HomeMy WebLinkAboutLP-09/28/2010LAND PRESERVATION COMMITTEE MEETING Minutes & Discussion Notes from Meeting held Tuesday, September 28, 2010 at 7:00 p.m. Members Present: John Sepenoski, Chairman Ray Huntington Lillian Ball Maureen Cullinane Members Absent: Chris Baiz Monica Harbes Eric Keil Also present: Melissa Spiro, Land Preservation Coordinator Melanie Doroski, Land Preservation Secretary Commencement: ?? The meeting began at 7:18 p.m. with four LPC members present. Adoption of Meeting Minutes: ?? ACCEPTANCE OF MEETING MINUTES FROM AUGUST 3, 2010, AUGUST 31, 2010 AND SEPTEMBER 14, 2010. HOLD minutes from August 3, 2010 and September 14, 2010 as quorum of attending members at these meeting were not present for vote. MOTION made by John Sepenoski, seconded by Maureen Cullinane, to accept the August 31, 2010 LPC meeting minutes, as corrected. Motion carried: 4/0 Land Preservation Applications and Inquiries: ?? SCTM #1000-52-5-60.2 (Yaxa) Review new application for PDR Melissa Spiro recommended that LPC members schedule a group field inspection of this property before acting on application. LPC agreed. Field inspection to be scheduled and members notified of date. ?? SCTM #1000-31-5-6 & 7.1 (Estate of Sonja Stein) Review application (open space/easement) Formal application received from Oysterponds Historical Society. Need more information and clarification before any further actions are taken by LPC. The members entered into EXECUTIVE SESSION. ?? SCTM #1000-45-5-3 & 4 (Sill) Update re: Town Board meeting [executive session] Review Environmental Site Assessment Town Board receptive to purchase. Town Board approved commissioning of a second appraisal to be prepared on the southern parcel accessed by crossing LIRR tracks. Reviewed Randy Parson’s inquiry as to whether or not LPC wanted to proceed with Environmental Site Assessment at this time to get better idea of clean-up costs. LPC not in favor of proceeding with this at this time. END OF EXECUTIVE SESSION ?? SCTM #1000-120-3-11.9 (KKP, LLC – Peter Harbes) Update of status LPC offer for development rights easement accepted by landowner and proceeding with contract preparation. Anticipate closing on this project by the end of the year 2010 as requested by landowner. ?? SCTM #1000-54-7-21.1 (Conway) Update re: status and next steps LPC Chair, John Sepenoski, was not present for a discussion of this project due to a family relationship. Melissa told LPC that contracts signed by landowner, that landowner has proceeded with some of the items from home inspection and that lot line application before Planning Board. Hearing will be scheduled soon. Addition to Agenda: ?? SCTM #1000-84-1-11 & 12.1 (Demchak) Status update. Landowners submitted application to Planning Board for a proposed Open Development Area (“ODA”). Federal grant will allow for sod farming provided soil is tested and meets federal requirements. Landowners are hoping to close by the end of the year 2010. Applications & Inquiries for Uses or Structures on Preserved Property: ?? SCTM #1000-58-1-1.1 (Town Open Space: Bittner) Planting & Grading Plan John Sepenoski gave update. Jim told Melissa and John that he plans to wait until spring time to plant as grant expired and awaiting extension. Al Krupski to bring matter before the Town Board again. ?? SCWA Notice of Intent to Cross Laurel Lake Preserve Formalize e-mail responses MOTION made by John Sepenoski, seconded by Maureen Cullinane, to support Suffolk County Water Authority’s request to cross Town-owned property per executed licensing agreement and adopted Management Plan for the Laurel Lake Preserve. Motion carried: 4/0 ?? SCTM #1000-100-4-5.4 (Smithen – Sherwood House Vineyard) Update re: violation status Letter from neighbor Mary Anne Coe Letter from neighbor reviewed, as well as letter received from landowners, Charles and Barbara Smith in response to Coe letter. Advice received from Town Attorney, that there is no need for LPC to respond to complaint letters. Status of violation – Justice Court dated of10/29/2010 @ 9:30 a.m. to respond to violation regarding tasting room locating and operating within Town preserved easement area. ?? SCTM #1000-19-1-1.4 (Cullinane) Request application for poultry house, covered run and fenced pasture HOLD for next LPC meeting. No voting majority present. Stewardship and Management: ?? MONITORING (PROPERTY CONDITION) REPORTS: SCTM #1000-63-2-6.2 Reinckens/Duffy (per John Sepenoski) o SCTM #1000-69-1-9.1 Doroski Family (per John Sepenoski) o SCTM #1000-84-1-3 Demchak (John Sepenoski/Melanie Doroski) o SCTM #1000-84-3-2.2 Lieb Vines (John Sepenoski/Melanie Doroski) o SCTM #1000-95-1-4.3 Schreiber (John Sepenoski/Melanie Doroski) o HOLD – due to time constraints Ray Huntington and Maureen Cullinane handed in field inspection monitoring reports that will be added to next LPC agenda for discussion. General Land Preservation Items: ?? FARMLAND BOND POLICY A policy is being drafted regarding the $4 million bond for procedures for Town’s purchasing and selling farmland properties. It is expected that the draft will be presented by the Town Attorney to the Town Board at their work session on October 5, 2010. ?? DEVELOPMENT RIGHT EASEMENT LANGUAGE LPC discussed easement language sections concerning Chapter 70 of the Southold Town Code and §301(2)(a-j) of NYS Ag & Markets Law in relation to easement sections pertaining to references to existing Code/Law and allowances for future amendments to the Code/Law. LPC members opinions varied. Further discussion necessary. Action was taken relating specifically to KKP, LLC easement language as decision needed in order to process and complete project by end of the year. LPC decided to allow easement language to reference Chapter 70 of the Southold Town Code, as may be amended and NYS Ag & Markets Law §301(2)(a-j) as may be amended provided any future changes made to the Ag & Markets list be inherently similar in nature to those as now defined in “”a-j” list. ?? CPF TASK FORCE UPDATE Rules and regulations drafted by CPF Task Group for stewardship purposes will be presented at Supervisors & Mayors meeting. Informational: ?? None Next Regular Meeting: ?? The next regular meeting will be held on October 12, 2010, at 7:00 p.m., in the Annex Executive Board Room. Adjournment: ?? The meeting was adjourned at 10:30 p.m. by the three remaining LPC members.
