WITNESSETH, that the party of the first part, in consideration of ........... Five Hundred Sixty Thousand and

unto the party of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that cedain plot, piec8 or parcel of land situate, lying and being at Fishers Island, Town of Southold, County
of Suffolk and State of New York, being more particularly bounded and described as set forth on Schedule A
hereto.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed recorded in
the Office of the Suffolk County Cterk on October 6, 2009 in Liber 12602 page 253.
SUBJECT TO a permanent easement which is hereby reserved by the party of the first part for ingress and egress
by pedestrians and vehicles end for the installation, maintenance and repair of utilities, said easement (a) to be
twenty-five feet in width and located along the westerly boundary lines of the subject premises and to extend from
the private, road on which the subject premises abut on the north to the~"{~x 40' right of way on which the subject
premises abut on the ~outh, all as more particularly described on Schedule A hereto, and (b) to be appurtenant
to and for the benefit of premises now owned by Chocomount, LLC and designated on the Suffolk County Tax
Map as District 1000, Section 008.00, Block~02400, Lot 009.000, said benefitted premises lying southwesterly of
the subject premises and adjoining saidlJ¢ x 40' right of way on the west.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premise~
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first
to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "padies" whenever the sense of this indenture so
requires.

ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Town of Southold, Suffolk County, State or New
York, being a part of that portion of Fishers Island lying easterly of the following line, viz:
BEGINNING at the southeasterly corner of land owned by the United States, known as the
Fort H.G. Wright Military Reservation, Mount Prospect Tract, on the shore of Block Island
Sound or the Atlantic Ocean and running thence northerly following the East boundary of
the said land of the United States to the southerly line of East End Road (sometimes called
Oriental Avenue) and which point is the northeasterly corner of land of the United States,
thence crossing the East End Road and following the same course as the last to the shore
of West Harbor or Fishers Island Sound; said lot or parcel of land being bounded and
described as follows:
BEGINNING at a stone monument set on the southerly side of Treasure Pond Road (forty
feet wide), said monument being 1261.57 feet South of a point which is 1568.58 feet West
of another monument marking the U.S. Coast and Geodetic Survey Triangulation Station
"Chocomount 2" (which said "Chocomount 2" monument is located on the summit of the
highest hill of Fishers Island, N.Y. about two and one-quarter miles West of the Eastern
end of Fishers Island and lies South 79 degrees 29 minutes and 46 seconds East of North
Dumpling Light in Fishers Island Sound); and
RUNNING THENCE South 62 degrees 06 minutes 30 seconds East, 392.20 feet to a stake
and land now or formerly of Cynthia C. Saint Amand;
THENCE along land now or formerly of Cynthia C. Saint Amand South 38 degrees 34
minutes 00 seconds West, 316.52 feet to a stake and land now or formerly of Jane F.
Geniesse;
THENCE along said land North 50 degrees 34 minutes 20 seconds West, 263.61 feet to
a stake;
THENCE North 22 degrees 56 minutes 40 seconds West, 202.81 feet to a stake set on the
southerly side of Treasure Pond Road (forty feet wide);
THENCE eastwardly along the southerly side of Treasure Pond mad (forty feet wide)
(following the am of a curve to the left whose radius is 250.11 feet and the direction of
whose radius at that point is North 12 degrees and 46 seconds West), 156.43 feet to the
place of BEGINNING.

premises now owned by Chocomount, LLC and designated on the Suffolk County Tax Map

southwesterly of the above described premises, and adjoining a 40' x 40' right of way on
the west, and said easement area being more particularly bounded and described as
follows:
BEGINNING at a point at the southwesterly corner of the above described premises, which
point is located 1692.55 feet South of a point which is 1419.29 feet West of a monument
marking the U.S. Coast and Geodetic Survey Triangulation Station "Chocomount 2" (which
said "Chocomount 2" monument is located on the summit of the highest hill of Fishers
Island, N.Y. about two and one-quarter miles West of the Eastern end of Fishers Island
and lies South 79 degrees 29 minutes and 46 seconds East of North Dumpling Light in
Fishers Island Sound); and
RUNNING THENCE North 50 degrees 34 minutes 20 seconds West, 263.61 feet to a
stake;
THENCE North 22 degrees 56 minutes 40 seconds West, 202.81 feet to a stake set on the
