanitary abandonment • Board of review determination regarding non-conformance with Department construction 4k standards; and HEREAS, on November 30, 2006, the Planning Board sent a letter to the agent, Francis Yakaboski, requiring the recommendation of the Mattituck Fire District be addressed; and WHEREAS, on December 5, 2006, the Southold Town Building Inspector reviewed and certified the site plan for a "Office" use; and WHEREAS, on December 8, 2006, Nancy Steelman, R.A. responded by letter addressing the recommendation of the Mattituck Fire District and the Planning Board, after review, continues to agree with the recommendation of the Mattituck Fire District; and WHEREAS, on December 27, 2006, the Suffolk County Department of Health Services responded that the SCDHS Board of Review would review this case at the Variance Hearing scheduled for January 18, 2007 under reference number C10-06-0015; and WHEREAS, on January 5, 2007, the Southold Town Engineer reviewed the site plan materials and replied with comments and the Planning Board accepts these comments; and WHEREAS, the Southold Town Planning Board, pursuant to Town Code §280-78, waives the parking requirements for the proposed site plan as the subject parcel is zoned Hamlet Business and municipal parking facilities exist within 300 feet of the proposed use and will adequately serve roposed use; and HEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; and -Orlowski Hardware Company Page Three January 9, 2007 WHEREAS, the following items shall be required: 1. All outdoor lighting shall be shielded so that the light source is not visible from adjacent properties and roadways. All signs shall meet Southold Town Zoning Codes and shall be subject to approval of the Southold Town Building Inspector. 3. The question of whether an action may be significant is not always easy to answer. Frequently, there are aspects of a project that are subjective or unmeasurable.
