Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part
661) no permit is required.
Be advised, no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary, as indicated above, without a permit.
It is your responsibility to ensure that all precautions are taken to prevent any sedimentation or
other alteration or disturbance to the ground surface or vegetation within Article 25 jurisdiction
which may result from your project. Such precautions may include maintaining adequate work

The Southold Town Board of Trustees reviewed the site plan prepared by Samuels &
Steelman, last dated March 8, 2008, and received on March 18, 2008, and determined
the proposed work of addition to an existing single family residence to be out of the
Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of
the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the
Coastal Erosion Hazard Area (Chapter 111 ) no permit is required. Please be advised,

plan prepared 9.95 by Peter T. Podlas, A.I.A. on file with the Building
Department and viewed in considering this request.

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions,
without an adverse effect on the environment if the project is implemented as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 34,000 square foot parcel has 110.50 feet along West
Road (also referred to as Pequash Avenue) and a lot depth of 305 feet along the easterly side property line.
The property is improved with a single-family, two-story frame dwelling and accessory garage as shown on the
June 20, 1968 survey prepared by Robert Kart, and the January 5, 1996 survey prepared by Roderick
VanTuyl, P.C.
BASIS OF APPLICATION: Building Department's November 1, 2005 Notice of Disapproval, citing Section
100-30A.3 in its denial of an application for a building permit concerning as-built alterations to a non-habitable
attic. The reason stated in the denial is that Section 100-30A.3 states that the construction is not permitted
unless the same conforms to the requirements of the Bulk Schedule and of the Parking Schedule, with the
same force and effect as if such regulations were set forth herein in full, and that the Bulk Schedule limits a
building to 2V2 stories, and stating further that the as-built construction converts the attic to a third story.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on January 26, 2006, at which time
written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of
the property, and other evidence, the Zoning Board finds the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: The applicants request a variance for a bedroom and storage
(closest and storage area) on the area above the second floor of the existing dwelling, as detailed on the "as
built" finished attic plan prepared 10/10/2005 by Eileen Santora, Residential Designer.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal
inspections, the Board makes the following findings:
1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a
detriment to nearby properties. The three-story house was constructed prior to 1957 with a finished habitable
space on the third floor and three small dormers, and rendered non-habitable after the 1938 hurricane. Two
out of the three dormers were destroyed in 1938. The area that was upgraded was interior, and renovated it
with updated electrical and energy compliant insulation.

2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to
pursue, other than an area variance. The dormers were restored under Building Permit 22830-Z issued in
1995, and extended under Building Permit 31329. There will be no expansion of the space, and the as-built
alteration is an updated replacement of the former habitable space, remaining the same as originally
constructed on the interior of the existing house.
3. The variance granted herein is not substantial and updates the area that was used on the third floor area.
4. The difficulty has been self-created because the building permit expired in 1996, after having been altered,
and a certificate of occupancy cannot be issued without a variance under the Town Code.
5. No evidence has been submitted to suggest that a variance in this residential community will have an
adverse impact on the physical or environmental conditions in the neighborhood. The two dormers were
replaced in 1996 and face the water, away from the road and the two adjacent houses. There will be no
outside change in the appearance of the home by the grant of the relief.
6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to
enjoy the benefit of interior alterations, while preserving and protecting the character of the neighborhood and
the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Simon, seconded by Chairwoman Oliva, and duly
carried, to
GRANT the variance as applied for, as shown on the "as built finished attic plan date 10-10-05
prepared by Residential Designer Eileen Santora, SUBJECT TO THE FOLLOWING CONDITIONS:
1. The dwelling shall be in compliance with the New York State Construction and Fire Codes.
2. No further expansion of the third floor living space shall be permitted.
This action does not authorize or condone any current or future use, setback or other feature of the subject
property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly
addressed in this action.

Following our discussion about this permit, your inspection and a review of our files, it appears
that the following occurred:
1.) Permit #22830 was issued in 1995 for the addition of doghouse dormers in a non-
habitable attic.
2.) Sometime in 1996, following a rough framing and plumbing inspection, amended
plans were submitted to this office, along with a Zoning Board of Appeals approval,
for the addition of a wrap around porch. However, the amended plans were not
reviewed and, subsequently, the plans were not amended.
3.) Earlier this month, as is policy, I simply renewed the existing original building permit
and, therefore, the new permit must be amended to include the warp around porch.
4.) Also, because your inspection revealed a habitable third story, the new permit will
also have to be amended to include this work.
At this time, the following is required from the applicant:
1 .) Amended plans (showing the third floor addition) from the applicant, meeting full
state code compliance (which includes the need for a sprinkler system) and a check in
the amount of $35 for the purpose ora Notice of Disapproval.
2.) The applicant will be forced to go for a variance from the Zoning Board of Appeals.
3.) If the applicant receives a variance from the Zoning Board of Appeals and the
addition meets full code compliance, they will move toward a certificate of
occupancy.

a single family dwelling at 995 West Road, Cutchogue, Suffolk County Tax Map
Number 110-7-3.
As you know, the original building permit was issued to add a deck/porch addition as
well as "dog house dormers" to a "non-habitable" attic area. Following a recent
inspection, it has come to our attention that the "non-habitable" attic has been converted
to living space which is a direct violation of the original permit, Southold Town Code
and, by design, New York State Code.

Southold, once you have applied for the "as built" work, along with a
check for $35, you will be issued a Notice of Disapproval from this
office. You will take that Notice of Disapproval and apply to the
Southold Town Zoning Board of Appeals (ZBA) for approval of the
third story.
A full set of drawings showing the layout of the third story and any
other work that has been done without first obtaining a building
permit. Be aware that the "as built" third story must meet all New
York State Code requirements, which may include the need for a full
sprinkler system.
Final approval. If the ZBA issues a variance for the "as built" work
and the work complies with all NYS Code requirements, you will be
issued a building permit and subsequently a certificate of occupancy.
Please be aware that additional agencies may be involved in this
project as the scope of work becomes apparent.

Product Description
Model RFC43 Concealed Residential Sprinklers are fast
response residential fusible solder link automatic sprinklers.
Residential sprinklers differ from standard sprinklers primarily
in their response time end water distribution patterns..
Model RFC43 sprinklers discharge water in a
hemispherical pattern below the sprinkler deflector.
Residential distribution pattems are higher and generally
centain a finer droplet size than standard sprinkler patterns.
The combination of speed of operation and high discharge
pattern required for residential sprinklers has demonstrated,
in fire testing, an ability for controlling residential fires, end
thereby providing significant evacuation time for occupants.
The RFC43 Sprinkler provides the best form of fire
protection by combining an atlractive appearance and 1/2"
(13mm) of cover adjustment for ease of installation. The
small diameter cover plate is easily and positively attached
and blends into the ceiling, concealing the most dependable
tire protection available, an automatic sprinkler system.
The RFC43 is a UL Listed Residential Sprinkler to be
installed in the residential pertions of any occupancy in
accordance with NFPA 13, 13R, & 13D.
The RFC43 can reduce the need for precise cutting of drop
nipples. The threaded cover plate assembly can be adjusted
without tools to fit accurately against the ceiling. The tire
protection system need not be shut down to adjust or remove
the cover plate assembly.
A~plication and Installation
e RFC43, for resibentleJ installetJORSl uses a 165°F (74°C)
fusible solder link in a tuning fork style sprinkler frame with a
drop~own deflecter. This assembly is recessed into the
ceiling end concealed by a flat cover plate. The cover plate is
attached to the skirt, using 135°F (57°C) ordinary temperature
classification sdder. When the ceiling temperature rises, the
solder holding the cover plate releases the cover allowing the
deflector to drop into position end exposing the sprinkler

inside to ceiling temperature. The subsequent operation of
the solder link opens the waterway and causes the defledor
to drop into posit~on to distribute the discharging water in a
hemispherical pattem below the sprinkler deflector. Any
adjustment of thread engagement between the cover plate
and cup will assure that the drop-down deflector is properly
located below the ceiling. The residential disbibution pattern
contains a finer droplet size than a standard sprinkler, and the
pattern produces significantly higher wall welting
After a 2 5/8 inch diameter hole is cut in the ceiling, the
sprinkler is to be installed with the Model FC Wrench. When
installing a sprinkler, the wrench is first positioned into the
sprinkler/cup assembly and around the hexagonal body of
the sprinkler frame. The Wrench must bottom out against the
cup in order to ensure proper, safe installation. The sprinkler
is then tightened into the pipe fitting. When inserting or
removing the wrench from the sprinkler/cup assembly, care
should be taken to prevent damage to the sprinkler. DO NOT
WRENCH ON ANY OTHER PART OF THE SPRINKLEF~CUP
ASSEMBLY. MODEL RFC43 CONCEALED SPRINKLERS
MUST BE INSTALLED ONLY WITH 135°F RATED COVERS.
Cover assemblies provide up to ~" (13mm) of
adjustment. Turn the cover clockwise until the flange is in
contact with the ceiling. Cover removal requires turning in
the counter-clockwise direction.
In ceilings that have a plenum space above the sprinkler,
the plenum space may have neutral or negative
pressurization but must not be positively pressurized. Inspect
all sprinklers after installatien to ensure ~at 'Ce gap between
the cover plate end ceiling end the 4 slots in the cup are all
open and free from any air flow impediment.

Maintenance
Model RFC43 Concealed Sprinklers should be inspected
qu~tody and the sprinkler system maintained in accordance
with NFPA 25. Do not clean sprinklers with soap and water,
ammonia or any other cleaning fluids. Remove dust by using
a soft brush or gentle vacuuming. Remove any sprinkler
cover plate assembly which has been painted (other than
factory applied) or damaged in any way. A stock of spare
sprinklers shocld be maintained to a~low quick replacement of
damaged or operated sprinklers. Prior to installation,
sprinklers should be maintained in the original cartons and
packaging until used to minimize the potential for damage to
sprinklers that would cause improper operation er
