FINDINGS OF FACT The Zoning Board of Appeals held a public headng on this application on October 23, 2003, 'at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence~ the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE F~ELIEF REQUESTED: Although the Notice of Disapproval notes that: the applicant pi'oposes alterations to an existing garage, applicant has applied for a variance to substantially remove the existing 20.5' x 28' accessory garage, rebuilding it of the same Size .and footprint at 3.6 feet from the northerly side property line and with vadablb'front yard setbacks at 18.5 feet and 14 feet, at the closest points. Alfred Magill of 1145 Fleetwood Rd. is planning on adding a 2 story garage on the original footprint of the old garage. He already has approval from the zoning board. The side wall height to the eaves is 15 ft. 11 in. and the peak is 20.6 ft. Neighbors had opposed a tall garage at the hearing and the first drawings for a 23 ft. tall garage were rejected and it was lowered to this height. However, in digging out the basement for the house which is being constructed now, the grad where the previous garage sat has been raised several feet. All neighbors, including Fleets Neck president Tom Wetzel can testify that there was a retaining wall and several cement steps in back of the garage which led up to the house. The variance states that the new garage must be on the existing grad. which was inspected at that time. We want to see this enforced. If allowed to build on higher ground, the garage will appear even taller and obstruct views further. You said someone from your department was already scheduled to visit the site Wed.
